Other Than Full and Open Competition (Brand Name Only)

Acquisition Plan Action ID: VA246‐18‐AP‐2854

1. Contracting Activity: Department of Veterans Affairs, VISN 6, Network Contracting Office (NCO), Durham Veterans Affairs Medical Center, Durham, North Carolina 27705.

2. Nature and/or Description of the Action Being Processed: This is a Brand Name Only Procurement to add another Vision Align RT: Real Time Patient Positioning, Tracking and Surveillance System. The system will connect to system already in place and must be installed and aligned to validate accuracy by manufacturer.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: DurhamVAMCis
requestingrealtime3DsurveillancecapabilityforRadiationOncologyshowinga
continuouslyupdatingdisplayusingVisionRT.Thiswillshowanymotioninallsix
degreesoffreedomandmaybeviewedthroughouttreatment.Inaddition,selected
regionsofthepatient’ssurfacemaybemonitoredinrealtime.Anymovementsoutside
userdefinedtolerancesaredetectedautomatically.Thisisbestpracticeforexternal
bodysitessuchasbreast,sarcomas,andforuseinallhighdosecasestoensureaccurate
setupanddetectpatientmovementduringtreatment.

4. Statutory Authority Permitting Other than Full and Open Competition:

( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302‐1;

( ) (2) Unusual and Compelling Urgency per FAR 6.302‐2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302‐3;

( ) (4) International Agreement per FAR 6.302‐4 ( ) (5) Authorized or Required by Statute FAR 6.302‐5;

( ) (6) National Security per FAR 6.302‐6;

( ) (7) Public Interest per FAR 6.302‐7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Per FAR 6.302‐1 this is a follow‐ on contract for a specific system used for patient setup and surveillance of external anatomy for radiation oncology patients. This system is the only real time surface guided equipment that is used specifically for radiation oncology by defining the radiation treatment area region of interest. Radiation Oncology is using high doses of radiation with millimeter

Revision 06 Date: 08/30/2017 precision. This equipment is used in coordination with the linear accelerator to track patient movement, ensure external anatomy is reproduced accurately and to visualize respiratory motion.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Sources Sought posted on FBO December 12-18, 2017 revealed two large business. Searched VIP 12/28/2017 using NAICS code 332510 and keyword: Real Time Patient Positioning. Found 6 SDVOSB & 7 VOSB, none could provide requirement requested.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: Thesystemincreasespatienttreatmentaccuracy.Thisisbestpracticefor
externalbodysitessuchasbreast,sarcomas,andforuseinallhighdosecasestoensure
accuratesetupanddetectpatientmovementduringtreatment.Ifanotherbrandis
purchase,anadditionalcostwouldbeaddedtothefacilitytoreplacethesystemin

place.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Sources Sought posted on FBO December 12-18, 2017 revealed two large business. Searched VIP 12/28/2017 using NAICS code 332510 and keyword: Real Time Patient Positioning. Found 6 SDVOSB & 7 VOSB, none could provide requirement requested.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: C‐RAD Inc

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required: N/A
