Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($150K)

1. Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton VA Medical Center, 100
Emancipation Drive, Hampton VA 23667.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
This requirement is for a brand name (Arthrex-Large Business) request to supply the Fayetteville VAMC with a Shoulder Instruments Repair Set. The Shoulder Repair Set is a comprehensive selection of specialty instruments to facilitate arthroscopic shoulder repairs. The set contains the most popular instruments as determined by leading upper extremity surgeons. A wide variety of arthroscopic suturing instruments facilitates multiple options to deal with most anatomical variations.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The Shoulder Instrument Repair Set for this acquisition is proprietary to Arthrex Inc. Due to lack of facility instrumentation, the Fayetteville VAMC is currently sending patients requiring shoulder surgery to an alternate facility for the procedure. The alternate VAMC uses the Arthrex Shoulder Repair Set requested with this acquisition to perform their shoulder surgery cases. Once procured, the Fayetteville VAMC will be able to provide this service in-house, increasing their scope of care, saving on external facility expenditures and reducing patient wait times. The Fayetteville VAMC surgeons are extensively trained on these devices and making a brand-name purchase will allow for a seamless transition in bringing this procedure in-house.
4. Description of market research conducted and results or statement why it was not conducted:
A sources sought notice was posted to FBO on 4/26/18 to gauge the interest of the current marketplace. Only one (1) response was received from industry expressing interest in the acquisition (Tattersall Inc; DUNS: 153789961/ WOSB). Despite the limited responses to the sources sought, the manufacturer (Arthrex) provided three (3) authorized SDVOSB distributors/resellers of their products; (Clear Vista LLC; DUNS: 831493320, Bayside Medical; DUNS: 883429409, TQM LLC; DUNS: 883012874). When contacted via email, 2 of the 3 (ClearVista LLC & Bayside Medical) expressed interest in bidding on the requirement. Market research indicated that the VA Rule of 2 would apply to this acquisition. The government intends to pursue a brand-name, 100% SDVOSB set-aside for this procurement.
