B.4 STATEMENT OF NEED
HANDHELD SELF-POSITIONING 3D BLUE LASER SCANNER SYSTEM
VA PITTSBURGH HEALTHCARE SYSTEM
Background
The Human Engineering Research Laboratories (HERL) of the VA Pittsburgh Healthcare System (VAPHS) has a requirement for a Handheld Self-positioning 3D Blue Laser Scanner System. This is a brand-name or equal requirement. The brand-name reference is Creaform HandySCAN BLACK ELITE. The NAICS Code is 334118.
Scope of Need
The Human Engineering Research Laboratories (HERL) of the VAPHS has a requirement for a brand name or equal requirement for a Handheld Self-positioning 3D Blue Laser Scanner System. The Laser Scanner system is a device that uses laser range finding to measure and digitally register and record shape and measurements.
The uses for the device are for scanning a wide range of items, from gears to human hands, and inputting the scanned data into a format that can be viewed, analyzed, and edited using Computer Aided Design Software (CAD). HERL will use these scans to create new Assistive Technologies (AT) that works closely with existing AT products or interfaces in a custom fitted way to Veterans who need AT.

Salient Characteristics
The scanner hardware must:
• Have an accuracy of .025 mm or better
• Have a measurement resolution: 0.025 mm or better
• Have a blue laser light source
• Have a scan speed of at least 1,300,000 measurements/second
• Must be an eye safe laser
• Must be able to scan parts as small as 0.05m and as large 4m
• Must have USE 3.0 connection
• Must be handheld scanning head allowing freedom of movement that does not require external positioning or tracking devices such as CMMs, poly-articulated arms, laser trackers, GPS, electro-magnetic positioning devices or any other positioning systems external to the part and or scanner head
• Not be influenced nor sensitive to material (namely metallic parts) in the vicinity of the scanning head or parts
• Have a system that is solid-state (i.e. does not contain any moving part)
• Be portable, the scanner and its accessories fit into a portable case the size of a carry-on baggage
• Have an acceptance test of the system is ISO 17025 accredited
• Output file in a wide range of common formats including dae, .fbx, .ma, .obj, .ply, .stl, .txt, .wrl, .x3d, .x3dz, .zpr, .3mf
• Have direct mesh output so an optimized mesh that can be exported in all standard formats as the scan acquisition is completed with no manual alignment or point cloud processing
• Be able to save the scan as one file, and can be imported into Solidworks 2021 CAD software as a direct mesh without post-processing treatment to remove erroneous data, smooth out the surface, etc
• Have real-time visualization of the 3D surface as the object that is being scanned
• Be highly accurate (better than .03mm) to get the detail needed to reproduce parts so that parts fit together mechanically.
• Be designed for use with small to mid-sized mechanical parts. HERL needs to scan mechanical parts ranging from “penny” sized to power wheelchair sized.
We do not need to scan larger areas such as rooms, buildings, or construction sites. These types of scanner are less accurate in surface detail and create enormous amounts of data that must be processed and stored.
• Be handheld packaging the intention is to move the scanner around existing parts to 3D scan them. Fixed point systems (systems on “arms” or that spin on tripods) limit are limited in the geometry of the items they can scan. Handheld allows for maximum flexibility.
• Contain software that integrates into Solidworks Directly – All scanners have an accompanying software package that allows them to function and are integral to their use. All scanners generate a “point cloud”; however, this data is not very useful for reverse engineering applications, as it has no inherent structure recognized by CAD software packages. Additional software features are needed to interpret this point cloud and create dimensional structures that are recognized and editable in CAD software. Additionally, HERL has an existing CAD software package called Solidworks that has been in use at HERL for 15+ years. Any scanner software would need to closely integrate with SolidWorks.
**Please include a spec sheet with your quote so that the Government can compare your product with the list of required salient characteristics.
GRAY MARKET ITEMS
No gray market or remanufactured items will be acceptable. Gray market items are Original Equipment Manufacturers’ (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical equipment only for VA medical facilities.
**Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
**FAILURE TO INCLUDE THE LOA FROM THE MANUFACTURER WILL EXCLUDE YOUR
QUOTE FROM CONSIDERATION.

(DEVIATION)
(a) Evaluation preference.
(1) Offers will be evaluated by adding a factor of 10 percent to the price of all offers, except—
(i) Offers from HUBZone small business concerns that have not waived the evaluation preference; and
(ii) Otherwise successful offers from small business concerns.
(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.
(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.
(b) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes.

(a) Applicability. This clause does not apply to the extent that the Contractor is supplying end products mined, produced, or manufactured in—
(1) Israel, and the anticipated value of the acquisition is $50,000 or more;
(2) Mexico, and the anticipated value of the acquisition is $83,099 or more; or
(3) Armenia, Aruba, Australia, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czech
Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Korea, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, Ukraine, or the United
Kingdom and the anticipated value of the acquisition is $182,000 or more.
(b) Cooperation with Authorities. To enforce the laws prohibiting the manufacture or importation of products mined, produced, or manufactured by forced or indentured child labor, authorized officials may need to conduct investigations to determine whether forced or indentured child labor was used to mine, produce, or manufacture any product furnished under this contract. If the solicitation includes the provision 52.222-18, Certification Regarding
Knowledge of Child Labor for Listed End Products, or the equivalent at 52.212-3(i), the
Contractor agrees to cooperate fully with authorized officials of the contracting agency, the
Department of the Treasury, or the Department of Justice by providing reasonable access to records, documents, persons, or premises upon reasonable request by the authorized officials.
(c) Violations. The Government may impose remedies set forth in paragraph (d) for the following violations:
(1) The Contractor has submitted a false certification regarding knowledge of the use of forced or indentured child labor for listed end products.
(2) The Contractor has failed to cooperate, if required, in accordance with paragraph (b) of this clause, with an investigation of the use of forced or indentured child labor by an Inspector
General, Attorney General, or the Secretary of the Treasury.
(3) The Contractor uses forced or indentured child labor in its mining, production, or manufacturing processes.
(4) The Contractor has furnished under the contract end products or components that have been mined, produced, or manufactured wholly or in part by forced or indentured child labor.
(The Government will not pursue remedies at paragraph (d)(2) or paragraph (d)(3) of this clause unless sufficient evidence indicates that the Contractor knew of the violation.)
(d) Remedies.
(1) The Contracting Officer may terminate the contract.
(2) The suspending official may suspend the Contractor in accordance with procedures in
FAR Subpart 9.4.
(3) The debarring official may debar the Contractor for a period not to exceed 3 years in accordance with the procedures in FAR Subpart 9.4.

C.5 VAAR 852.212-71 GRAY MARKET ITEMS (APR 2020)
(a) No gray market or remanufactured items will be acceptable. Gray market items are Original
Equipment Manufacturers’ (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical equipment only for VA medical facilities.
(b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the
OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.

2020)
(a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided.
This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory.
(b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the
Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor
Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the
Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award
Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representations. (1) The Offeror represents that it [ ] does, [ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the
Government in the performance of any contract, subcontract, or other contractual instrument.

(2) The Offeror shall list as foreign end products those end products manufactured in the
United States that do not qualify as domestic end products.
(3) The terms ‘‘domestic end product,’’ ‘‘end product,’’ and ‘‘foreign end product’’ are defined in the clause of this solicitation entitled ‘‘Buy American—Supplies.”

(a) Definitions. As used in this provision—
"Manufactured end product" means any end product in product and service codes (PSCs)

(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;

(b) For statistical purposes only, the offeror shall indicate whether the place of manufacture of the end products it expects to provide in response to this solicitation is predominantly—

E.5 52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
LPTA - Offers will be evaluated on a pass/fail basis for adherence to technical requirements.
Of those offers that pass the technical evaluation, the lowest priced offer will be selected for award.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) Definitions. As used in this provision—
Covered telecommunications equipment or services has the meaning provided in the clause
52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance
Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
