B.3 STATEMENT OF WORK

1.0 General:

The Veterans Health Administration (VHA) has a requirement for Modular Cabinets for Erie, PA Dental Project that meet the VHA requirements.

This requirement includes modular casework, design, project management, professional installation and maintenance/ warranty services.

Finish requirements: Vendor shall provide the government with finish options appropriate to the finish type or grade indicated with bid package – include laminate, metal, and pulls options as requested.

Included with bid package must have product specifications and cut sheets for each item that is submitted documentation must include at minimum images, dimensions, product construction, warranty, for all detailed information showing that substitution meets all requirements of the items specified in this package.

2.0 Performance Requirements:

The contractor shall provide and be responsible for the technical assistance, development and generation for final specifications.

Install items as per the specifications.

Prepare and provide as built furniture drawings in PDF and AutoCAD.

Provide maintenance manuals for all products specified.

3.0 Kickoff Meeting:

The prime contractor(s) shall participate in a kickoff meeting within ten (10) days of contract award, in person at Erie, PA. Time and date will be determined by VA Point of Contact.

4.0 Services:

All items to be delivered/ received at vendor warehouse then delivered to job site for install.

There is no loading dock available for deliveries. All deliveries will be offloaded on ground level outside in designated area.

All packing and trash to be removed by vendor and disposed of at vendor warehouse.

5. Design Contract Tasks/Requirements The contractor shall attend a minimum of three (3) in-person meetings at the Erie, VAMC to review final award with VA Interior Designer and End Users and to make necessary revisions.

During first meeting the contractor shall provide the Interior Designer with the Auto-Cad drawings to [1/4” – 1/8”] scale drawings showing layouts of awarded product.

The contractor shall allow for three (3) revisions per line item included in design services including updating Auto-Cad Drawings and PDFs as request by VA Interior Designer.

The contractor shall be responsible for taking and applying accurate field measurements to ordered product for verification of correct sizing. Auto-Cad drawings may not be accurate finished dimensions and may not be used in place of field measurements. The Vendor shall be liable for any incorrect field measurements leading to incorrect product order.

The contractor shall be responsible for providing all sample materials for awarded product (2-Day Delivery) as requested by VA Interior Designer.

The product must not be placed into production without clearance from the VA COR.

The contractor shall provide final, clean [1/4” – 1/8”] scaled drawings of product layout for sign-off prior to scheduling manufacturing.

The contractor shall track manufacturing schedule and notify VA Interior Designer with updates of estimated completion date by email.

The contractor shall attend a post-installation meeting to assess, address, and document any punch-list items and shall submit to the VA Interior Designer a remediation plan within 5 business days.

The contractor shall provide 30 days free storage.

6.0 Privacy Training:

Contractor and/or subcontractors will be required to take the VA Privacy Training for Personnel without Access to VA Computer Systems or Direct Access or Use to VA Sensitive Information If contract is for more than one year, the training must be completed annually

7.0 Product:

General All finished surfaces shall be free of scratches, mars, dents, or blemishes, and withstand staining, and exhibit to flaking, cracking, or loss or adhesion.

Furnishings shall have smooth finishes with no hazardous projections, sharp corners, or detail, which can be hazardous and cause personal injury or damage to clothing.

See below for technical requirement of products.

The Government maintains the option to modify the normal work week, days and hours, as necessary for the accomplishment of VHA mission.

All work required by other trades shall be identified under this section by the Bidder.

Basis of Design- A-Dec Inspired Casework

MTR Requirements for Basis of Design:

Field verification by vendor required prior to ordering – height/depth/width of cabinets may alter after field verification then indicated in scope of work. Changes should be accommodated without additional charges to the VA.

A component-based line of cabinetry and coordinating work tops to be used in labs, patient rooms, storage rooms, pharmacy, supply areas, break rooms, dayrooms, and limited office spaces to supply a “built- in” look while maintaining the quality and flexibility of a modular approach.

A wide variety of fully modular cabinet components available for upper and lower storage on 6” modules, allowing cabinets to be moved and reconfigured.

Cabinet front constructed of HPL or thermoform over a ½” minimal thickness low VOC substrate with all edges sealed with matching edge-band or thermo-formed radius edges.

Cabinet interiors full metal inside for infection control – no laminate will be accepted.

Drawer construction options of standard box type with replaceable drawer front and unitary interior box for use in healthcare.

Full extension steel ball bearing drawer glides.

Adjustable 4-way hinges.

Adjustable height shelving – metal or tempered glass shelves Integral seamless backsplash caulked and sealed at side seams and at wall.

Ability to coordinate with building plumbing and medical gases.

The countertop height is 30” with 3/4” thick solid surface Countertop with 2” Backsplash Counter vendor to provide solid surface options available for selection with bid Soft-close drawers for all drawers Lower cabinets All lower cabinets will have options of HPL, Solid Surface, Chemical resistant HPL, epoxy resin, and Phenolic surfaces.

Upper Cabinets All doors to have resin/ decorative glass inserts Color-coded drawer bins to be provided in each drawer to fill drawers.

Yellow bins 3”x 3” – Qty: 4 per drawer Red bins 3”x 6” – Qty: 4 per drawer Blue bins 3”x 9” – Qty: 4 per drawer

Finish base covers must be provided with product matching material of cabinets.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(End of Clause) C.4 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov); and

(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) General.

(1) Offers are solicited only from verified service-disabled veteran-owned small business concerns. Offers received from concerns that are not verified service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran-owned small business concern.

(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.

(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of . Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

C.8 VAAR 852.270-1 REPRESENTATIVES OF CONTRACTING OFFICERS (JAN 2008)

The contracting officer reserves the right to designate representatives to act for him/her in furnishing technical guidance and advice or generally monitor the work to be performed under this contract. Such designation will be in writing and will define the scope and limitation of the designee's authority. A copy of the designation shall be furnished to the contractor.

C.9 VAAR 852.246-71 REJECTED GOODS (OCT 2018)

(a) Supplies and equipment. Rejected goods will be held subject to Contractor’s order for not more than 15 days, after which the rejected merchandise will be returned to the Contractor’s address at the Contractor’s risk and expense. Expenses incident to the examination and testing of materials or supplies that have been rejected will be charged to the Contractor.

(b) Perishable supplies. The Contractor shall remove rejected perishable supplies within 48 hours after notice of rejection. Supplies determined to be unfit for human consumption will not be removed without permission of the local health authorities. Supplies not removed within the allowed time may be destroyed. The Department of Veterans Affairs will not be responsible for, nor pay for, products rejected. The Contractor will be liable for costs incident to examination of rejected products.
