This project shall generally consist of, but is not limited to; Providing all labor, supplies, transportation, and equipment required to construct new sidewalks, curbs, gutter curbs, accessible ramps, handrails, steps, slopes, and landscaping at the Coatesville VA Medical Center (CVAMC) in accordance with the Statement of Work, the solicitation attachments, and while remaining in compliance with all applicable Federal, State, and local codes.

This solicitation is issued under the authority of 38 U.S.C. 8127, Total Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside. As such, this project is 100% set-aside for SDVOSB concerns. Bidders must be verified as SDVOSB per the Center for Veterans Enterprises (CVE) www.vetbiz.gov website.

The magnitude of construction is between $100,000 and $250,000.

The small business size standard is $36.5 million. The North American Industry Classification System (NAICS) code is 236220.

ITEM I, BASE BID: The contractor shall Provide all labor, supplies, transportation, and equipment required to construct new sidewalks, curbs, gutter curbs, accessible ramps, handrails, steps, slopes, and landscaping at the Coatesville VA Medical Center (CVAMC) in accordance with the Statement of Work, the solicitation attachments, and while remaining in compliance with all applicable Federal, State, and local codes. Attachment A – Drawings, Attachment B – Specifications, Attachment C – Safety and Health During Construction – VHA Directive 7715, and Attachment D – CVAMC Campus Map – Areas 1 – 7, are attached for reference.

STATEMENT OF WORK

FOR

CURB AND SIDEWALK REPLACEMENT

PROJECT NO. 542-19-112

COATESVILLE VA MEDICAL CENTER

DESCRIPTION:

This project includes all necessary work associated with the construction of new sidewalks, curbs, gutter curbs, accessible ramps, handrails, steps, slopes, and landscaping for the Coatesville VA Medical Center, at various locations throughout the facility. The contractor shall comply with the Department of Veteran’s Affairs (VA) performance requirements listed herein, as well as all applicable Federal, State, and local codes.

PLACE OF PERFORMANCE:

The Coatesville VA Medical Center (CVAMC) - 1400 Blackhorse Hill Rd, Coatesville, PA 19320;

1) Area 1 will be located outside Building 138, with a walk way size of approximately 12’x 20’ and a curb size of approximately 25’x 2’. The type of work done in this area will include installation of new sidewalk, gutter curb, accessible ramp, truncated dome and landscaping.

2) Area 2 will be located outside Building 138, will involve two walk ways sized approximately 23’ x 19’ and 52’ x 9’, as well as a curb size of 25’ x 2’. The type of work involved in this area will include installation of sidewalk, gutter curb and landscaping.

3) Area 3 will be located outside Building 57, with a walk way size of approximately 58’ x 5’. The type of work involved in this area will include sidewalk, reinstall hand rail, slopes and landscaping.

4) Area 4 will be located outside Building 38, with a walk way size of approximately 32’ x 6’. The type of work involved in this area will include a sidewalk and landscaping.

5) Area 5 will be located outside Building 9, with a walk way size of approximately 72’ x 6’ and a curb size of approximately 48’ x 8”. The type of work involved in this area will include a sidewalk, curb and landscaping.

6) Area 6 will be located outside Building 8, with a walk way size of approximately 120’ x 6’. The type of work involved in this area will include a sidewalk and landscaping.

7) Area 7 will be located outside Building 10, with a walk way size of approximately 14’ x 6’, as well as a curb size of approximately 7’ x 18”. The type of work involved in this area will include sidewalk, steps, reinstall handrail, accessible ramps, truncated dome and landscaping.

PERFORMANCE REQUIREMENTS:

The contractor shall provide all labor, supplies, transportation, and equipment required to construct new sidewalks, curbs, gutter curbs, accessible ramps, handrails, steps, slopes, and landscaping at the Coatesville VA Medical Center (CVAMC) in accordance with the Statement of Work, the attachments provided, and while remaining in compliance with all applicable Federal, State, and local codes.

B. Construction:

1) The contractor shall provide the following in accordance with attachments; A, B, C, and D. Work will include, but is not limited to;

a. Sidewalks that present a safety hazard due to any of the following: heaved, cracked, depressions, missing sections and/or drop-offs along the sides; will be replaced.

b. Curbs that are either; missing, cracked, or are not in compliance with pedestrians with disabilities when transitioning to asphalt will be replaced. American with Disabilities Act (ADA) tactile warning signs will be installed at curb ramps which meet with asphalt roads.

c. Sidewalks which exhibit a slope greater than 1:12, and 8.33%, must be redesigned to meet a slope of 1:12 (8.33%) in accordance with federal, state, and local regulations to comply with handicap accessibility.

d. Handrails and Accessible Ramps will be reinstalled in accordance with Federal, State, and local regulations to comply with handicap accessibility.

C. Contractor’s Responsibilities:

1) The contractor is responsible for verifying all site conditions prior to performing any work under this contract, and follow all guidelines and standards, applicable to the task, as described in the Construction Safety Standards and Master Construction Specifications.

2) Before opening any excavation for repairing slopes of sidewalks, it is the contractor’s responsibility to verify the existence of underground utilities prior to excavation. As-built drawings are available for review, however, the contractor shall not rely on drawings as sole source of locating underground utilities.

3) Contractor shall verify all site dimensions prior to demolition and construction.

4) The contractor is responsible for submitting a list of parts and materials to the COR for approval prior to use.

5) The contractor is responsible for protecting adjacent structures, equipment, vehicles, pedestrians, and vegetation while performing under this contract.

6) The contractor is responsible for replacing concrete walkways that were removed, disrupted, or damaged during this project. This includes all grounds, pavements, and any other damages caused by the contractor during this project. Damages shall be replaced, not repaired.

7) Contractor is responsible for landscaping restoration in areas where damages occurred while demo or replacing during the project.

8) The contractor shall be responsible for the actions of all individuals provided to work under this contract. If in the event damages arise from work provided by contractor personnel, the contractor shall be responsible for all resources necessary to remedy the incident (including damages to landscaping) at no additional cost to the Government.

9) The contractor shall be responsible for ensuring that all individuals provided to work under this contract are properly licensed to operate a motor vehicle, if operating a motor vehicle on VA property is required.

10) The contractor shall adhere to all Occupational Safety and Health Administration (OSHA) regulations, as well as the safety regulations of the CVAMC while performing under this contract; see Attachment C - Safety and Health During Construction.

11) The contractor shall ensure the worksite is properly cleaned up during construction and when work is complete.

12) The contractor shall dispose of all residues off-site in strict accordance with all applicable Federal, State and Local regulations.

D. Warranty:

All services provided by the contractor, as well as parts replaced shall come with a one (1) year warranty (minimum). All labor, tools, supplies, transportation, and equipment associated with the replacement of warranty items shall be provided by the contractor at no additional cost to the Government.

E. Interference in Performance Requirements:

The following provisions shall be adhered to by contractor personnel throughout the duration of this contract:

1) The contractor may be required to interrupt their work at any time so as not to interfere with the normal functioning of the facility; e.g. utility services, emergency responses, the passage of facility patients/personnel, etc.

2) In the event of an emergency, contractor services may be stopped and rescheduled at no additional cost to the Government.

F. Construction Barrier:

The contractor shall provide a safety barrier around the construction site / work area, comprised of fences, signs, cones, caution tape, etc.

G. Materials:

The contractor shall only supply new items that are equivalent to the existing equipment. All materials or items to be supplied by the contractor that are not listed in an attachment must first be submitted to the Contracting Officer Representative (COR) and the Contracting Officer (CO) for approval prior to installation.

H. Contractor Required Reporting:

1) Prior to the completion of all weekly work activities, the contractor shall exclusively supply the COR, with his/her company’s work-documentation (daily logs).

2) The contractor shall supply the COR with any product literature and maintenance requirements for all items installed under this contract.

I. Required Contractor Notifications:

1) Contractor personnel shall inform the COR of the need to gain access to secured areas. If access is required to secured areas, prearranged scheduling will be coordinated between the contractor and the COR.

2) The contractor shall coordinate all pedestrian traffic at least 2 weeks prior.

3) If work is required beyond the terms of this contract, the contractor shall provide the Contracting Officer (CO) and the COR with a written cost estimate for any additional work or materials at no cost to the Government. The contractor shall not perform any work or make any purchases beyond the terms of this contract without approval from the CO.

J. Project Completion:

1) The contractor shall complete all contract work and schedule a final inspection within the specified performance period. During the final inspection, the contractor shall demonstrate for the COR that all newly constructed items under this contract are functioning properly prior to the Government’s final acceptance.

2) Should the Contractor fail to complete the contract work (including scheduling of the final inspection), and it is determined by the Government to be a contractor-caused delay, the Contractor shall be in default status.

PERFORMANCE SCHEDULE:

A. Normal Working Hours:

1) Normal working hours will be from 7:00 AM to 4:30 PM, Monday through Friday (excluding Federal holidays).

2) Off-hour work may be required to accommodate special circumstances.

B. Commencement of Work:

The contractor shall be required to commence work under this contract within ten (10) calendar days of receipt of the notice to proceed.

C. Period of Performance:

The contractor shall complete all work no later than one hundred and twenty (120) calendar days of receipt of the Notice to Proceed.

INSTRUCTIONS TO BIDDERS

INFORMATION REGARDING BIDDING MATERIALS:

A. Bidders are required to submit sealed offers in accordance with the instructions outlined in Section 13 (cover page of Standard Form 1442) and by submitting a bid amount on the Cost/Price Schedule, located on Page 5. Electronic submittals will not be accepted.

B. Bids shall be hand-delivered to the Department of Veterans Affairs, Lebanon VA Medical Center, 1700 S. Lincoln Ave. Building 99, Room 43 (Conference Room), Lebanon, PA 17042.

C. Bid materials consisting of drawings, specifications and contract forms may be obtained by qualified General (Prime) Contractors interested in submitting Bids directly to the Department of Veterans Affairs.

D. Questions regarding the solicitation must be submitted to the Contract Specialist by email at Lev.Stowe@va.gov, no later than June 20, 2019, at 4:00 PM (Local), after which time questions will not be answered.

SITE VISIT:

In accordance with FAR 52.236-27 – Site Visit (FEB 1995), interested parties are encouraged to attend the scheduled Site Visit, which will be held at the Department of Veterans Affairs, Coatesville VA Medical Center, 1400 Blackhorse Hill Road, Building 70 (Conference Room), Coatesville, PA 19320, on June 14, 2019 at 10:00 AM (Local).

B. Set-Aside Requirement:

As required by the statutory requirement pertaining to the Veterans Benefits Act of 2003 (15 U.S.C. 657f) and in accordance with FAR 6.206, this procurement will be set-aside for Service-Disabled Veteran-Owned Small Business (SDVOSB) concerns. Only SDVOSB concerns who are verified in the Vendor Information Page (VETBIZ) and registered in System for Award Management (SAM.gov) will be eligible to submit a bid.

C. Minimum Standards of Workmanship:

All work shall be performed in compliance with all Federal, State and Local Laws and Regulations. In addition, work will meet equipment’s manufacturer and generally accepted industry standards of good workmanship. All waste materials shall be disposed of by the contractor in compliance with Federal, State, and Local laws and regulations.

D. Contracting Officer Representative (COR):

1) (In accordance with VAAR 1.604 and 1.602-2) the COR assists in the technical monitoring or administration of a contract. Limited authority is given in writing by the Contracting Officer’s letter of designation describing the COR’s duties and responsibilities.

2) The COR has no authority to make any commitments or changes that affect price, quality, quantity, delivery, or other terms and conditions of the contract (or provisions of the solicitation).

3) The COR’s authority is limited to contract administration functions delegated in writing by the Contracting Officer.

E. Point of Contact:

1) All questions related to the contract are to be directed to the Contracting Officer.

2) Do not contact any A/E firm that may be identified herein. The A/E firm does not have the authority to share information with others or bind the government.

F. Privacy & Confidentiality:

1) Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. Information maybe overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this agreement or its attached documents in accordance with the contracted services.

2) Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breeches of the privacy and confidential should be reported immediately to the Contracting Officer, Contracting Officer’s Representative (COR) or the Facility Privacy Officer.

A. Security Requirements:

1) Prior to the commencement of any work under this contract, upon arrival to the CVAMC, contractor personnel shall first check-in with the VA Police (Building 1) to obtain a VA visitor badge.

2) The contractor employee shall be responsible for safeguarding the badge and immediately report if the badge has been lost, stolen, or destroyed to the VA Police.

3) Contractor personnel shall properly display their employee identification badge and VA visitor badge at all times while on VA property so that their name, photo, and the company they work for can easily be seen.

4) All contractor personnel shall properly sign out with the VA Police upon the completion of all daily work activities.

B. Keys:

1) All keys provided to the contractor, or any subcontractor for use during the project shall be returned to the Contracting Officer Representative (COR) at the completion of the work, or upon request.

2) No keys shall be reproduced by the contractor or any subcontractor.

3) There shall be a charge for each key that is lost or not returned to the COR.

C. Safety or Environmental Violations and Experience Modification Rate:

1) All bidders shall submit information pertaining to their past safety and environmental record. The information shall contain, at a minimum, a certification that the offeror has no more than three (3) serious, or one (1) repeat, or one (1) willful OSHA, or any Environmental Protection Agency (EPA) violation(s) in the past three years. All bidders shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the offeror’s insurance company and be furnished on the insurance carrier’s letterhead.

2) Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.

D. Determination of Responsibility:

1) A determination of responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the System for Award Management (SAM.gov), Vendor Information Pages (VETBIZ), Experian Credit Risk Score and Financial Stability Risk Score (Experian) and/or DUN and Bradstreet, Federal Awardee Performance and Integrity Information System (FAPIIS) accessed through the Past Performance Information Retrieval System (PPIRS), Small Business Administration (SBA), Office of Inspector General-Health and Human Services (OIG-HHS), OSHA, Veterans’ Employment & Training Services (VETS 4214) reporting database, and EPA online inspection history databases will be used to make the Determination of Responsibility. Any information received by the Government that would cause for a negative Determination of Responsibility may make the offeror ineligible for award.

2) This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.

E. Training:

1) Effective July 31, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course.

2) The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course.

3) Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. Failure to present the proper training documentation will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.

F. Wage and Hour Laws:

The Contractor shall be responsible for the correct title classification of workers and compliance with all applicable wage and hour laws.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS

2.1 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.2 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014) ALTERNATE I (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute shall submit the request with its offer, including the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

GENERAL CONDITIONS

4.1 52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)

(a) Definitions. As used in this clause— Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures. (1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

4.2 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120 days after receipt of notice to proceed. The time stated for completion shall include final cleanup of the premises.

4.3 52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JUL 2013)

(a) Definitions. As used in this clause— Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
