Justification for Single Source Awards IAW FAR 13.106-1(b)(ii) For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($150K)

1. Contracting Activity: Department of Veterans Affairs

The Purchase Request number for this requirement is 642-18-3-584-0062.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The existing exhaust hoods require new Phoenix exhaust control valves to replace the current faulty ones. The valves are required to interface with the existing Building Management System (BMS) to be able to adjust the amount of air to be exhausted from the laboratories for safety. The estimated value of the Phoenix valves and associated programing is .

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The contractor will replace the existing safety cabinet exhaust control valves. The valves are manufactured by Phoenix. These valves are required to be the identical size so that no field modifications will be needed to the existing system. Using a different supplier or manufacturers valve will require several field modifications including replacement of the electrical power supply, conduit, wiring and communications cables and wiring. These exact replacements will minimize the down time of the safety cabinets and laboratory operation. In addition, the Phoenix valves software control is capable of interfacing with the existing CM3 BMS. The valve replacement shall be as follows:

Phoenix Control Accel II Venturi Valves, low pressure, high speed. Position/airflow controller, constant volume and variable. Volume electrical controlled CM3 control integrated.

It is imperative that the Philadelphia VAMC procure the exact Phoenix brand name valve replacement. Using another manufacturer would be very costly to the Government. A different system and manufactured valve would require the Government to incur additional costs in making the necessary modifications required for extensive modifications of the field conditions, closing the laboratories for an extended period would impact patient care in the medical center, and other valves would not integrate with the existing BMS system without developing and writing new software to interface with a different product, other than Phoenix.

4. Description of market research conducted and results or statement why it was not conducted: On

September 6, 2018 the CO conducted a search of the Vendor Information Pages (VIP) database at https://www.vip.vetbiz.gov. CO conducted a search using NAICS 238220 (Plumbing, Heating, and Air-Conditioning Contractors) of Service Disabled Veteran Owned Small Business (SDVOSB) and Veteran Owned Small Business (VOSB) vendors that provide services in Pennsylvania. The search resulted in 323 SDVOSB/VOSBs. However, it is uncertain how many of the resulting vendors can provide Phoenix valves. Due to time constraints additional market research was not conducted by the CO.

In addition, as market research, the Philadelphia VAMC obtained quotes from two small businesses:

R.L.M. Mechanical, LLC (SDVOSB) and Wheeling Mechanical, Inc. (Small); which provide services in Pennsylvania and can provide Phoenix valves and associated programming of the requirement.

Because of the above findings, the CO determined this effort be set-aside 100% to all small business concerns via open market.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
