B.2 LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011)
This solicitation includes FAR 52.219-14 Limitations on Subcontracting. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

This solicitation includes VAAR 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, and VAAR 852.215-71, Evaluation Factor Commitments. Accordingly, any contract resulting from this solicitation will include these clauses. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) to assist in assessing contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. STATEMENT OF WORK
Butler VA Medical Center Building #2: Lead Dust Abatement and Cleaning Overview:
The contractor shall perform Lead (Pb) dust abatement including sealing off areas and ventilation systems, including all Fan Coil Units (FCU's) and Air Handling Units (AHU's), rooms and individual floors of the building as areas are completely abated to prevent re-contamination of surfaces in Building 2 at the Butler VA Medical Center (VAMC). This Pb abatement will include all piping, all interior and exterior surfaces of the HVAC ductwork, Fan Coil Units, Air Handling Units, electrical conduit, cabinets, lockers, all items above the suspended ceiling tiles and ceiling support grids, including the ceiling tile, water lines, and gas lines. Also included are all stair wells, stairs, window sills, elevator compartment/cab, windows, all rooms including administrative, exam, kitchen, mechanical, electrical, pump rooms, corridors, interior ramps, walk-in coolers, and fixed equipment within the building shall be cleaned within the scope of this statement of work.
The contractor shall employ a vacuum truck system with a HEPA exhaust filtration system, along with mobile HEPA VACS, negative-pressure HEPA air filtration equipment, and other cleaning equipment to ensure lead-contaminated surfaces are cleaned to a level below the acceptable threshold limit of 40ug/ft2. Should a porous surface, including rough concrete, speed tile, unpainted wood, and or areas/surfaces that are inaccessible for adequate cleaning, are not able to be abated to a level below the threshold limit of 40ug/ft2 .
The contractor awarded this project shall utilize a pre-approved encapsulate to bind the remaining Pb to secure the surfaces from releasing that substance thereby reducing potential exposure to airborne particulates and skin contact. The building shall be cleaned in accordance with all applicable regulations and the contractor shall provide a written building clearance certificate signed by the contractor’s CIH, for the VA Butler’s subsequent occupation of all building spaces.
The contractor shall employ a Certified Industrial Hygienist to monitor abatement work activities and perform personal air sampling on the contractor’s employees. The contractor’s I.H. shall also wipe test areas cleaned to ensure they are cleaned to the project threshold limit < 40 ug/ft2. The contractor shall follow all surface cleaning procedures as outlined by certified lead (Pb) abatement protocols to include the following methods at a minimum: Cleaning with High Efficiency Vacuum Tools and wet wiping with an appropriate concentration of Tri-Sodium Phosphate, TSP, solution. These procedures require cleaning all horizontal and vertical surfaces with a vacuum system equipped with a high efficiency particulate air filter (HEPA) or an equivalent high efficiency filter. Within a room, start with the highest horizontal surfaces and work down to the floor. Be sure to clean dust traps such as windows, radiators, air vents/registers, ceiling fans, duct work, AHUs, and FCUs work from the cleanest areas to the dirtiest areas to minimize the spreading of lead-contaminated dust to previously cleaned areas. The contractor shall not open or change the filters and bags within the building being abated. The contractor shall follow all manufacturer's instructions and routine maintenance procedures for equipment deployed to this VA Butler site.
Methods:
1. Isolate the AHU and associated ductwork with Pb contamination (determined by pre-abatement sampling to determine extent)
2. Plan for staged decontamination…dirtiest to cleanest HVAC contaminated surfaces
3. Contractor will submit a written detailed abatement plan for review and approval, by the VA Butler staff and their Industrial Hygiene representative, prior to the commencement of work.
4. During the decontamination process all HVAC systems and ductwork should be sealed externally with acceptable barriers to prevent Pb migration within the sections of ductwork and between rooms, as the wipe test results are obtained within the threshold limits.
5. Contractor will HEPA vacuum entire contaminated system(s) between air intakes, fans/blowers, fan coils, heat exchangers, motors, filter housing units, registers and diffusers, in addition to air return and exhaust ducts. VA Butler’s 3rd party I.H. service provider and Safety Officer will be responsible for reviewing contractor actions, wipe test results, air monitoring data, work practices and recommending subsequent steps/actions. A visual observation of the abatement contractor’s final HEPA vacuum cleaning will determine readiness for the next progressive steps toward wet washing, wipe testing and final clearance of each area.
6. Contractor will utilize tri-sodium phosphate (TSP) detergent solution to wet wash the surfaces of the entire contaminated system(s) and interior building surfaces. A visual assessment of the abatement contractor’s final wet washing procedure will determine readiness for the next progressive steps toward wipe testing and final clearance of each area.
7. Perform wipe sampling on a representative number of homogenous areas and surfaces, i.e. ceilings, walls, sills, floors, vents ducts, and other surfaces. Wipe test all decontaminated HVAC system surfaces (NIOSH method 9100; random target within hard-to-clean areas).
8. Re-clean if wipe sample test results exceed 40ug/ft.2
9. Criteria for surface wipe testing should not exceed 40 ug/ft.2 Pb
10. Should a porous surface, including rough concrete, speed tile, unpainted wood, and or areas/surfaces that are inaccessible for adequate cleaning, are not able to be abated to a level below the threshold limit of 40ug/ft2, the contractor awarded this project shall utilize a pre-approved encapsulate to bind the remaining Pb to secure the surfaces from releasing that substance, thereby reducing potential exposure to airborne particulates and skin contact. Concurrence between the VA I.H. representative, the contractor’s C.I.H. and the VA Safety Officer will be obtained prior to ceasing cleaning and applying pre-approved encapsulate to those areas and materials
11. Contractor will perform continuous background/area environmental air monitoring for airborne Pb in rooms/spaces outside of where ductwork is being decontaminated.
12. The contractor shall clean all carpeted surfaces utilizing the following methods: HEPA vacuum with a rotor bar vacuum device will be utilized at a cleaning rate not to exceed more than two minutes per 10 square feet in a side-to-side direction, followed by another pass at the same rate in a direction perpendicular to the direction of the first vacuuming, for a total of four minutes per 10 square feet. The contractor shall utilize steam clean or other suitable carpet scrubbing equipment on the carpet areas using an acceptable commercial cleaning method, after performing the HEPA vacuuming outlined above.
13. Targeted wipe monitoring should be performed in work areas supplied by Pb contaminated ducts for two weeks after turning on the AHU (served area should be vacant and have little furniture. If furniture is present is should be covered. If the HVAC unit was operable at the time of contamination the served area should be included in the abatement/cleanup assessment)
14. Wipe test all of the 28 previously tested locations that exceeded the threshold limit in the FCUs and AHUs, (as shown on drawings), and at a minimum the 28 rooms or areas that are supplied by those contaminated HVAC units. A minimum of two walls shall be tested, along with window sills and floors (one sample each). All positive duct work, FCUs (fan coil units), AHUs (air handling unit) and rooms/areas supplied by those HVAC system components shall be tested.
15. If a post–abatement wipe sample result exceeds 40ug/ft.2, following initial cleaning and testing, the contractor shall re-clean the areas and re-sample with wipe tests until test results are less than 40ug/ft.2.
16. The abatement contractor will be permitted to remove and properly dispose all flexible air handling ductwork to provide access to the interior face of the diffusers and the solid “box” or hard pipe ductwork for abatement. The contractor will not be responsible for replacement of the aforementioned-flex ductwork as defined during the walk-through of the pre-bid process.
17. Whereas the abatement contractor will be required to remove ceiling tiles to access the above utilities space, HVAC, concrete, painted, and speed tile surfaces, the contractor will be required to replace any more than minor damages to existing structures, including ceiling support grids, hangers, light fixtures, sprinkler systems, etc. Any damages caused, observed and reported to the VA Butler agents previously mentioned herein shall be assessed and conveyed to the COR and Contracting Officer for resolution.
18. One area of this Building #2 abatement project shall be performed after 7:00 PM and before 5:30 AM Sunday through Saturday. This small area is in the Building #2’s connecting corridor between Building #1 and Building #20, on the 1st floor only.
The following specifications shall be followed:
1.1 SUMMARY OF THE WORK
1.1.1 CONTRACT DOCUMENTS AND RELATED REQUIREMENTS
Drawings, general provisions of the contract, including general and supplementary conditions and other Division 01 specifications, shall apply to the work of this section. The contract documents show the work to be done under the contract and related requirements and conditions impacting the project. Related requirements and conditions include applicable codes and regulations, notices and permits, existing site conditions and restrictions on use of the site, requirements for partial owner occupancy during the work, coordination with other work and the phasing of the work.
1.1.5 CONTRACTORS USE OF PREMISES
| A. | The Contractor and Contractor's personnel shall cooperate fully with the VA representative/consultant to facilitate efficient use of buildings and areas within buildings. The Contractor shall perform the work in accordance with the VA specifications, drawings, phasing plan and in compliance with any/all applicable Federal, State and Local regulations and requirements. |
| B. | The Contractor shall use the existing facilities in the building strictly within the limits indicated in contract documents as well as the approved VA Design and Construction Procedures. VA Design and Construction Procedures drawings of partially occupied buildings will show the limits of regulated areas; the placement of decontamination facilities; the temporary location of bagged waste; the path of transport to outside the building; and the temporary waste storage area for each building/regulated area. Any variation from the arrangements shown on drawings shall be secured in writing from the VA representative through the pre-abatement plan of action. The following limitations of use shall apply to existing facilities shown on drawings: |
| 1.3 | Area Monitoring: Sampling of lead(Pb) concentrations within lead DEFINITIONS |
| A. | Control area and inside physical boundaries which are representative of airborne lead concentrations which may reach breathing zone of personnel potentially exposed to lead. Maintain a negative air pressure. |
| B. | Breathing Zone: Area within hemisphere, forward of shoulders, with 150 mm to 225 mm (6 to 9 inches) radius and center at nose or mouth of employee. |
| C. | Certified Industrial Hygienist (CIH): As used in this section, refers to an Industrial Hygienist employed by Contractor. |
| D. | Change Rooms and Shower Facilities: Rooms within designated physical boundary around lead control area equipped with separate storage facilities for clean protective work clothing and equipment and for street clothes which prevent cross contamination. |
| E. | Competent Person: Person capable of identifying lead hazards in work area and authorized by contractor to take corrective action. |
| F. | Decontamination Room: Room for removal of contaminated personal protective equipment (PPE). |
| G. | Eight Hour Time Weighted Average (TWA): Airborne concentration of lead averaged over 8 hour workday to which an employee is exposed. |
| H. | High Efficiency Particulate Air (HEPA) Filter Equipment: HEPA filtered vacuuming equipment with UL 586 filter system capable of collecting and retaining lead contaminated paint dust. HEPA filter means 99.97 percent efficient against 0.3-micron (0.012 mil) size particles. |
| I. | Lead: Metallic lead, inorganic lead compounds, and organic lead soaps. Excluded from this definition are other organic lead compounds. |

| 2. | Conduct area monitoring at physical boundary daily for each work shift to ensure unprotected personnel are not exposed above action level anytime. |
| 3. | For outdoor operations, take at least one sample on each shift leeward of lead control area. When adjacent areas are contaminated, clean area of contamination and have CIH visually inspect and certify lead contamination is cleaned. |
| 4. | Stop work when outside boundary lead levels meet or exceed action level. Notify Contracting Officer's Representative, immediately. |
| 5. | Correct conditions causing increased lead concentration as directed by CIH. |
| 6. | Review sampling data collected during work stoppage to determine if conditions require additional work method modifications as determined by CIH. |
| 7. | Resume paint removal when approved by CIH. |
| 3.4 | LEAD DUST REMOVAL |
| A. | Remove Lead Dust within areas indicated on drawings completely exposing substrate. Minimize damage to substrate. |

C.2 SUPPLEMENTAL INSURANCE REQUIREMENTS
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

C.3 52.228-5 INSURANCE—WORK ON A GOVERNMENT INSTALLATION (JAN 1997)
(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.
(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective—
(1) For such period as the laws of the State in which this contract is to be performed prescribe; or
(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran-owned small business concern.
(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.
(d) A joint venture may be considered a service-disabled veteran owned small business concern if the joint venture complies with the requirements in 13 CFR 125.15, provided that any reference therein to SDVO SBC is to be construed to apply to a VA verified SDVOSB as appropriate.
(e) Any service-disabled veteran-owned small business concern (non-manufacturer) must meet the requirements in FAR 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2012)
(a) Definitions. As used in this clause—
(1) Contract financing payment has the meaning given in FAR 32.001.
(2) Designated agency office has the meaning given in 5 CFR 1315.2(m).
(3) Electronic form means an automated system transmitting information electronically according to the Accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests.
(4) Invoice payment has the meaning given in FAR 32.001.
(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.
(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:
(1) VA’s Electronic Invoice Presentment and Payment System.
