DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval

For

Other Than Full and Open Competition

1. Contracting Activity: Department of Veterans Affairs, VISN 04, Corporal Michael J. Crescenz VA

Medical Center

2. Nature and/or Description of the Action Being Processed:

Firm Fixed Price purchase order with trade in for the acquisition of the Neptune 3 Rover(s) from Stryker to handle surgical waste disposal.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The Operating Room (OR) currently disposes of thousands of pounds of surgical irrigation fluid a year. With the purchase/trade of the Neptune Waste Management System, the staff will be able to dispose of the fluid more safely and efficiently. The OR presently has the Neptune 2 Rovers which are no longer support by Stryker.

The Neptune eliminates the splash risk from disposing contaminated fluid down the hopper and changing suction canisters. The Neptune is on wheels and is far ergonomically superior to other methods of fluid waste disposal minimizing the risk of injury from carrying heavy container fluid.

Neptune offers superior digital readout for the fluid collection giving the OR and Anesthesia staff a better indication of blood loss. Neptune offers emergency back-up suction ability in the event of a facility loss of vacuum because Neptune functions on electricity.

The Neptune 3 Rovers replace the current Neptune 2 Rovers that are no longer supported by the manufacturer Stryker.

4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The Neptune 2 system is presently in use and looking to be upgraded to the Neptune 3. The operating room staff has been trained and proficient in its use so it makes sense for the continuation and standardization of use in the Neptune 3. There is a dedicated service team available to address any issues or concerns regarding the product. The Neptune is a totally closed system. There are no lids to take off the collection canisters and they are completely enclosed within the frame of the system. The advantages to this feature are primarily infection control related. The Neptune has independent suction control levels. All other similar products on the market have one vacuum source, which does not allow for versatility during surgery. The advantage to this feature is that the surgeon/anesthesiologist can choose to use a high, medium or low suction level at the same time.

The Neptune 3 not only offers the closed mobile system protecting the OR staff from exposure to suctioned biohazardous fluids, it permits patient-to-patient use requiring only a manifold change.

This helps to optimize the OR turnover time.

The Neptune 3 includes a power IV pole such as the Neptune 2 holding 4 bags of saline at once. The advantage to this feature is that there is no manual lifting of the saline bags, and there is no separate IV pole. This leads to less manual labor for the nurses and less poles in the operating room.

Another advantage to the Neptune 3 which includes a smoke evacuation unit which helps suction away smoke created when cauterizing tissue during surgery. Advantage to this feature is that it is included within the frame of the system saving valuable OR space and does not require a separate purchase of equipment.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Will be posted to GSA as there is an FSS contract through the manufacture. The manufacture has several authorized SDVOSB distributors able to compete this requirement.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Pricing is deemed fair and reasonable with trade in values of existing obsolete equipment being given to the facility.

8. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Based on market research the Neptune 3 Rover Waste Management System is manufactured by Stryker only. Stryker has previously demonstrated its ability to perform maintenance on the existing system effectively. They are the manufacturer and vendor that distribute the Neptune 3 Rover System and as such have immediate access to replacement parts and service. Stryker has the necessary qualified and trained personnel to provide all services and answer any technical questions.

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Stryker has several authorized SDVOSB/VOSB distributors.

10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

This is a brand name request; the manufacture Stryker has several authorized SDVOSB/VOSB distributors that we can compete this requirement successfully.

11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
