This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. A firm-fixed price purchase order is anticipated.

Statement of Need Lebanon VA Medical Center Title of Project: Welch Allyn Diagnostic Unit and accessories for activation for Lancaster and Camp Hill Scope of Work: The vendor shall provide all resources necessary to accomplish the deliverables described in this statement of need (SON), except as may otherwise be specified. Contractor shall provide (55) Welch Allyn Diagnostic units and accessories deliver within 30-days from the date of notice of contract award to the Lebanon Veterans Affairs Medical Center for activation of new Cumberland VA Clinic and Lancaster VA Clinic. Cumberland will receive (40) of the units by 5/30/2018 and Lancaster will receive (15) of the units by 8/24/2018.

Background:

The Lebanon VA Medical Center (LVAMC) has a need for fifty-five (55) Welch Allyn Diagnostic units and accessories for activation to be used in the new Cumberland VA Clinic (40 units) and new Lancaster VA Clinic (15 units).

Performance Period: Delivery shall occur within 30 days of receipt of contract. Need dates: Cumberland – 5/31/2018 and Lancaster – 8/24/2018.

Type of Contract: Firm Fixed Price Delivery Order.

General Requirement

1. The Lebanon VA Medical Center (LVAMC) Camp Hill and Lancaster new VA Clinics have a need for fifty-five (55) Welch Allyn Diagnostic units and accessories for activation. The (55) Welch Allyn Diagnostic units and accessories will be placed in each Exam Room throughout the clinics to be utilized for patient care.

Delivery:

1. Contractor shall provide delivery of (55) Welch Allyn Diagnostic units and accessories within 30 days of contract award to the Cumberland and Lancaster VA Clinics, addresses and amounts below. Need dates are also listed as: Cumberland 5/31/2018 and Lancaster 8/24/2018.

2. The Biomed Engineer will need to perform a safety check after installed on the wall at the Cumberland VA Clinic, Lancaster VA Clinic and enter the equipment into the system for annual Preventative Maintenance (PM0 Checks).

3. Delivery to the facility shall be coordinated at least 72 hours prior to required delivery date with the Warehouse Supervisor.

(viii) The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition and the following clauses AND instructions are added as addenda:

(a) Gray market items are Original Equipment Manufacturer’s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable.

(b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM’s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.

(c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA’s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.

(ix) Evaluation of this requirement will be based on PRICE ONLY

(x) Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer if has not been completed on SAM.gov.

(xi) The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and the following clauses are added as addenda:
