VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: VA244-18-4-AP-0037
1. Contracting Activity: Department of Veterans Affairs, VISN 04 Lebanon Medical Center, YMCA
Section. Renovation for Move 595-13-106
2. Nature and/or Description of the Action Being Processed:
The Lebanon VA Medical Center (VAMC) has a need to replace the existing hot tub and failing structure housing the hot tub with a Hydrotherapy pool. This will occur as part of the Renovation for MOVE 595- 13-106 project, which include renovations to the Wellness Center (current pool area, gymnasium, and fitness center).
The overall scope of work includes all acquisition, materials, equipment, supervision and quality assurance necessary to acquire and install a hydrotherapy pool that meets the specification noted in this document. The pool is to be installed flush with the facility poolroom floor. The construction contractor is responsible for the preparation of the hydrotherapy pool area of the site prior to installation under construction project 36C24418C0044. This is a brand name or and equal to the Hydroworx 2000 Series.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The Hydroworx Hydrotherapy pool is the only pool with the distinct and functional features that the capable of providing the desired therapy and conditioning suited to meet the need. These features are unique and patented.
Distinctive Salient Characteristics/Specification s
• The Hydrotherapy pool will be 8’ X 12’ and contain removable stainless steel support bars, variable water temperature (up to 104 degrees F), commercial filtration system, and a 30kW heater. Ascending and descending floor (8’ – 12’)
• Hydrotherapy pool will accommodate up to four (1-4) patients during treatment session.
• 8’x 12’ underwater treadmill with variable speeds ranging from .2 mph – 8.5 mph the treadmill will cover the entire surface of the pool floor.
• The pool treadmill and moving floor are mechanically driven –v- hydraulically driven (preventing down time)
• A hand held remote control will control the jets, treadmill, and other key aspects of the pool.
• Deep tissues massage hose.
• The pool will contain a resistance therapy jet system. The system will provide 200 different water speeds.
• The unit will include a computer, a control pendant and an underwater video monitoring system with viewing monitors. The cameras will provide views of the front and side of the underwater area. The images for the underwater cameras will be provided on 2 flat panel monitors for simultaneous front and side views of the patient.
• The pool will have an automatic water leveling system, which can automatically detect a drop in water level, and fill the pool to maintain proper circulation and filtration.
• The pool will have a computer documentation and software package that will allow clinicians to interpret the data collected thru the camera and other systems within the pool.
• Heating of the hydrotherapy pool will be provided via a heat exchanger.
4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The Hydroworx 200 was used an element of design for the MOVE 595-13-106 project, therefore should have been included in specifications of that project.
The critical characteristics of the HydroWorx 2000 essential to the successful completion of the entire project are:
• SIZE/DIMENSIONS:
o 8’ by 12’ foot print o Variable capacity to max of 5,000 gallons o Minimal water levels required to minimize maintenance expense o More efficient de-humidification and heating of pool and immediate area
• Range of Motion for the Floor:
o Ascending and Descending floor 0’-6’ allows for:
o Zero depth access o no accessibility barriers o Capable of tailoring of the aquatic environment specific to an individual and accommodating diverse sized and capability of patients at various depths
• One "small and versatile” pool to treat everyone
• Pool Floor doubles as a Treadmill:
o Treadmill as pool floor to replicate land based gait pattern in non-weight bearing environment.
o The full floor treadmill is required to treat multi-patient interval or group training (up to 4 patients at a time) o Replicate full range of motion “life like” situations/motions/strides in a none (or less) weight bearing state.
o Speed ranges from .2MPH up to 8.5MPH; .2MPH incremental increases required for treatment plans spanning slow shuffle step through a full sprint o Removable and repositionable treadmill support bars for support, stretching, etc. based on needs and protocols
• Resistance Jets:
o Multi-directional variable speed front resistance jets:
o Directional control – variable force/speed required to maximize application across a broad spectrum of jet treatment protocols o Directional Control – along all axis with pitch and yaw o Focus direction and speed required to increase effectiveness of ROM exercises, interval training, and continuous lap training
• Massage Hoses:
o Jets must be adaptable to accept massage hoses for deep tissue massage, lactic acid stripping, scar tissue manipulation and any pain management protocols
• Video Documentation System:
o Ability to give immediate feedback to the patients to help correct gait patterns and improper mechanics.(Bio-feedback) o Ability to record (and replay) pool sessions to share with doctors and patient’s progression/status of their rehab/workout.
• Computer Documentation System:
o Ability to record and objectively measure the progression of athletes through their rehabs or workouts.
o Ability to precisely monitor and control all facets of pool, treadmill speed, resistance jets, etc.
• Hand held remote which gives the clinical staff and patients the ability to control the options of the pool from anywhere in the pool or pool room
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Tactical market research did not yield any other vendors that can provide and install the Hydroworx 2000 Series, nor where there any hydrotherapy pools that would meet the critical elements of design necessary to completed the project.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The cost of the pool is $312,500.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
Tactical market research did not yield any other vendors that can provide and install the Hydroworx 2000 Series, nor where there any hydrotherapy pools that would meet the critical elements of design necessary to completed the project.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The delivery and installation of the pool is being done in conjunction with the existing renovation project 595-13-106, delays in in ordering and installation will delay the construction project schedule. This will have an adverse effect on patient care
