Other Than Full and Open Competition (>$150K)

1. Contracting Activity: Department of Veterans Affairs, VISN 04, Station 646

2. Nature and/or Description of the Action Being Processed: Procurement is for the replacement of the existing Cardiac monitoring cables which are needed to install new Philips cardiac and hemodynamic monitoring system (hereafter referred to as cardiac monitoring system or cardiac monitors) in the Emergency Department (ED), the Critical Care Units, and the 9 West Observation Unit at the VA Pittsburgh, University Drive Division Pittsburgh PA 15240. THIS IS A BRAND NAME REQUIREMENT ONLY. This is a firm-fixed price and includes all time, materials, and labor. In addition, training for Biomed on the new cardiac monitoring system is also included in this request.
This training can only be done by trained Philips representatives.

The estimated value of the proposed action is $ 189,688.40
FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for the replacement of cabling needed for the installation of the Philips Cardiac Monitoring system (BRAND NAME REQUIREMENT ONLY) in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
VA Pittsburgh purchased new Philips Cardiac monitors in FY17. Original purchase order stated vendor could recertify current cabling. After a review of the current cabling in these units, Philips provided a detailed report showing not all current cabling met the requirements for the new system to be installed. As a result, VA Pittsburgh would like to remove all old cabling and replace with new cabling to ensure proper installation and operation which is needed for patient care. This decision has warranted the need for an additional purchase order to complete the installation.
Philips IntelliVue systems offer an expanded, real-time view of your patients’ vital signs, and with the integrated PC option, a wealth of clinically relevant information from your hospital’s intranet and applications. Philips must be the exact same monitors (Brand Name Requirement) as all the other patient monitors used in the ICU units at VAPHS. All clinical staff is trained on this particular model. If they are not the same, patient care may suffer.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Cable Pull Statement of Work below outlines the extent of the project for the six units included in this project. Philips will hold the cable vendor responsible for meeting the project completion timeline that was discussed and agreed upon by the VA Pittsburgh in the orginal purchase order.
o ED – 18 cable pulls and 35 test and terminations with dust containment o 3A – 13 cable pulls and 24 test and terminations with dust containment o 3E – 18 cable pulls and 35 test and terminations with dust containment o 4E – 18 cable pulls and 35 test and terminations with dust containment o 5A – 10 cable pulls and 19 test and terminations with dust containment for bedsides o Six (6) cable pulls and six (6) test and terminations for remote displays
• New sender
• Six (6) new receivers
• Displays are on main 5A quote o 9W – 20 cable pulls and 39 test and terminations with dust containment
• 20 keyboard trays
• Project management
4. Statutory Authority Permitting Other than Full and Open Competition:

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Philips Corporation has authorized vendors who are the only firms capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition.
Philips requires an authorized vendor to compete the cabling or VA Pittsburgh may face unacceptable delays in installing the cardiac monitoring system which will negatively impact patient care. Philips was awarded the cardiac monitor contract in FY17. The replacement of the cabiling is needed at once as it is essential to the installation and replacement of the monitors in the ICUs. This is an urgent and compelling need due to the safety concerns with the current cardiac monitors.
Issues with the current system include:
a. Misidentification of rhythm which could be lethal
b. Misidentification of rhythm significantly contributes to alarm fatigue
c. Phantom Spikes (Source of phantom spikes remains unknown); if phantom spikes are present, precludes ability to monitor patients with pacemakers
1. Spikes have been documented prevalently with Prismaflex
2. Spikes have also been seen in the absence of Prismaflex
3. Unknown if spikes will be problematic in a patient with ECMO
Philips will be able to schedule them to be on-site to complete tasks prior to the scheduled Go-Lives for this project. Philips will also need the vendors to be on-site during the Go-Lives to complete cable testing for the central station cables. The scheduling and coordination of the cable pulling project will need to be overseen by Philips Project Management in order to stay on track with the delivering and installation of the patient monitors for all six units.
In addition, training for Biomed on the new cardiac monitoring system is also included in this request. This training can only be done by trained Philips representatives.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: VA Pittsburgh has reached out to the vendor to ensure that offers are solicited from as many potential sources as practicable under the circumstances. Research was conducted and Philips (BRAND NAME REQUIREMENT) does have three Service Disabled Veteran Owned Small Businesses (SDVOSBs) authorized to complete this project.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: In accordance with Federal Acquisition Regulation (FAR) 6.303-2(b)(7), the CO determines by certifying this document that the anticipated cost to the Government of $ 189,688.40 for the entire requirement is fair and reasonable. This has been determined by reviewing previous purchase orders which included the need for cabling.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: As described in Section 6 above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Philips Corporation has authorized vendors who are the only firms capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition. Philips requires an authorized vendor to compete the cabling or VA Pittsburgh may face unacceptable delays in installing the cardiac monitoring system which will negatively impact patient care.
In addition, training for Biomed on the new cardiac monitoring system is also included in this request. This training can only be done by trained Philips representatives.
Without the purchase of this cabling for the new equipment, patient care can suffer if a patient is not monitored properly and goes into cardiac arrest. Delying this request will delay the agency’s need to replace the existing system. Philips patient monitors are designed to match the pace and unique needs of adult, pediatric, and neonatal intensive care; anesthesia and peri-operative care;
and cardiac care environments. Utilizing cables which are not certified by the manufacturer places an unnecessary risk of equipment failure.
