The Contractor shall provide all Management, Supervision, Labor, Materials, Equipment, Tools, and Transportation to execute work for the installation of a dedicated feed for MRI upgrade project located at the Stratton VA Medical Center.
This project is being solicited as a 100% TOTAL SDVOSB SET-ASIDE.
Project Magnitude: Between $100,000 and $250,000. NAICS code 236220 and small business size standard is $39.5 Mil.
Offeror's must be verified in Vetbiz at the time of bid andcontract award. Failure to be both Verified by CVE and VetBiz prior to contract award will result in offerors proposal being deemed non-compliant. All offerors are urged to contact the CVE and submit documents to obtain CVE verification of their SDVOSB status if they have not already done so.
In accordance with FAR 52.204-7, prospective contractors shall be registered in the SAM database prior to award of a contract.
All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information will be obtained from the bidder's/offeror's insurance company and be furnished on the insurance carrier's letterhead.

A site visit is scheduled for 1:00 pm on Thursday, August 26, 2021. All prospective offerors are to meet in the lobby located at the main building and must be wearing a disposable surgical mask prior to entering as cloth masks are no longer allowed in the building. All offerors will be screened for COVID prior to entering the building.

SCOPE OF WORK:
Project 528A8-18-806 Replace 1.5T MRI – Install Dedicated Feeder for MRI’s MDU Bldg. 1 VAMC, 113 Holland Ave., Albany, NY
I. PROJECT DESCRIPTION
The Stratton VA Medical Center (VAMC) in Albany, NY is replacing its existing 1.5T MRI machine. Philips Healthcare is contracted with the Stratton VA Medical Center to furnish and install an Ingenia Ambition 1.5T X MRI. The VA has contracted Construction Technology Group (CTG) to conduct most of the site prep for the new MRI, including installing a new circuit breaker for the MDU. However, CTG’s contract does not cover Philips’ requirement of isolating the feeder for the MRI’s MDU from existing Panel, NPP-1.
Per Philips’ Pre-Order Site Preparation Support Document, the MDU requires the following:
· Supply Configuration
· 3 phase, 3 wire power, unity ground, and bonded ground
· Nominal Line Voltage
· 480 VAC, 60 Hz
· Branch Power Requirement
· 80 kVA
· Circuit Breaker
· 3 pole, 100 Amp (480 VAC) This contract will require the Contractor to route a dedicated feeder (and necessary grounding) from the Spare (200A) breaker in the 480V switchgear to the MDU’s circuit breaker (also known as Circuit Breaker for System, CBS). The CBS will be installed in A209 (by CTG) and the 480V switchgear is in S-15 (Sub-Basement, B-wing Electrical Room). The feeder size is required to be 400 MCM.
The Contractor is responsible to determine the routing and applicable work (including demolition and construction) required to install the dedicated raceway. The A-wing’s mechanical chase is a possibility for the Contractor to route the new feeder. All work outside the Sub-Basement is expected to be off-hour work, unless stated otherwise by the CO. Depending where the raceway is installed, the off-hour work will vary due to some departments remaining operational 24/7, e.g. 2A Radiology.
Please note, the Contractor will need this feeder installed to CTG’s circuit breaker. The Contractor shall furnish and install a junction box with multi-lug terminal strip beside CBS breaker panel. The Contractor will need to transition their 400 MCM power cabling to fit the lug size in the CBS breaker panel. CTG’s breaker is specified to be Square ‘D’ type QG, with a maximum lug size of 300 MCM. The Contractor shall install the wire and connection between multi-lug terminal strip and CBS. Once the installation is complete, the Contractor shall conduct a megger test to certify their construction.
Attached is CTG’s proposed Construction Schedule, for Reference – it could be subject to change. The Contractor will be required to coordinate construction timeframes with the VA and CTG. Also, the Contractor will need to coordinate with CTG to ensure their raceway doesn’t conflict with the locations of CTG’s/Philips’ equipment and designed raceways, located in A209. The Contractor’s work will need to be completed prior to CTG’s date for Substantial Completion, in order for the VA to accept delivery of the MRI.
To ensure Contractor’s/Electrician’s path is feasible, the Contractor/Electrician shall conduct a site visit(s) to verify existing conditions. The Contractor shall take appropriate field measurements of their proposed raceway.
Specific work requirements include, but are not limited to the following:
1. Protect all items and finishes to remain. Repair any damage caused by construction to the original state or better.
2. Contractor shall provide professional, full-time on-site supervision of the work.
3. Contractor shall develop a schedule and conduct weekly construction meetings and prepare the meeting minutes.
4. Contractor shall provide all required survey and testing work.
5. Contractor shall utilize the Philips’ Pre-Order Site Preparation Support Document as the basis for construction.
6. Contractor shall review all shop drawings, submittals and RFIs prior to submitting to VA COR.
7. Prior to starting any work, the Contractor shall provide complete architectural and electrical engineering design services to develop electrical design drawings defining the power run in its entirety, and ICRA/ILSM drawing(s) for each floor where work is taking place. The VA’s approval/sign off is required prior to any physical work starting.
8. Once the construction is complete, the Contractor shall provide two fully signed and sealed sets of hard copy as-built drawings to the VAMC for their records and use. Contractor shall also provide CADD files formatted for AutoCAD 2020 and PDF files.
9. All work shall be performed and accomplished according to Albany VAMC’s specifications, including General Requirements, Safety, and Infection Control requirements.
a. Coordinate all power and other utility shutdowns with the VA COR. Provide the VA COR a minimum 3-week notice.
b. The prime contractor shall be responsible for assuring that all work is coordinated and performed during appropriate hours that will not interfere and/or interrupt the Stratton VA’s daily activities.
Background: The Samuel S. Stratton VA Medical Center was constructed in the late 1940’s based upon plans by Green & James, Architects & Engineers, Buffalo, New York and Eggers & Higgins Architects & Engineers, New York, New York dated December 10, 1947. The MRI suite was last renovated in the early 2000s with the installation of the existing Philips 1.5T MRI.
The Radiology department shall remain operational throughout construction. Coordinate with the VA COR and Radiology Program Director to schedule all work that may be disruptive to hospital operations.
Roadway closures will not be permitted at any time or for any reason except with the written approval of the VA COR.
Perform all work to the specifications & drawings and provide construction period services for the subject project.
II. REFERENCES
Applicable design and construction standards are listed in Appendix A. Criteria specified throughout the solicitation shall be taken from the most current references as of the date of the solicitation. The list is not intended to include all criteria that may apply or to restrict design and construction to only those references listed. As part of the close-out documentation, the Contractor/Designer shall provide as-built drawings in Adobe PDF and AutoCAD 2020 format.
III. WORK COVERED BY CONTRACT DOCUMENTS
GENERAL
The construction services and contract documents shall cover the design and construction for the rehabilitation of the VAMC, Albany, NY, Building 1, Install Dedicated Feeder for MRI’s MDU, consisting of all building components, site modifications and improvements needed to turn over to the government a fully functional facility that meets or exceeds the government requirements as set forth herein. The Contractor shall provide all labor, supervision and materials necessary to perform the work as indicated in this scope of work, project specifications and drawings. The building and site elements shall be accommodated in the given project site. Develop and construct the facility within the budgeted funds that will be negotiated with the government.
A. EXISTING ELEMENTS
The proposed sites span from the Sub-Basement of B-wing to 2nd floor, Radiology (2A) at the Samuel S. Stratton VAMC, Albany, NY campus at 113 Holland Avenue. There are existing utilities in and around the proposed work area. In addition to following “FAR 52.236-9, Protection of Existing, Structures, Equipment, Utilities and Improvements” the contractor shall remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work, which is to remain. The contractor shall repair or replace portions of the existing work, which have been altered or damaged during construction operations to match or adjoining work, as approved by the Contracting Officer and at no additional cost to the government. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.
The Contractor shall verify all existing conditions on the site and in the facility infrastructure that the proposed project may affect before the commencement of any construction. This includes but is not limited to, verifying the location and elevations of existing utilities, verifying site items as shown on the project drawings and taking appropriate field measurements. The government will not be held responsible for bidding errors made or the failure to adequately inspect the job site for existing conditions, dimensions or to fully review manufacturer’s information related to the project. All bidders are strongly encouraged to inspect the job site prior to submitting bids.
All discrepancies between the scope of work, drawings, specifications, and manufacturer’s recommendations shall be brought to the attention of the Contracting Officer’s Representative prior to the commencement of work. The Contractor shall abide by the Scope of Work regardless of whether a manufacturer calls for the task, level of preparation, etc. in question. The only exception is where the Contracting Officer agrees in writing that the item or task specifically voids a manufacturer’s warranty and may be omitted. A credit for the work not performed may be due to the government in such circumstances at the discretion of the Contracting Officer.
The Contractor shall review the drawings to determine if they are responsible for providing the specific material and/or labor associated to complete the task or phase of the project as well as the project overall.
As part of the project, the Contractor shall:
1. Provide a project schedule that addresses the needs of any area of the VAMC facility that will or may be impacted by the work.
2. Prepare and execute a well-managed plan to mitigate service disruptions.
B. SITE PLANNING AND ENGINEERING
The Contractor shall maintain existing adjacent areas and all areas not designated for a new finish, disturbed during construction shall be patched, repaired, or restored to original conditions.
C. LIFE SAFETY AND BUILDING COMPONENT FIRE RATINGS
All life safety codes shall be adhered to as they pertain to the built environment of this project. Egress routes shall be delineated to meet the requirements of the governing codes. All existing means of egress shall be fully accommodated during construction.
Proper temporary partitions shall be constructed and maintained during all phases of work and shall comply with all current VA Safety and Infectious Control standards.
D. COLORS
The color, texture, and pattern selections for the finishes of the renovations shall provide an aesthetically pleasing, comfortable, easily maintainable, and functional environment of the occupants (including contractor’s ante rooms). The government will provide finish standards of the facility. Coordination of the new finishes and color selections shall match or compliment with existing buildings adjacent and shall be necessary for a cohesive design. Color selection shall be appropriate for the building type on this campus.
IV. GOVERNMENT PROVIDED EQUIPMENT
A. CONTRACT DOCUMENTS
The government is providing Philips’ drawings to support/verify the scope of work. The document is to be used for informational purposes. The Contractor’s shall comply with governing codes noted in the drawings and specifications.
V. SCHEDULES
The Period of Performance is 30 days after the Notice to Proceed unless otherwise agreed to in writing with the Contracting Officer. Provide the government with a design development and construction project timeline that includes but is not limited to submittal submission dates, start of construction, milestones, completion of construction, performance testing and final hand over to the government for occupancy that is less than or equal to 30 calendar days.
Rescheduling of any activities shall be done at no cost to the government unless negotiation and authorization of the rescheduled activity has been agreed upon by the government. Notify the government at least 72 hours prior to starting demolition work, large deliveries or any event that may impact the normal operations of the facility. Utility shutdowns require a minimum 14-day notice.
VI. PROJECT ENERGY PERFORMANCE
The intent of this project is to meet the energy requirements as set forth in the governing codes and regulations for this type of building. There are no LEED requirements for this project.
VII. OCCUPANCY OF SITE
This project is on a fully operational campus. All activities being performed shall maintain the safety and wellbeing of the occupants that operate within the campus. Before work is started, arrange with the government a sequence of procedures, means of approach and space for storage of materials and equipment. The Contractor is responsible for the security of the proposed site during construction.
VIII. CONTRACTOR PERFORMANCE
Use good construction practices and standards in completing all work. All work shall be performed by laborers that are fully versed and experienced in the trade that they are employed to do. Coordination with the government, of project progress and scheduled items, shall be a regular occurrence, initiated by the Contractor.

The following documents are to be included in the bid submission:

1) All Bidders/Offerors shall submit the following information pertaining to their past Safety and Environmental record. The information shall contain, at a minimum, a certification that the bidder/offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any EPA violation(s) in the past three years.
2) All Bidders/Offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information will be obtained from the bidder’s/offeror’s insurance company and be furnished on the insurance carrier’s letterhead.
3) Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead may obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Note: Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR will obtain their EMR rating from their state run worker’s compensation insurance rating bureau.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS
GENERAL INTENTION
The Stratton VA Medical Center (VAMC) in Albany, NY is replacing its existing 1.5T MRI machine. Philips Healthcare is contracted with the Stratton VA Medical Center to furnish and install an Ingenia Ambition 1.5T X MRI. The VA has contracted Construction Technology Group (CTG) to conduct most of the site prep for the new MRI, including installing a new circuit breaker for the MDU.
SITE VISIT
Bidders are urged and encouraged to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of performing these services. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
There will only be one (1) organized site visit. The site visit is scheduled for Thursday, August 26, 2021 @ 1:00 pm (EST). Due to the pandemic, participants are required to wear disposable surgical masks at all times while inside the building as cloth masks are no longer acceptable when entering the Stratton VA Medical Center. Participants are to enter through the main entrance to be screened for COVID 19 prior entering building. Please bring a government issued photo ID. You will be escorted by the Contracting Officer and Contracting Officer Representative.
Attendance is not mandatory, however all bidders are strongly encouraged to attend.
REQUESTS FOR INFORMATION (RFI):

BASIS FOR AWARD
Contract award will be made to the responsive, responsible bidder submitting the lowest price in accordance with FAR Part 14 – Sealed Bidding.
RESPONSIBILITY REQUIREMENTS
A Determination of Responsibility shall be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the OSHA and EPA online inspection history databases will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines above or submit this information may result in a determination of “Non-Responsibility” for the bidder/offeror. NOTE: Any information received by the Government that would cause for a negative Determination of Responsibility may make the bidder/offeror ineligible for award.
This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.
2.1 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.2 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

2.4 52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—
(1) To unsuccessful bidders as soon as practicable after the opening of bids; and
(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000, whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

2.5 52.228-17 INDIVIDUAL SURETY—PLEDGE OF ASSETS (BID GUARANTEE) (FEB 2021)
(a) Offerors shall obtain from each person acting as an individual surety on a bid guarantee—
(1) A pledge of assets that meets the eligibility, valuation, and security requirements described in the Federal Acquisition Regulation (FAR) 28.203–1; and
(2) Standard Form 28, Affidavit of Individual Surety.
(b) The Offeror shall include with its offer the information required at paragraph (a) of this provision within the timeframe specified in the provision at FAR 52.228–1, Bid Guarantee, or as otherwise established by the Contracting Officer.
(c) The Contracting Officer may release the security interest on the individual surety’s assets in support of a bid guarantee based upon evidence that the offer supported by the individual surety will not result in contract award.
