DESCRIPTION

Nexstim NBS System 5 INTENT TO SOLE SOURCE: PROCUREMENT OF ONE (1) Nexstim NBS System 5 (all components)

INTENT TO SOLE SOURCE FOR PURCHASE REQUISITION: This is not a request for competitive proposals. This is not a solicitation or request for offers. No solicitation package is available and telephone requests will not be honored.

The Department of Veterans Affairs Providence Medical Center intends to award a one-time, Firm Fixed Price, Sole Source contract for One (1) Nexstim NBS System 5 to VAMC Jamaica Plain, Original Equipment Manufacturer Nexstim, INC.

Technology, knowledge, technical expertise, and servicing capabilities for the Nexstim NBS System 5 are proprietary to Nexstim.

A Sole Source Letter was provided by the Original Equipment Manufacturer (OEM) describing the proprietary nature of the Nexstim NBS system establishing this requirement as being peculiar in manufacturing to Nexstim. The letter states that only the OEM is authorized to distribute and service the Nexstim NBS system.

The authority for applying the Simplified Acquisition Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901. This statute is implemented by for restricting competition on this procurement via FAR 8.405-6(a)(1)(i)(B).

The intent is to procure these products on a sole source basis. No solicitation will be posted to Contract Opportunities. The primary North American Classification System Code (NAICS) is 334510: Electromedical and Electrotherapeutic Apparatus Manufacturing. The most current Business Size Rating for this NAICS is 1,250 employees.

Capable parties may identify their interests and authorization to respond to this requirement by June 23rd, 2023, at 12:00 PM (EDT).

A determination by the Government not to compete this proposed award upon response to this notice is solely within the discretion of the Contracting Officer.

Statement of Work Nexstim NBS System 5, Neurology

A. INTRODUCTION:

The VA Boston Healthcare System, Neurology Department, requires upgrading of its Nexstim NBS System for transcranial magnetic stimulation (TMS).

The VA Boston Healthcare System acquired a Nexstim NBS System 4 about 10 years ago. Since that time, the Neurology Department has significantly expanded its neuro-oncology and epilepsy surgery program. The Nexstim TMS system is used for pre-surgical workup and planning for patients with epilepsy and/or brain tumors. The current NBS System 4 is at end-of-life and requires upgrade to System 5 for continued functionality.

The Nexstim Navigated Brain Stimulation (NBS) System 5 is indicated for non-invasive mapping of the primary motor cortex of the brain. The Nexstim NBS System 5 provides information that may be used in the assessment of the primary motor cortex for pre-procedural planning. Nexstim NexSpeech®, when used together with the NBS System 5, is indicated for non-invasive localization of cortical areas that do not contain essential speech function. NexSpeech® provides information that may be used in pre-surgical planning in patients undergoing brain surgery. This system does not connect to or access the VA network. PHI is stored on the password-protected and encrypted NBS System.

The upgrade of the Nexstim NBS System will significantly improve access to and quality of non-invasive brain mapping for Veterans with epilepsy and/or brain tumors, and facilitate advanced surgical treatment strategies.

The total price for this equipment is $391,500 which includes equipment upgrade, professional installation, on-site training, and 3-year maintenance and service agreement.

All contractor personnel shall report and check-in according to the current vendor registration protocol. No employee of the contractor shall enter the site without a valid identification badge issued by the VA.
