1. Contracting Activity: Department of Veterans Affairs, VISN 01, VHA Boston Healthcare System, 523

VA Boston Medical Center, Brockton, MA; NCO 1 Contracting Transaction Number is 523-19-2-4944-0037.

2. Nature and/or Description of the Action Being Processed:

• New contract to Island Lighting & Power

This project is for an emergency repair to the damaged existing 13,800 volt main electrical loop at the VHA Boston Healthcare System, Brockton Campus. Project will replace a damaged 750 kVA transformer, repair a section of damaged electrical duct bank, repair 3 electrical manholes and replace approximately 1000 ft of 15 kV 3 phase electrical cable.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

• Contractor (Island Lighting & Power) to provide all labor, material, equipment, supplies, transportation and supervision necessary to repair the damaged existing 13,800 volt main electrical loop at the VHA Boston Healthcare System, Brockton Campus. Work will include replacement of a damaged 750 kVA transformer, repair of a section of damaged electrical duct bank, repair of 3 electrical manholes and replacement of approximately 1000 ft of 15 kV 3 phase electrical cable.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.

Code § 8127, as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

• The contractor, Island Lighting & Power, has previous experience working on our existing 13,800

Volt main electrical loop. As the current 750 kVA transformer serving building 3 has been operating on an emergency repair, we need Island Lighting & Power, who has experience with our electrical system and transformers, to come in and replace said transformer. Since this is considered an emergency repair, we need a contractor with not only expertise in medium

Revision 01 Eff Date: 04/23/2018 voltage electrical work, but also one that is familiar with our electrical loop. Island Lighting & Power meets both of these requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

• This is an urgent and compelling emergency requirement. Island Lighting & Power is a VOSB contractor with experience working on our main electrical loop on our campus. They have worked on our main electrical loop numerous times and it is in the best interest of the government not only for time constraints, but also for quality work.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

• Island Lighting and Power is familiar with the area and has previously successfully completed electrical work at the VAMC Boston, MA.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

• See #8 above.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

• Not Applicable

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required:

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
