PERFORMANCE WORK STATEMENT
CONSTRUCTION MANAGEMENT SERVICES
Fremont, Indiana – HOME MODIFICATIONS
1.0 SPECIFIC REQUIREMENTS.
1.1 Location of Work: The work will be performed in Fremont, Indiana
1.2 Period of Performance: The period of performance is 30 calendar days from contract award. This includes the completion of work contained in this Performance Work Statement for the base contract line items. Period of performance for the optional line items will include the solicitation, award and performance of the construction contract.
2.0 STATEMENTN OF WORK:
The purpose of this PWS is to obtain Construction Management (CM) Services for Independent Living Home Modifications based on the attached Statement of Objectives. The Department of Veterans Affairs (VA), Vocational Rehabilitation and Employment Division (VR&E) has identified possible independent living needs, which includes residential construction alterations. 2.1 Construction Project Objectives: The intent of this project is to provide increased safety walking indoors in his home, improve ingress and egress from residence to driveway/vehicle and provide ADA accommodations and accessibility to bathroom.
FLOORING:
· Remove carpet and provide other flooring option to assist veteran to access his main living spaces. Provide a safe walkway from his bedroom to the living room and make living room safer to walk.
AWNING:
· Provide awning for the aluminum ramp veteran uses to get to driveway to meet ADA requirements and to provide shelter from the elements.
BATHROOM:
· Provide ADA accessibility/accommodation to the closest bathroom to the living room. Current bathroom is too narrow and will not allow the use of a walker.
2.2 Sustainability Objectives: The VA requires that all construction projects be accomplished with sustainable design and construction elements incorporated. The construction contract (please reference the IL Construction PWS Template provided by the Contracting Officer) will contain language requiring waste management plans, the use of energy efficient, water efficient, and recycled content equipment and products. The required deliverables under this PWS shall incorporate, to the maximum extent practicable, these ideals and objectives.
2.3 Requirements: The contractor shall provide Construction Management Services to include, but not limited to, Project Planning Phase Services, Project Procurement Phase Services, Construction Phase Services and Inspection Services listed below.
2.3.1 Base contract items shall include the following services.
A. Project Planning Phase: Contractor shall conduct a site visit of the Veteran’s home to determine the following items;
· Best method for achieving stated construction project objective.
· Major construction risk areas based on field observations (age of home, asbestos, structural issues, etc.) so the Government may take steps to mitigate those risks in the construction contract.
2.3.2 Optional contract items shall include the following services for each of the four identified construction projects.
A. Project Procurement Phase: Contractor shall attend the construction pre-proposal site visit and the pre-construction conference (telecom), review construction bids, assist in preparing RFI responses, and assist in preparing solicitation amendments.
B. Project Construction Phase: Contractor shall perform the following tasks;
· Monitor and coordinate the submittal review process, including the establishment and maintenance of the submittal log; provide the CO and/or COR recommendations to approve.
· Establish and maintain an RFI log; assist the CO and COR with written reviews and written recommendations throughout the RFI response process.
· Review and monitor the preliminary and construction project schedule. Provide written recommendations to accept the contractor’s schedule with notations of discrepancies and/or opportunities to accelerate the project completion;
· Coordinate construction activities with the contractor and COR.
· Confirm in writing, any verbal discussions/directions, documenting the actions taken, understandings and decisions collaborated upon.
· Compile defects and omissions lists, related to the phase and work performed, and provide these lists to the contractor for correction. Verify the completion with the construction contractor and make recommendations to the CO and/or COR to accept or reject the installed work.
· Review construction waste reports.
· Review construction contractor payment requests to include the assessment of the percentage complete, schedule of values and recommendations for progress payments.
· Perform labor standard interviews and provide the CO with documentation on Standard Form 1445.
C. Project Inspection Services: Contractor shall perform the following tasks;
· Recommend approval/rejection of materials or workmanship.
· Monitor site safety provisions and devices for compliance with safety standards.
· Monitor site for sustainable practices and the use of sustainable materials as outlined in the construction contract.
· Provide immediate notification to CO and COR orally and in writing of unsafe working conditions;
· Ensure contractor coordinates appropriate permitting with local authorities.
· Prepare and provide to the CO and COR, written reports for each inspection with the location, types of inspection and observations.
· Maintain inspection logs and records of defects and/or omissions.
· Notify the CO and COR immediately upon discovery of any omissions and/or defects.
2.4 Deliverables:
2.4.1 Base contract items shall include the following deliverables.
A. Contractor shall prepare and submit a report to the Government within 30 days of contract award. Report shall be submitted in PDF and Word formats. The report shall contain the following elements;
· Narrative and photographic report of site visit and observances.
· An assessment of construction risk areas based on observed existing conditions and suggestions for mitigating those risks.
· The contractor shall address the objectives found in the Statement of Work paragraph, and deliver to the Agency a Performance Work Statement (PWS) to be used in the solicitation for IL Construction, should the IILP plan for such residential construction alterations be approved by the Agency (see attached sample template). The PWS should state the intent of the construction project with enough detail that a competent construction contractor could execute the work based on performance objectives. The PWS should include all elements required to satisfy the project requirements and should address any major areas of risk. The PWS shall be written from a performance based perspective. The PWS shall not include specific instructions or specifications. See below examples.
· An independent cost estimate (ICE) addressing the construction services identified in the PWS, as well as, a separate ICE (if applicable) identifying construction risk factors/areas based on observed conditions and suggestions for mitigation (e.g., ICE for lead paint remediation, mold remediation, etc.).
2.4.2 Optional contract items shall include the following deliverables;
A. Inspection Reports B. Submittal Log C. RFI Log
2.4.3 Close out deliverables shall include the following items. Final payment will not be made until all deliverables have been submitted.
A. Release of Claims B. Memo confirming photograph destruction per Section 3.6
3.0 GENERAL REQUIREMENTS
3.1 Contractor Personnel:
3.1.1 The Construction Manager (CM) Contractor shall be responsible for all work performed under this order. Contractor CM is designated as Key Personnel in accordance with Item 3.2 below.
3.1.2 CM shall be a single point of contact for the Contracting Officer (CO) and Contracting Officer’s Representative (COR). The individual designated as CM shall be equivalent in seniority to any other personnel assigned by the Contractor for this work effort.
3.1.3 CM shall be available to the CO and/or COR via telephone between the hours of 7:00am through 4:30pm, Monday through Friday, with the exception of federal holidays. Reponses to request for discussion or resolution of technical problems will be within one (1) business day of notification.
3.1.4 During the absence of the CM, only one (1) alternate shall have full authority to act for the contractor on all matters relating to work performed under this contract.
3.2 Key Personnel: Before replacing any individual designated as Key by the Government, the Contractor shall notify the Contracting Officer no less than five calendar days in advance, submit written justification for replacement, and provide the name and qualifications of any proposed substitute(s). All proposed substitutes shall possess qualifications equal to or superior to those of the Key person being replaced. The Contractor shall not replace Key Contractor personnel without acknowledgment from the Contracting Officer. The Government may designate additional Contractor personnel as Key at the time of award.
3.3 Pre-Performance Conference: The Contractor shall attend a pre-performance conference with the Government not later than five business days after the date of award. The purpose of the Pre-Performance Conference, which will be chaired by the Contracting Officer, is to discuss technical and contracting objectives of this task order and review/clarify the Construction Management requirements of the project.
3.4 Progress Meetings: The contractor shall be available to meet with the CO or COR upon request to present deliverables, discuss progress, exchange information and resolve emergent construction management problems and/or issues. Progress meetings will be held throughout the duration of the contract and will be scheduled through coordination between the CM, the CO and the COR. The Contractor will keep VA informed, through meetings, reports, on-site discussions, and/or emails, of progress and potential problems with the project concerning construction and/or with management of the project. The Contractor is required to keep an open dialogue with the CO, particularly in areas relating to quality assurance of the project, schedule, building code violations, reporting issues and, safety concerns. The CM is required to bring such matters to the attention of the CO as soon as he/she is aware of the issue(s).
3.5 Travel Requirements: Travel expenses (hotel, per diem, parking, etc.) will not be authorized for locations within 150 miles one-way of the VBA Regional Office located at: 1700 Clairmont Rd, Decatur, GA 30031-7024. Travel shall not be authorized for locations within 150 miles of the Contractor’s location. Mileage shall be calculated using Google Maps. For locations outside 150 miles radius travel expenses will be authorized in accordance with the Federal Travel Regulations.
3.6 Photography: Any photos taken by the contractor of the Veteran’s home shall not include the Veteran or any occupants of the home. Photographs shall not include any information that could be considered Personally Identifiable Information (PII) including license plates, addresses, names, telephone numbers or other information that might identify the Veteran or any occupants of the home. Contractor shall treat photographs related to this project as sensitive information. All photos shall be destroyed at the end of the project and a memo confirming this shall be required prior to final payment. If the security of the photos is compromised in any way the contractor is required to notify the VA immediately.
3.7 Security Requirements: The contractor shall ensure that all personnel (including subcontractors) assigned to perform work associated with the tasks described in this PWS have been screened through standard employment background checks. The contractor shall provide proof of these screenings upon request by the Contracting Officer. All contractor personnel must be identified with a picture ID provided by the employer and must prominently display said ID at all times while on-site. Contractor provided ID shall include, at a minimum, the employer name, employee name, and employee picture.
