Sun Nuclear Software Maintenance Control Number: TAC-18-51183

SOLE SOURCE JUSTIFICATION

1. Contracting Activity: Department of Veterans Affairs Office of Procurement Acquisition and Logistics Technology Acquisition Center 1701 Directors Blvd Austin, TX 78744

2. Description of Action: The proposed action is a sole source firm-fixed price (FFP) purchase order for continued maintenance of Sun Nuclear Corporation (SNC) software/hardware system.

3. Description of Supplies or Services: The proposed action is for the continuation of Sun Nuclear software and hardware maintenance for Department of Veterans Affairs (VA), Veterans Health Administration (VHA), Roudebush Veterans Administration Medical Center (VAMC) (Indianapolis, IN). The department of Radiation Oncology owns many pieces of SNC hardware and the accompanying software that is required to use the hardware such as PC electrometers, MapCheck2, ArcCheck, Daily QA3, IC Profiler and SNC compute server. SNC will provide needed updates and improvements throughout the life of the agreement. This system is needed to provide the legally mandated daily, monthly and yearly radiation quality assurance tests on two Varian Linear Accelerators. This contract will allow VA access to the latest versions of the required software, as well as cover repairs on certain pieces of equipment. The period of performance for the proposed action is 12-month base and four 12-month options. The total estimated price for this proposed action is , including options.

4. Statutory Authority: In accordance with Federal Acquisition Regulation (FAR)· 13.106-1 (b) (1 ), for purchases exceeding the simplified acquisition threshold. The requirements at 13.501 (a) apply to sole-source (including brand-name) acquisitions of commercial items conducted pursuant to Subpart 13.5.

5. Rationale Supporting Use of Authority Cited Above: Sun Nuclear remains the only source capable of providing hardware and software maintenance for the existing Sun Nuclear equipment. Only Sun Nuclear can meet all of VA’s interoperability and compatibility requirements because the current systems is comprised of Sun Nuclear products and operated through its proprietary code. No other vendor has the ability or data rights to access the software source code in order to develop and push software updates, patches, or provide technical support on its products. Access to the proprietary source code is critical to meet the VA’s need to maintain the Sun Nuclear equipment. SNC’s suite of product licenses and maintenance support provides a unique solution that is compatible with the existing system and with current business needs. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section eight of this document. This effort did not yield any additional sources that can meet the Government’s requirements. In accordance with FAR 5.201, this action will be synopsized at award on the Federal Business Opportunities Page and justification will be made publicly available.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed.

8. Market Research: VA technical personnel conducted market research in June 2018 by researching products comparable to the Sun Nuclear, including Standard Imaging and PTW. This review confirmed that other sources can’t provide the required hardware and software maintenance for VA’s existing Sun Nuclear equipment. The VA’s subject matter expert determined that only Sun Nuclear can meet the Government’s requirement. Therefore, these products could not meet VA’s compatibility and operability requirements. Based on the above, only Sun Nuclear can meet all of the Government’s requirements.

The Contract Specialist (CS) conducted additional market research in July 2018 by issuing an Request for Information (RFI) on National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V, Governmentwide Acquisition Contract (GWAC) and sources sought notice on Federal Business Opportunities (FBO) to determine if there are authorized resellers of the required maintenance. Based on the market research, only Sun Nuclear is capable of meeting the full requirement.
