1. Description of the Action
This purpose of this Brand Name Justification (BNJ) is to purchase true-up subscriptions and annual RedHat support subscriptions. This action will be Firm Fixed Price order. This requirement will be for one year with an estimated amount of $780,611.46, with four one-year options. The total estimated value of this requirement is $3.9M.
2. Description of the Supplies/Services
The RedHat product suite has been implemented at USPTO since 2008. Since 2008, the products have been incorporated into many systems and environments at the USPTO.
The middleware supported environments include the Development (DEV), System Integration Testing (SIT), Functional Quality Testing (FQT), Production Verification Testing (PVT), and production, these environments host more than 150 applications. In order to support the USPTO’s Next Generation systems such as Patents End-to-End (PE2E), Trademarks Next Generation (TMNG), Fee Processing Next Generation (FPNG) and to keep the applications running smoothly, it is vital to the USPTO’s IT operations to renew the annual support subscriptions licenses with RedHat and obtain additional subscriptions as needed.
The true-up subscriptions and renewals subscriptions include access to Red Hat software, updates, maintenance and support and include the following products:

3. Statutory Authority
This action is being executed under the procedures in FAR subpart 12 and 13.5, used in accordance with or the authority of PTAG 6.1.1.
4. Unique Vendor Qualifications or Nature of the Acquisition
In evaluating this requirement, it has been determined that the specialized services required for this effort are presently only available from one brand. USPTO has been looking for open source server software as one of their operation and application server platforms, as part of selection process we have evaluated various open source alternatives including Tomcat, Glassfish, IBM community edition and JBOSS Enterprise Application Platform Server. The following advantages of Red Hat make it the most advantageous selection relativeto other open source servers:
1. USPTO has made a significant investment in Red Hat Enterprise Linux and associated products from Red Hat. As JBOSS is RedHat product, there will be fewer challenges as far as technology integration is concerned.
2. Red Hat is integrated, tested and certified Enterprise Platform as evident from many from its usage in many fortune 500 companies.
3. Red Hat technologies provide accelerated deployment, accelerated deployment and are cloud ready.
4. Red Hat provides rapid innovation, with long-term stability, supportability and maintainability.
5. USPTO has been extensively using various products under Red Hat umbrella platform such as Linux Server, Satellite, Openstack, Openshift, RHEV, EAP, EWS and FUSE.
6. RedHat provides SLA-based support for all Red Hat products that includes patches, updates, multi-year maintenance policies, unlimited incident technical support, access to product knowledgebase and Red Hat Open Source Assurance.
The use of another vendor’s product would require an entire overhaul of the USPTO’s PE2E, TMNG, FPNG, MyUSPTO systems including redesign and redevelopment of the existing platforms at an estimated that cost that would exceed $25,000,000.00. The applications noted are developed to be running in JBOSS Middleware environment. Changing to another vendor's Middleware Software would require the application to go through full retesting, development, integration, deployment, and etc. Changing from RedHat would also result in product non-conformity and increased training and maintenance costs. Additionally, USPTO must currently maintain the existing systems. Continuing with RedHat will ensure minimal interruptions and provide seamless integration and performance. Any benefits that could be gained by changing to a different vendor and associated product would be negated by the cost of making the change, is not feasible, and would not be recoverable.
5. Efforts to solicit as many potential sources as possible
This requirement will be competed amongst RedHat resellers with HUBzone status who are also a small business in NAICS code is 423430, Computer and Computer Peripheral Equipment and Software Merchant Wholesalers. A combined/synopsis solicitation will be posted on Federal Business Opportunities (FBO).
6. Determination by the Contracting Officer that anticipated cost will be fair and reasonable
The anticipated price of this acquisition will be fair and reasonable based on adequate price competition.
Detailed documentation and justification of price reasonableness will be disclosed in the Acquisition File Documentation (AFD) to be prepared upon completion of negotiations.
7. Market Research
As part of market research process the OCIO Platform Services Branch reviewed various open source alternatives including Tomcat, Glassfish, IBM community edition and JBOSS Enterprise Application Platform Server. Following advantages of Red Hat stood it apart from rest of the open source servers:

10. Actions to remove or overcome barriers to competition
No actions are planned at this time, as the procurement will be competed. The use of another vendor’s product would require an entire overhaul of the USPTO’s PE2E, TMNG, FPNG, MyUSPTO systems including redesign and redevelopment of the existing platforms at an estimated that cost that would exceed $25,000,000.00. Changing from RedHat would also result in product non-conformity and increased training and maintenance costs. Additionally, USPTO must currently maintain the existing systems. Continuing with RedHat will ensure minimal interruptions and provide seamless integration and performance.
