Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

Infrastructure Nexus (MARVIN) and an operational system Range Application Deployment (RAD). Both systems are Dell VMware hardware with VMware Cloud Foundation and Tanzu Kubernetes baseline. Brand name licensing for VMware on Commercial Cloud with the Enterprise VMC licensing agreement and additional Tanzu Kubernetes core licensing are required to ensure compatibility with the existing RAD and MARVIN systems and to fully utilize the functionality of the VMware Cloud Foundation features. Additionally, the brand name licensing will ensure the ability to transition specific existing system workloads from the current environment to the cloud environment for testing and evaluation without reconfiguration.
(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:
The guidance in FAR 16.505(b)(1)(i) and in accordance to the NASA SEWP Ordering Guide, all awardees under Groups B-SDVOSB, B-HUBZone, C and D were previously given fair opportunity to provide a quote.

(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:
There are no barriers to competition. The software product/licesening is commercially available.
