Rentals will include unlimited usage hours within the contracted period of performance.
Delivery and pick-up of the equipment at the address noted above is the responsibility of the contractor. Delivery and pick-up location may be either the PNSY storage yard in Portsmouth or the Portsmouth Naval Shipyard in Kittery. The contractor will confirm which location is to be used when coordinating delivery or pick-up with the Government point of contact. After delivery, machines may be moved between either location by the Government during the term of the rental.
Equipment shall be delivered in fully functional, safe operating condition. It will be in compliance with any and all applicable laws governing internal combustion material handling equipment and its operation in the State and/or jurisdiction where the rental will be used. All units for use in California will have an CARB EIN clearly visible on each machine.
The contractor shall notify the Contracting Officer’s Representative (COR) or Technical Point of Contact a minimum of 48 hours prior to delivery of units. Delivery will occur on or before the required start date noted in the period of performance. Initial delivery will take place during normal first shift hours. The vendor should account for potential delays at the pass-office and security when planning the delivery. For the purposes of this contract, normal first shift hours will be considered week-days that are not federal holidays, between the hours of 06:00am and 02:30pm.
The Contractor will be able to deliver equipment outlined in any option CLINs within 72 hours of notification of intent to exercise the option(s) by the Government.
An inspection of each forklift shall be performed by a shipyard licensed operator using a PNSY provided MHE Inspection Sheet on delivery. Any machines not meeting the requirements of this statement of work, or having defects or damage that negatively affect the operation of the machine will be refused.
If there are deminimis defects or damage found that are determined to be superficial in nature and that do not affect the operation of the machine, they will be noted on the inspection form. The Vendor’s representative will sign the PNSY inspection form or attest in writing that the damage was pre-existing and does not affect the operation of the machine. This will be completed before the unit is accepted by the Government.
The rental period does not begin until the government has accepted the forklift.
To be allowed onto a Government Shipyard, personnel must be US citizens and in possession of appropriate personal identification. Proof of US citizenship may be necessary and can be required for access to the drydock. Allowable documentation of US citizenship is an official government issued Certificate of Birth or Naturalization (w/ raised seal & not a photocopy) or a US passport.
Vehicular access requires a non-expired driver’s license and appropriate vehicle identification or registration. The transport vehicle must have the company’s name / logo prominently displayed.
To gain access to the drydock environs, personnel must be escorted and possess / wear their own personal safety gear to include safety shoes, hard hat, eye protection, and hearing protection at a minimum.
Electronic devices with cameras are not allowed inside the controlled industrial area (CIA). In the event that a repair is needed inside the CIA that renders the machine immobile, the contractor will make arrangements to perform the maintenance in, or have the machine towed from, that area without the need for any specialty electronics equipped with cameras. Any fees or expenses associated with moving or towing will be the contractor’s responsibility.
In the event that camera equipped tools (computer/tablet/etc.) are the only feasible option to perform a repair on a machine that cannot reasonably be removed from the CIA, the contractor will work with their Shipyard contact to obtain the necessary security approvals.
The contractor shall be responsible for all preventative maintenance, repairs, and the necessary materials to complete them for any maintenance issues not arising out of abuse or negligence by the Government. The government shall be responsible for daily fluid level checks; however, the contractor shall be responsible for adding fluids to the equipment to ensure the loss of fluid is not due to a more serious mechanical issue.
All service shall be provided within twenty-four (24) hours of notification to the contractor. In the event the equipment cannot be returned to service within the twenty-four (24) hour period, a comparable replacement shall be provided by the contractor within forty-eight
(48) hours of the initial notification at no charge to the Government.
The Contractor is responsible for the disposal of any waste generated as a result of maintenance.
The Contractor shall validate all completed repairs by either signing the appropriate PNSY provided MHE Inspection Sheet, or providing a completed repair order.
If unplanned maintenance issues become frequent, the Government may request to have the equipment replaced with a more reliable unit in accordance with the unit specifications outlined herein.
Any routine preventative maintenance will be completed during normal first-shift hours unless alternative arrangements are made ahead of time.
The contractor shall provide liquid spill protection to the ground surface during all maintenance and repairs. Any/all spills shall be contained and cleaned up prior to leaving the site.
If during use, a liquid spill is caused by a broken or leaking line or some other system on the contractor’s equipment, the installation spill team will be alerted to contain the spill until the contractor can make the necessary repairs. It shall be the responsibility of the contractor to reimburse the Government for containing the spill.
If fluid leaks become frequent the government may request to have the equipment removed from the shipyard and replaced with a more reliable unit in accordance with the unit specifications outlined herein.
