DEPARTMENT OF THE AIR FORCE

47TH FLYING TRAINING WING (AETC)

JUSTIFICATION AND APPROVAL FOR A WITHIN SCOPE DETERMINATION

CONTRACT: FA3099-22-P-0038; Auxiliary Catholic Priest

1. Contracting Activity:

47 CONS Laughlin AFB, TX

2. Nature and/or description of the action being approved:

Increase in funding by $3,000.00 for the Auxiliary Catholic Priest contract in order to have sufficient funding for FY23.

3. A description of the supplies or services required to meet the agency’s needs (including estimated value).

The contract value of FA3099-23-P0038 is being increased by $3,000.00 to a new total value of $27,900.00. The period of performance for this change will not increase. Contained within the initial scope of the contract as awarded, The Contractor shall provide for the Catholic community of Laughlin Air Force Base in all capacities as a Catholic priest in the absence of the Director of Catholic Ministries (Catholic Priest – Military or Civilian GS Contract).

4. Identification and the supporting rationale.

AFFARS 5343.102-90 Contract Scope Considerations states:

Proposed modifications generally constitute new work when, a) an individual modification or the cumulative effect from previous modifications result in changes that were not fairly and reasonably within the contemplation of the parties when the contract was awarded; or b) when proposed changes are not within the terms of the original contract award.

FAR 5.101 (a)(1).

The intent of the contract was not to exceed $25,000.00, but based on additional work that was determined to be in scope increased the total contract value to exceeded the required advertising threshold mentioned in FAR 5.101(a)(1).

Only One Responsible Source and no other supplies or services will satisfy agency requirements.

5. A determination by the contracting officer that the anticipated cost is within cope:

Based on the findings listed above, the scope of the original contract will not be substantially changed by this modification. In addition, the period of performance of this contract does not need to be extended as a result of this modification. It is hereby determined that this change is a with-in scope modification, and no J&A is required, the subject proposed contract action is within scope and a contract modification will be awarded under authority of FAR 43.103(a)

6. Certification by the Contracting Officer.

I hereby certify that the justification is accurate and complete to the best of my knowledge and belief.

7. Requirements personnel certification:

I certify that the technical data which forms a basis for this justification is complete, accurate, within scope, and meets the Government’s minimum needs.
