STATEMENT OF WORK
Statement of Work
This statement of work is for the calibration and service of various pieces of mechanical testing equipment in the Naval Undersea Warfare Center (NUWC) Keyport Failure Analysis Lab. This work shall be completed by an accredited vendor who is either certified as ISO17025 and/or National Voluntary Laboratory Accreditation Program (NVLAP).
Service calibration shall be performed onsite for the large Instron load frame tensile tester, Instron desktop load cell, and Wilson twin scale hardness tester, and Leco microhardness tester located in the Failure Analysis Lab at NUWC Keyport. Service calibration will use test blocks to verify low, medium, and high readings as per relevant ASTM standards. Equipment will be calibrated to appropriate ASTM standards with NIST traceable certificates. The address of the work location is:

The calibration for the tensile tester, spring tester, and hardness testers expires August 24, 2022 and needs to be renewed. Calibration service for these pieces of equipment usually lasts a couple of days during which the vendor will need to be in the lab. The tensile testers and hardness testers are used to verify that components were manufactured to the correct mechanical properties. These pieces of equipment support both the production and R&D efforts here at Keyport. With the calibration expired, the readings cannot be viewed as accurate, and thus are not reportable. As such, more suspect hardware may be permitted into units for the fleet.

Each piece of equipment shall have a certificate of calibration issued by the vendor for each scale tested per the required ASTM specification valid for no less than 1 year from date of service.
Equipment Specific Requirements
Instron 5585P Load Frame
The Instron 5585P is a 200 kilo Newton (kN) (45,000 lbs) load frame. The vendor must be familiar with Instron Bluehill 2 software version 2.29 and have previous knowledge related to proper operation of the software used to control the Instron 5585P machine to prevent damage to personnel and equipment during service. Preventative maintenance of the load frame shall be completed as part of the calibration. All specialized vendor-owned calibration equipment, test blocks, and tools necessary to calibrate load frame/load cell in tension and compression as well as displacement shall be carried by the service provider to and from the lab. Vendor shall calibrate the load frame/load cell for both tension and compression per ASTM E4 from 1% to 100% of full scale. Vendor must calibrate displacement of the load cell in compliance with ASTM E2309 from 0.32” to 1.6”.
Instron Desktop Load Cell The Instron Desktop Load Cell (Model 34SC-5) is a tension/compression load cell with a force capacity of 5 kN (500 kgf, 1125 lbf). Any specialized vendor-owned calibration equipment and tools necessary to calibrate load frame/load cell in compression shall be carried by the service provider to and from the lab. Vendor shall calibrate the load frame/load cell for compression per ASTM E4 from 2% to 100% of full scale.
Twin Scale Standard Hardness and Superficial Tester
Preventative maintenance of the hardness test frames shall be completed as part of the calibration. Any specialized vendor-owned calibration equipment, hardness blocks, and tools necessary to calibrate hardness testers shall be carried by the service provider to and from the lab. Superficial hardness scales shall be calibrated in the 15N, 30N, 45N, 15T, 30T, and 45T scales per ASTM E18. Standard hardness scales shall be calibrated in the Rockwell “B” and “C” scales per ASTM E18.
Microhardness Tester LM247ATXM0253 The LECO LMS247AT duel indenter microhardness tester is equipped with both Knoop and Vickers indention heads. Preventative maintenance of the microhardness test fixture shall be completed as part of the calibration. Any specialized vendor-owned calibration equipment and tools necessary to calibrate hardness testers shall be carried by the service provider to and from the lab. The LECO microhardness tester LM247ATXM0253 shall be calibrated Vickers and Knoop scales per ASTM E384.
OPTION FOR ANNUAL CALIBRATION SERVICE CONTRACTS:
Options for up to two (2) annual services may be available in addition to the base contract.
The calibration shall be valid for one calendar year.
Annual payments will be committed at the time of exercise during each option year.
The statement of work requirements shall be in effect for each option year.
The bidder shall include a schedule of proposed prices over the duration of the option years.
SECURITY REQUIREMENTS
SECURITY REQUIREMENTS FOR CONTRACTOR PERSONNEL
a. Permission to visit. Whenever Contractor personnel are required to perform work aboard a ship of U.S. Navy or associated Shore Facility, the Contractor shall submit a visit request via the Joint Personnel Adjudication System (JPAS) using the visiting ship/facility’s SMO (NUWC Keyport’s SMO is 002536). If company does not have access to JPAS, a written request to visit must be sent to that ship/facility or ship Security Officer using the guidance below.
(1) For classified visits, the visit request shall include all information required by paragraph 6-100 of DOD 5220.22M Industrial Security Manual.
(2) For unclassified visits, the visit request shall include the following information on each person visiting the users agency’s facility or ship. The request shall be on company letterhead stationery with company address/telephone number and provide the following information:

b. Citizenship. No employee or representative of the contractor shall be admitted to any facility or ship of the U.S.
Navy unless satisfactory proof of citizenship of the United States can be furnished.
c. Compliance with Security Regulations.
(1) The Contractor shall comply with the security regulations in force at Naval Undersea Warfare Center, Division Keyport, WA and Keyport Annex Bangor. Company-granted clearances are not valid for access to restricted areas or information. If access to these areas or information is involved, contractor personnel must possess a Government-granted clearance based on formal investigative actions. Contractor personnel may be required to fill out a form regarding involvement with alcohol or dangerous drugs, police records, relative living abroad, and personal foreign travel as a condition for receiving a clearance.
(2) If applicable, special security provisions for access to classified information are set forth in the attached DD Form 254, Contract Security Classification Specifications.
(3) It is the Contractor’s responsibility to collect and account for all personnel identification passes/badges and vehicle passes issued to his employees when no longer needed. The Contractor must return all passes/badges to the facility security office within three (3) days of the separation of an individual from employment on this contract.
(4) It is the Contractor’s responsibility to assure that his employees are aware of, and comply with, the security requirements of the facility or ship as set forth in the contract and as explained at the preaward conference, if applicable. Noncompliance by an individual can result in denial of access to the facility or ship.
(5) If a Contracting Officer’s Representative (COR) is appointed in this contract, a listing of persons employed on the contract indicating that they have been briefed on the facility/ship security requirements shall be submitted to the COR within 14 days after award of the contract. The list is in addition to that shown in paragraphs a, b, and c above.
The list shall also include a description of all company vehicles, including road equipment and office supply trailers, to be employed on the facility, along with license numbers, if applicable. The Contractor shall promptly notify the COR of any changes to the list.
(6) Per SECNAV M-5510.36, contractor employees working in government spaces are subject to the activity’s security education program. Such employees at NUWCDIVKPT must review each NUWCDIVKPT Security Training Quarterly (STQ) Bulletin and report same to the company’s Training or Facility Security Officer.
Contractor employees with SECRET or higher clearances must attend one counterintelligence briefing annually.
Briefings are conducted quarterly and are advertised in the STQ.
(7) The use of privately owned personal computers and cellular telephones by contractor personnel at Naval Undersea Warfare Center, Division Keyport, WA and Keyport Annex Bangor is restricted. Contractors requiring such devices in the performance of this contract shall notify the Contracting Officer.
(8) Contractor personnel at Naval Undersea Warfare Center, Division Keyport, WA and Keyport Annex Bangor are prohibited from having photographic equipment, tape recorders, or other recording devices in their possession.

The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(2) The services will be furnished at prices which are, or are based on, established catalog or market prices for the maintenance, calibration, or repair of equipment.
(i) An “established catalog price” is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public.
(ii) An “established market price” is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and
(3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers.
(b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Labor Standards statute--
(1) Will not apply to this offeror, then the Service Contract Labor Standards clause in this solicitation will not be included in any resultant contract to this offeror; or

(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

C-204-H001 USE OF NAVY SUPPORT CONTRACTORS FOR OFFICIAL CONTRACT FILES (NAVSEA)
(OCT 2018)
(a) NAVSEA may use a file room management support contractor, hereinafter referred to as "the support contractor", to manage its file room, in which all official contract files, including the official file supporting this procurement, are retained. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as “protected information”. File room management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein.
(b) The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file room management services are acquired will contain a requirement that:
(1) The support contractor not disclose any information;
(2) Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files;
(3) The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and,
(4) In addition to any other rights the contractor may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed protected information, for the unauthorized duplication, release, or disclosure of such protected information.
(c) Execution of this contract by the contractor is considered consent to NAVSEA's permitting access to any information, irrespective of restrictive markings or the nature of the information submitted, by its file room management support contractor for the limited purpose of executing its file room support contract responsibilities.
(d) NAVSEA may, without further notice, enter into contracts with other contractors for these services. Contractors should enter into separate non-disclosure agreements with the file room contractor. Contact the Procuring Contracting Officer for contractor specifics. However, any such agreement will not be considered a prerequisite before information submitted is stored in the file room or otherwise encumber the government.
