A. PART I-DRYTIME BOXES:

1. Vessel Required:

A. U.S. or foreign flag, self-sustaining vessel(s) (multiple awards up to 3 vessels) capable of carrying a portion of 352,522 square feet of military cargo (wheeled vehicles, tracked vehicles, and breakbulk) from a cargo list described below.

B. Each vessel shall have a minimum capacity (measured in square feet) of 85,000 square feet of cargo from the cargo list.

C. Minimum laden speed shall be 15 knots while laden.

53 days for each vessel chartered

5. Laydays:

Commencing/Cancelling: 12, 15, and / or 18 June 2021. Offerors to offer for dates available.

Where a successful offeror offers more than one layday, the Government will select the layday upon award.

Special requirements:

A. Health and Safety Requirements:

1. Owner shall provide the MSC Area Commander with any report required under U.S. Coast

Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.

2. Owner shall provide in its proposal its company’s health and safety plans for its crew, related to the novel coronavirus for this mission. The plan will become part of the contract.

3. With respect to Restriction of Movement (ROM) procedures/COVID testing provisions, this portion of the plan will be evaluated to ensure it meets or exceeds MSC QMS requirements and provisions as relates to routine crew rotations; the MSC QMS is available upon request. An unacceptable plan as relates to routine crew rotations will render an offer ineligible for award. Alternatively, in lieu of having their ROM procedures/COVID testing provisions evaluated as part of contract award, or meeting MSC QMS requirements, an offeror may warrant that they will not conduct any routine crew changes during the course of the charter.

4. Any and all costs related to all crew changes/rotations shall be for the responsibility and account of the owner, who shall notify the Contracting Officer not later than two weeks prior to the crew change/rotation.

5. Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.

6. The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.

B. Lashing Gear: Vessel must be fully outfitted with container deck fittings, semi-automatic twist locks, stackers, rods, turnbuckles, lashing gear, dunnage, and shifting boards in sufficient quantity to safely stow and secure cargo.

C. Spreader Bar: RO-RO/LO-LO or LO/LO vessel must be equipped with a spreader bar(s) capable of lifting 20-foot containers, weight tested to 45,000 lbs. per crane.

D. Certificates: Provide most recent and complete copies (with endorsements) of the following documents:

a. Company Document of Compliance

b. Vessel Safety Management Certificate

c. Vessel International Ship Security Certificate

d. Vessel Certificate of Inspection (COI)

E. Stow Plan: Provide detailed stow plan, including vessel trim and stability values resulting from the proposed stow plan, using the provided cargo list showing the vessel’s ability to support the requirement. Stow plans may be cross-checked in ICODES for feasibility - to include square footage, weight, trim, and stability issues.

F. Fully Bunkered: Vessels shall be delivered fully bunkered.

G. Supercargo: Pursuant to PART VI(k), a minimum of 4 supercargo is required for each vessel.

H. Self-Sustaining: A contractor-provided mobile crane on vessel can equate to being self-sustaining. Offer must provide specification of self-sustaining equipment intended for use for this contract

I. Classified Requirement:

a. There is a classified requirement in this solicitation. Owners or their representative, with appropriate security clearances in place, must submit to the contracting officer a request to review the classified requirement within one business day of the issuance of this solicitation and then must then make the necessary arrangements at their expense to view the classified requirement at appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the contracting officer does not receive a request on time or if the offeror misses the appointment.

b. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owners will be notified if their offers were excluded because of this requirement.

NOTE: Boxes 1A, 1B, 1C, 6A.2, 6B, 6C, 6D, 6E, and 6H must be addressed in sufficient detail to demonstrate compliance, and Items 2, 3, 4, 5, 6A.1, 6A.3, 6A.4, 6A.5, 6A.6, 6F, 6G, and 6I must be acknowledged.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

The offeror’s price proposal will be evaluated based on the value of the charter hire rate(s) offered for the entire charter period of (a) 53 days, price for fuel, and any other pricing elements set forth in the offer. For evaluation purposes, the period of performance will consist of (b) 53 days.

Fuel calculations will be based upon (c) 36 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 68 and 70; (d) 00 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 69 and 70; and (e) 17 days in port idle, using the fuel consumption provided in DRYTIME Box 71. The evaluated price will be per vessel offered and will be computed based upon the above costs set forth in the offer, divided by the percentage of the cargo packing list

(per vessel) in square feet that can be carried, to formulate a “per percentage, by square feet, of the packing list” rate. Award will be made, if at all, to the offers (up to three) with the lowest “per percentage, by square feet, of packing list rate” that collectively carry 100% of the packing list, or the

Government’s needs have been met. The proposed price(s) must be determined to be fair and reasonable.”

Where a successful offeror offers more than one layday, the Government will select the layday upon award.
