About this file
This document is a Justification for Other Than Full and Open Competition (JOTFOC) for the U.S. Coast Guard, specifically supporting a sole-source procurement of ten (10) ELBOW, WATER INJECTION PORT components (P/N 206168, NSN 4730-01-617-9439) for a 45 RBM vessel. Marine Exhaust Systems, Inc. is identified as the sole Original Equipment Manufacturer (OEM), with the justification citing that the technical data and manufacturing specifications required to assess equivalent parts are unavailable. The document emphasizes critical operational requirements, noting that alternative parts could potentially compromise the exhaust system's performance and create safety risks such as harmful gas buildup or fire hazards.
The justification was prepared under the authority of 10 U.S.C. § 3204(a)(1), which allows procurement from only one responsible source when no other supplies can satisfy agency requirements. Market research efforts included internet searches and review of previous purchases, concluding that Marine Exhaust Systems, Inc. has no known distributors and exclusively possesses the proprietary manufacturing drawings and technical specifications. The Contracting Officer of Record, James Taylor, recommends continued market research to potentially identify alternative vendors in future acquisitions, with the current procurement focused on ensuring mission-critical equipment reliability for Coast Guard vessels.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT
WILL MEET THE GOVERNMENT’S REQUIREMENT.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE. The purchase of ten (10) each, ELBOW, WATER INJECTION PORT, P/N 206168, NSN 4730-01-617-9439. Vessel: 45 RBM. MARINE EXHAUST SYSTEMS, INC. is the Original Equipment Manufacturer (OEM) of the part, therefore, any material offered shall conform to this brand.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. The technical data for the ELBOW, WATER INJECTION PORT required to make an accurate assessment of equal or alternate equipment that could meet the Coast Guard’s performance, fit and function requirements for this procurement is unavailable. The ELBOW, WATER INJECTION PORT is used in the EXHAUST SYSTEM to help cool and remove harmful gases from the engine compartment. A failure of the EXHAUST SYSTEM would result in placing the vessel in a hazardous situation with the buildup of harmful exhaust gases and possible fire hazards. Any attempt to manufacture this item without the proper Original Equipment Manufacturer (OEM) parts and access to OEM reproduction manufacturing drawings, spec, tolerances/parameters, test procedures and other relevant information, could lead to major mission degradation.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). Researched the Internet for vendors available to provide the ELBOW, WATER INJECTION PORT, reviewed Previous Buys for material. The Internet shows various manufacturers an ELBOW, WATER INJECTION PORT, however, MARINE EXHAUST SYSTEMS, INC. is the brand presently installed onboard, compatible with the EXHAUST SYSTEM installed on Coast Guard small boats. Searched for other vendors capable of supplying the OEM “official” ELBOW, WATER INJECTION PORT.
MARINE EXHAUST SYSTEMS, INC. has no known distributors.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
MARINE EXHAUST SYSTEMS, INC. is the suggested source that can provide the ELBOW, WATER INJECTION PORT. Any offer of parts shall be “official brand OEM” parts. MARINE EXHAUST SYSTEMS, INC. is the sole possessor of the drawings and other technical information required to properly manufacture the ELBOW, WATER INJECTION PORT. Another vendor’s part may not contain the same fit, form and function as the MARINE EXHAUST SYSTEMS, INC. brand, and could lead to fabrication being necessary for installation.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. This is a proprietary commercial item of the proposed contractor. The reproduction of manufacturing drawings, specifications and other technical data related to this item were never purchased by the U.S. Coast Guard and therefore are controlled by and remain the sole property of the OEM.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. COR will continue to conduct market research in the attempt to locate vendors that can satisfy the needs of the Coast Guard including a requirement for manufacturer’s engineering drawings, detailed parts lists, design or testing procedures, and other relevant information concerning this item.
