1.0 Description of Services
1.1 Objective(s): This Performance-Based Work Statement (PWS) describes the requirements to provide timely sustaining engineering and technical support for the AN/APQ-170 Multi-Mode Radar System and subsystems (hereafter referred to as the AN/APQ-170 Radar System) to resolve deficiencies and improve reliability, maintainability and functionality. These requirements include engineering studies in support of resolving reliability and maintainability issues, resolving obsolete parts issues and analyzing failure trends from the depots and the field level shops. The contractor shall deliver correct data deliverables as outlined on each request.
Engineering support shall also include the correction of errors in engineering drawings, investigating anomalies on the aircraft and in the radar and test equipment as well as any other technical support that is required. The tasks associated with this contract are to be accomplished at the contractor’s facility and other locations as specified by the Government. These tasks shall support the war fighter in performing missions that utilize the AN/APQ-170 Radar System. The contractor shall provide timely support (by the most economical means) to resolve issues with the radar, allowing return of the aircraft(s) to full mission capability expeditiously.
1.2 Benefit to United States Air Force (USAF): This acquisition will benefit the United States Air Force (USAF) by providing a one-12 month basic and four 12-month option periods that will resolve deficiencies and improve reliability, maintainability and functionality. The engineering studies will resolve, or provide a resolution to obsolete parts issues and analyze failure trends from the depots and field level shop. To be proactive, the contractor shall analyze failure data on a quarterly basis to identify current failure trends in order to keep the radar in a functioning state for the war fighter.
1.3 Background: The AN/APQ-170 Radar System was designed and developed by DRS Sustainment Systems, Inc. (hereafter referred to as DRS) for the United States Air Force (USAF). The AN/APQ-170 Radar System was designed to support Terrain Following and Terrain Avoidance (TF/TA) capabilities specifically for use on the Special Operations Forces (SOF) MC-130H Combat Talon II (CT-II) aircraft, and to provide controlled flight at low levels.
The AN/APQ-170 Radar System is also capable of ground mapping, weather detection, and beacon interrogation.

The contractor shall submit a recurring status report to AFLCMC/WIUAI in accordance with (IAW) its Contract Data Requirements List (CDRL). The contractor’s report shall be complete and accurate so the number of report rejections/revisions shall not exceed one per quarter. Rewritten reports shall be resubmitted to AFLCMC/WIUAI within five

working days after notification that the report must be rewritten.

The contractor shall submit technical reports to AFLCMC/WIUAI IAW the mutually established suspense for completion of the review, study, analysis, etc. Government will direct revisions on individual draft submissions which shall not exceed one per report. Revisions shall be submitted to AFLCMC/WIUAI within ten working days after notification that the report must be rewritten. The contractor’s final report shall be 100% accurate and contain zero discrepancies.

Each data deliverable shall be reviewed by the applicable person and meet the requirements of its CDRL. The Integrated Product Team (IPT) will review CDRL for quality and if needed issue an e-mail notification or rejection letter to contractor. No more than one e-mail notification or rejection letter shall be allowed for each deliverable quarterly.

The contractor shall submit all drawings IAW the mutually established suspense for their completion. One Government directed revision per drawing is allowed. Drawing revisions shall be submitted to AFLCMC/WIUAI and AFLCMC/LZPEM within five working days after notification that the drawing must be revised.

3.0 Government Property
3.1 Contractor Responsibility: The contractor shall be responsible for Government property in their possession IAW the Federal Acquisition Regulation (FAR) and applicable supplements including, but not limited to, FAR Part 45, Government Property; FAR 52.245-1, Government Property; and Defense Federal Acquisition Regulation Supplement (DFARS) Part 245, Government Property. 3.2 Government Property to be Provided: 411th SCMS/GULA issued a repair contract for the repair of the AN/APQ-170 Radar System under sole source contract, FA8524-18-D-0017, with DRS. Use of the Government Furnished Equipment (GFE) identified in the repair contract may also be required to support this effort. The contractor shall be allowed to use it on a non-interference basis.
3.3 Reporting of Government Property: The Contractor shall create and maintain records of all Government property accountable to the contract. The Contractor shall record receipt and return of Government-Furnished Property (GFP) in the Item Unique Identification (IUID) Registry.
3.4 Loss of Government Property
3.4.1 Definition of Loss of Government Property: “Loss of Government property” means unintended loss of or damage to Government property including property that cannot be found after a reasonable search, loss due to inadequate storage, loss due to lack of security, theft, damage requiring repair to restore the item to usable condition, or damage that renders the property useless for its intended purpose or Beyond Economical Repair (BER). Loss of Government property does not include manufacturing defects, obsolescence, normal wear and tear, or purposeful destructive testing. Unless otherwise stated in the contract, loss of Government property does not include normal and reasonable inventory adjustments, i.e., losses of low priority consumable material, such as common hardware, as agreed to by the Contractor and the Government Property Administrator.
3.4.2 Reporting Loss of Government Property: The Contractor shall report loss of Government property using Defense Contract Management Agency (DCMA) / Access to eTools.

3.5 Return or Retention of Government Property: All property provided by the Government remains the property of the Government and shall be returned to the Government as directed, but no later than completion of the contract, unless the Procuring Contracting Officer (PCO) directs the Contractor to retain the property for continued use under a successor contract. All Government property shall be returned to the Government in the condition provided unless approved in advance by the PCO. All material generated under the contract becomes the property of the Government and shall be returned to the Government as directed, but no later than completion of the contract, unless the PCO directs the Contractor to retain the material for continued use under a successor contract.
3.5 Government System(s): The Government will provide contractor personnel access to system(s) necessary to perform tasks under the contract. Upon completion/termination of the contract or transfer/termination of contractor personnel, the system account(s) will be closed.
4.0 Technical Requirements

4.1 Engineering Services: Engineering services shall include the performance of engineering studies in support of resolving reliability and maintainability issues, resolving obsolete parts issues, and analyzing failure trends from the depots and the shop at the field unit and any other technical support that is required. Findings shall be documented in a contractor format IAW CDRL A001. This tasking shall allow the contractor to do the engineering groundwork initiated by a reliability or maintainability problem and could result in an Engineering Change Proposal (ECP). The contractor shall maintain and submit on a quarterly basis, a Diminishing Manufacturing Sources Material Shortages report and a reliability report for each Line Replaceable Unit (LRU) of the AN/APQ-170 Radar System. The Contactor shall be proactive in identifying and addressing technical issues in the field. [CDRL A001, DI-MISC-80711A/T, Scientific and Technical Reports]
4.2 Reports and Data Deliverables: Each data deliverable shall be reviewed by the applicable person and meet the requirements of its CDRL. No more than one rejection letter shall be allowed for each deliverable quarterly.
4.2.1 Integrated Master Schedule (IMS): The contractor shall develop an IMS showing accomplishments within the period of performance as individual tasks are identified. Each milestone on the most current IMS shall not be late more than 30 days. Any change to the IMS and milestones shall require concurrence from the Government. The contractor shall remain within 10 working days of schedule parameters set forth in the IMS. If the IMS is revised, and approved by the Government, the contractor shall be held to the same 10 working day standard which begins immediately pending Government approval. Milestones shall include any Technical Data Package (TDP) Guidance Conferences, TDP In Process Reviews (IPR), in-house design reviews and Technical Report deliveries. 4.2.2 Monthly Status Reports: These reports shall include the technical support provided by the contractor. The contractor shall document task status by milestone and schedule, contract issues and actions. In addition, all problem areas shall be covered, with recommended solutions and the outcome after solutions are implemented. The Contractor’s report shall be complete and accurate so the number of report rejections/revisions shall not exceed one per quarter. [CDRL A003, DI-MGMT-80368A, Status Report]
4.2.3 Performance and Cost Report: The contractor's monthly report shall document 1) man-hours by labor category and task, 2) material costs by task, and 3) total contractual expenditures and funds remaining as of the reporting date for each contract line item. Each data deliverable shall be reviewed by the IPT and meet the requirements of its CDRL. Only one rejection shall be allowed for each report. [CDRL A004, DI-FNCL-80912A, Performance and Cost Report]
4.2.4 Technical Reports: The final results of any engineering studies shall be documented in a technical report. [CDRL A001, DI-MISC-80711A/T, Scientific and Technical Reports]
4.2.5 Engineering Data: The contractor shall develop/produce/maintain and deliver a TDP that accurately depicts the final product. The TDP shall represent the approved, tested, and accepted configuration of the defined delivered item(s). TDP data includes, but is not limited to, PR: FD2060-21-30211 PWS REVISION: 0 7
Computer Aided Design (CAD) data, CAD models, model based definition data sets, Gerber data and Master Bill of Materials. The TDP shall provide the necessary design, engineering, manufacturing, testing, and quality assurance requirements information necessary to enable the procurement or manufacture of an interchangeable item that duplicates the physical and performance characteristics of the original product without additional design engineering effort or recourse to the original design activity or any third party. Vendor Item Control Drawings shall be used to specify the requirements for purchased items when such items have been approved for use in the design and are used without alteration, selection or source qualification (testing of an item prior to procurement action to ensure that it satisfies the specified requirements). All engineering product definition data created as a result of this contract shall be considered a part of the TDP and shall be delivered to the Government with unlimited rights.
The TDP shall be delivered IAW U.S. AF Product Data Specification drawing 9579776 Revision L (CAGE 98752); reference attached DD Form 1423 Block 16. [CDRL A005, DI-SESS- 81000F/T, Product Engineering Design Data and Associated Lists]
4.2.5.1 Engineering Data Guidance Conference (Engineering Data Post-Award Multi- Functional Team (MFT) Meeting: As required, the contractor shall support and co-chair a Guidance Conference with AFLCMC/LZPEM for engineering data within 60 days after request by the Government. The conference shall be convened at a site and on a date agreed upon by the Government PCO and the contractor. The contractor shall prepare an agenda and record the minutes of the Guidance Conference. The contractor shall address, discuss, and provide status on the following:
a. Understanding of all CDRL requirements, applicable Data Item Descriptions (DIDs), specifications and standards.
b. TDP review requirements and schedules.
c. TDP delivery requirements and schedules.
d. Contractor’s drafting practices, procedures and TDP drawing formats.
e. The contractor’s quality assurance procedures relating to TDP documents, including quality control of subcontractor and vendor data.
f. The role of subcontractors and vendors who may deliver TDP documents under this contract.
g. The contractor’s configuration management system, including methods for releasing documents, approving documents and incorporating changes into documents.
h. Digital TDP Deliverables.
Note: Guidance Conference may be held in conjunction with other meetings or conferences.

4.2.5.2 In Process Review of the TDP (Engineering Data MTF Review): As required, the contractor shall host, support and co-chair (at a location mutually agreed upon by Government and contractor) an IPR of the engineering drawings and associated lists and other documentation to be included in the TDP. The contractor shall have a copy of all data available at the IPR. The IPR will be conducted only after the contractor’s quality assurance personnel have completely reviewed the data and determined that data are of sufficient quality that Government time will be

effectively utilized during the review. The IPR may be scheduled when data has reached the 50% completion point and shall be held, when possible, in conjunction with other reviews (i.e., Preliminary Design Review (PDR), Critical Design Review (CDR). The contractor shall notify the AFLCMC/LZPEM a minimum of 30 days prior to the anticipated date of completion point.
The IPR shall focus on the contractor’s progress in the preparation of the TDP. The contractor shall support and provide the necessary resources, i.e., meeting agenda, conference room, applicable data and minutes, with appropriate personnel available to answer any questions to perform the IPR effectively. The contractor shall correct all discrepancies identified in the IPR.
All subcontractor and vendor data shall be made available for review. If the quantity of subcontractor or vendor data is of sufficient magnitude, the Government may schedule a separate IPR at the subcontractor’s or the vendor’s facility. 4.2.5.3 Class I/II Changes: Any proposed Class I/II change shall be submitted to the Government for concurrence/approval on the class of the change. This support shall include development of any Engineering Orders (EO) required to update existing drawings. [CDRL A001, DI-MISC-80711A/T, Scientific and Technical Reports]
4.2.5.4 Engineering Change Proposal (ECP): The contractor shall provide Class I or Class II ECP to address changes to the TDP, as required. When a part is determined to be obsolete, the contractor shall prepare and submit ECP in order to qualify a replacement for use in the radar.
The contractor shall perform a proof of concept on all ECPs and reengineering projects. The contractor shall analyze failure data on a quarterly basis to identify current failure trends so they can be addressed in order to keep the radar in a functioning state for the war fighter. 4.2.5.5 Prototyping: The contractor shall develop prototype hardware as required to validate and test alternative designs, integrate equipment into the AN/APQ-170 Radar System, update support equipment and conduct qualification testing. This shall include support for Temporary 1 (T-1) and Temporary (T-2) test requirements. Prototype hardware shall be production representative, documented by engineering drawings and specifications. The contractor shall obtain design concept approval of all assembly and installation drawings prior to the prototype installation. Prototype installation will be accomplished for the purpose of proving the validity of the contractor’s design, verification of the kit component design, completeness of kit contents, checking electromagnetic effects (EME), testing of system performance and verification of the preliminary Time Compliance Technical Order (TCTO). The contractor shall furnish the prototype installation kit and installation labor unless otherwise directed. Drawing revisions shall be submitted to the Government Program Manager at AFLCMC/WIUAI and the Government Engineer at AFLCMC/WIUEB within five working days after notification that drawings must be revised. The contractor’s final product shall be 100% accurate and comply with the applicable CDRL requirements. [CDRL A005, DI-SESS-81000F/T, Product Engineering Design Data and Associated Lists]
4.2.5.6 Relationship of Contractor with Subcontractors and Vendors: The contractor shall levy on sub-contractors and sub-vendors the same requirements for TDPs as are levied on them

by this contract. This requirement shall apply at all tiers of sub-contractor/vendor levels associated with the program.
4.2.5.7 Engineering Data Updates and Revisions: The contractor shall (and shall cause subcontractors and vendors to) update and maintain engineering data for the item(s) designed/ developed/modified/produced and funded by this contract or the life of this contract and shall incorporate all changes IAW the following:
a. All engineering changes shall be incorporated into the applicable engineering data IAW the CDRL.
b. All engineering changes shall be incorporated into the applicable engineering data prior to delivery of data for review.
c. All engineering changes shall be incorporated into the applicable engineering data prior to delivery of final media.
d. Revisions to existing engineering drawings/models and associated lists and other documentation to be included in the TDP for which the contractor is the current design activity shall result in the delivery of the entire revised document and associated data file. For example, when a portion of a document is revised the entire document shall be delivered.

4.3 Changes to Technical Orders (TOs): The contractor shall submit an Air Force Technical Order (AFTO) Form 22 to show the before and after changes to any affected Technical Orders.

4.4 Data Deliverables: Per Department of Defense (DoD) policy, every attempt shall be made by the contractor to provide “paperless” electronic or digital deliveries. Status Reports shall be submitted by e-mail. Engineering drawings shall be delivered IAW the CDRL for Product Drawings/Models and Associated Lists.
4.5 Action Item Tracking: The contractor shall establish and maintain an action item tracking system for the program review meetings as needed. The action item tracking system shall document the action item content, source, status, due date and offices of primary and collateral responsibility. Open action items and recently closed action items shall be included in the monthly status report. [CDRL A003, DI-MGMT-80368A, Status Report]
4.6 Packaging: The Contractor shall package and mark material IAW the contract Air Force Materiel Command (AFMC) Form 158, Packaging Requirements; MIL-STD-129P, Department of Defense Standard Practice / Military Marking for Shipment and Storage; MIL-STD-130N, Department of Defense Standard Practice / Identification Marking of U.S. Military Property; and MIL-STD-2073-1D, Standard Practice for Military Packaging.
4.7 Transportation of Materials and Equipment: The contractor shall arrange, obtain, and provide all transportation required for the movement of all material and equipment in support of

this task. The contractor shall use the lowest cost mode of transportation commensurate with mission requirements.
4.8 Period and Place of Performance
4.8.1 Contract Period of Performance: The period of performance for the contract is for one- 12 month basic and four 12-month option periods.
4.8.2 Place of Performance: These services shall be performed primarily at the contractor’s facility.
4.9 Travel: The contractor, in performing required engineering services, may be required to travel to other Government installations or to contractor facilities to observe and conduct tests, ensure compatibility of configuration changes and other integration services and to furnish technical guidance as required. Trips, numbers and types of personnel shall be limited to the minimum required to accomplish work requirements. The contractor shall be responsible for arranging all contractor personnel travel during the program effort. All travel must be approved by the Government PCO five (5) business days in advance. The travel request shall include, as a minimum, the dates of travel, purpose, number of personnel traveling and estimated cost. All travel should adhere to the requirements of FAR 31.205-46, Travel Costs. The results of each trip shall be documented in a trip report, which shall be delivered as an attachment to the monthly status report. The contractor shall provide a list of projected travel requirements in the status report. [CDRL A003, DI-MGMT-80368A, Status Report]
4.10 Over and Above: The contractor shall submit over and above requests to the Government Program Manager (PM) for concurrence. The PM will forward written concurrence to the PCO.
Funding shall be provided by the contracting agency upon Government approval of the over and above work.
4.11 Program Management: The contractor shall establish a formal project organization responsible for the program. The contractor shall identify and maintain throughout the contract period a list of key personnel who have management and task accomplishment responsibilities, including key personnel of any major subcontractors. The contractor shall have the responsibility for the management, administration, financial control, engineering, manufacturing, procurement, testing, and quality assurance activities associated with this effort. The contractor shall serve as the point of contact on all contractual and technical matters. All program management requirements of the contract shall extend to the effort required by this PWS.
Overtime, weekend, or holiday work is not anticipated, but may be added as required if approved by Government program management through the PCO.

4.12.1 Quality of CDRL Deliverable: There shall be no more than one rejection of any deliverable. There shall be no more than one total rejection(s) of deliverables per quarter. The Government will reject a deliverable if one (1) or more technical errors or two (2) or more minor errors are found within the deliverable. A technical error is defined as the format not being in accordance with the CDRL or the content not being accurate and complete in accordance with the CDRL, PWS or contract. A minor error is exemplified by a typographical error, a grammatical error, etc. The rejected deliverable shall be corrected and resubmitted within five
(5) business days of notification of Government rejection.
4.12.2 Receipt of CDRL Deliverable: CDRL deliverables shall be submitted via Wide Area Workflow (WAWF) and submitted directly to the MFT e-mail address identified on the CDRL.
There shall be no more than one (1) late submission(s) of deliverables per quarter. The Contractor shall notify the Government if the delivery of any data/document shall not meet the scheduled delivery date and negotiate a revised delivery date. The data/document shall be delivered by the revised delivery date acceptable to the Government.
4.13 Cybersecurity
4.13.1 Cybersecurity Implementation: The contractor shall integrate DoD Instruction 8510 procedures into all architecture, design, development, integration, and test processes and products. The contractor shall implement the applicable cybersecurity controls through the risk management and systems engineering technical processes: stakeholder requirements definition, requirements analysis, architecture design, implementation, integration, verification and validation. The contractor shall integrate cybersecurity into all systems engineering functional areas including as part of program protection and anti-tamper. The contractor shall ensure that the development environment and processes support cybersecurity implementation.

4.13.2 Cybersecurity Workforce: The contractor shall implement DoD Directive 8140.1 and DoD 8570.1-M for requirements and processes necessary for information management and cybersecurity including those applicable to contractor employees and employee training.
4.13.3 Cybersecurity in Technical Data: The contractor shall ensure that training materials, technical manuals, and other technical data developed for the program address any cybersecurity controls (e.g., administrative, procedural, inherited) or requirements that affect system operation, maintenance, repair, or other support activities.
4.13.4 Supply Chain Risk Management (SCRM) Process: The contractor shall establish and implement a SCRM process, integrate it into their configuration management and overall risk management processes to ensure that the delivered system, maintenance equipment, and supplies (e.g., spares and repair parts) do not incorporate counterfeit parts, malicious code, or any other elements that would allow adversaries to gain unauthorized access to data, alter data, interrupt communications, or otherwise disrupt operations.
a. The contractor shall report to the Government on any case where configuration control of systems, assemblies, subassemblies and parts, and mechanisms in their own supply chain is not sufficient to allow traceability of parts to an Original Equipment Manufacturer (OEM), Original Component Manufacturer (OCM), or authorized distributor.
b. The contractor shall require their vendors, suppliers and subcontractors to participate in the counterfeit prevention and supply chain risk mitigation activities.
c. The contractor shall use inspection tools and techniques for detecting counterfeit parts.
d. The contractor shall use authentication and screening techniques for securing any electronic parts that are not received from an OEM, OCM, or authorized distributor.
e. The contractor shall screen and test received system components for evidence of unauthorized tampering or modification, intentional bugging or subversion, or harmful features during manufacture and assembly or after repair or refurbishment.
f. The contractor shall demonstrate via testing that all critical components used in cryptographic systems are free of intentional defects and malicious design alterations.
g. The contractor shall ensure that no component, part, or material that is suspected or determined to be counterfeit is used in the system. The contractor shall ensure that any components, parts, or materials that are suspected or determined to be counterfeit are not placed back into inventory.
h. The contractor shall develop and implement a Counterfeit Prevention Plan to describe how they shall prevent procurement of counterfeit materials and parts, including mechanical piece/parts and electronics components procured for sustainment of those systems and assemblies. 5.0 General Information
5.1 Continuation of Mission-Essential Services During a Crisis

5.1.1 Definition of Mission-Essential Services: IAW DFARS 252.237-7023(a)(1), Continuation of Essential Contractor Services, “ ‘Essential Contractor service’ means a service provided by a firm or individual under contract to DoD to support mission-essential functions, such as support of vital systems, associated support activities, and similar services provided to foreign military sales customers under the Security Assistance Program. Services are essential if the effectiveness of defense systems or operations has the potential to be seriously impaired by the interruption of these services, as determined by the appropriate functional commander or civilian equivalent.”
5.1.2 Designation of Services as Mission-Essential: IAW DFARS 252.237-7023, Continuation of Essential Contractor Services / Policy, DFARS 252.237-7023(a)(2), and Air Force Instruction (AFI) 10-403, Deployment Planning and Execution, paragraph 1.9.1.33.2, the Functional Commander (FC) or civilian equivalent has determined these services are not mission-essential and will not continue in the event of a crisis.
5.2 Security Requirements
5.2.1 Actual knowledge and/or generation of classified information and/or Controlled Unclassified Information (CUI) are not expected to be necessary for performance of the contract.
Contractor personnel are required to comply with Government security requirements to preclude potential security incidents or violations; including potential unauthorized disclosure or compromise of classified and/or controlled unclassified information.
5.2.2 Security Clearance: It is not expected contractor/subcontractor personnel will require security clearances for proper accomplishment of contract requirements.
Contractor/subcontractor personnel shall not be authorized access to classified information and/or Controlled Unclassified Information (CUI) and classified items or be permitted to work on classified projects and/or programs without an appropriate security clearance and a need-to-know.
5.2.3 Security Incident or Violation: The Contractor shall immediately notify the Government Security Office of any potential or actual security incident or violation.
5.2.4 Access to Government System(s): The contractor shall have access to the Electronic Technical Manual Systems (ETMS). They shall submit a request for a National Agency check, Standard Form 85P and Questionnaire for Public Trust Positions to AFLCMC/WIUWA Security Office for processing. The Government will provide contractor/subcontractor personnel access to system(s) necessary to perform tasks under the contract/order. The Contractor shall ensure contractor/subcontractor personnel who require access to an unclassified or classified Government Automated Information System (AIS) have the respective background check or security investigation conducted. At a minimum, the Contractor shall ensure contractor/subcontractor personnel who require access to an unclassified AIS have a National Agency Check with Inquiries (NACI) conducted. Upon completion/termination of the contract/order or transfer/termination of contractor/subcontractor personnel, the Contractor shall ensure the system account(s) are closed.

5.2.5 Access to Government Facility or Military Installation: The Contractor shall ensure contractor/subcontractor personnel who require access to a Government facility or military installation comply with the security requirements of the facility or installation.
5.2.6 Common Access Card (CAC)
5.2.6.1 The Contractor shall ensure a CAC is obtained by all contractor/subcontractor personnel who require access to DoD computer networks/systems, for DoD facility entry control and/or for physical access to facilities and buildings to perform tasks under the contract/order. The Contractor shall provide a list of contractor/subcontractor personnel who require a CAC to the PCO. The Government will provide the Contractor instruction on how to complete a Contractor Verification System (CVS) application and notify the Contractor of approval/disapproval of contractor/subcontractor personnel application. Contractor/subcontractor personnel shall obtain the CAC from the local Real Time Automated Personnel Identification Documentation System (RAPIDS) issuing facility [usually the Military Personnel Flight (MPF)].
5.2.6.2 The Contractor shall immediately report a lost or stolen CAC as directed by local Government policy. The Contractor shall notify the PCO of any change to the list of contractor/subcontractor personnel who require a CAC and provide an updated list within five business days. The Contractor shall return a CAC within five business days once contractor/subcontractor personnel no longer require computer network/system access and/or facility access. The Contractor shall return an expired CAC within five business days after the expiration date. The Contractor shall return any and all CACs within five business days after completion/termination of the contract as directed by local Government policy.
5.3 Environmental Management System (EMS): Contractor/subcontractor personnel who perform work on any Government facility shall comply with the EMS requirements established by the facility. Contractor/subcontractor personnel may be required to complete EMS training prior to beginning work.
5.4 Agency Affirmative Procurement Programs: In accordance with FAR 23.404, Agency Affirmative Procurement Programs, 100% of purchases of Environmental Protection Agency (EPA)-designated products included in the Comprehensive Procurement Guidelines (CPG) list [http://www.epa.gov/cpg/products.htm] and/or United States Department of Agriculture (USDA)-designated products included in the bio-based product listings [http://www.biopreferred.gov] shall, at a minimum, meet the EPA or USDA standards for recovered materials or bio-based content, respectively, unless an item cannot be acquired competitively within a realistic timeframe, meet appropriate performance standards, and/or be acquired at a reasonable price.
5.5 Safety Requirements
5.5.1 Contractor Compliance: The Contractor shall comply with Government Safety and Health regulations including, Public Law 91-596 as amended by Public Law 101-552 [Occupational Safety and Health Act of 1970 (OSHA)] and DoDD 4715.1E, Environment, Safety, and Occupational Health (ESOH).

5.5.2 Mishap Notification/Investigation
5.5.2.1 IAW AFI 91-204, Safety Investigations and Reports, paragraph 2.4.6.1.1, the contractor shall report mishaps involving damage or injury to USAF interests. IAW AFI 91-204, paragraph 1.3.1.1, damage or injury includes: damage to DoD property; occupational illness to DoD military or civilian personnel; injury to on- or off-duty DoD military personnel; injury to on-duty DoD civilian personnel; and damage to public or private property or injury or illness to non-DoD personnel caused by USAF operations.
5.5.2.2 IAW AFI 91-204, paragraph 2.4.6.1.1, the contractor shall ensure the USAF [Safety Office] and the applicable contract management authority are notified of mishaps. The contractor shall contact the MFT [Contracting Officer’s Representative (COR), if available, or another MFT member] by telephone within four (4) hours. The MFT will notify the Safety Office and the PCO. No more than one instance of late mishap notification per year.
5.5.2.3 IAW AFI 91-204, paragraph 2.4.6.1.2, the contractor shall cooperate with USAF safety investigations.
5.5.3 Voluntary Protection Program (VPP): Contractor personnel performing work on a USAF installation shall participate in the local VPP. Information on the VPP can be accessed at http://www.osha.gov/dcsp/vpp/index.html.
5.6 Inspection of Services
5.6.1 IAW FAR 52.246-4, Inspection of Services – Fixed Price for data and FAR 25.246-5, Inspection of Services – Cost-Reimbursement for engineering services, gives the Government the right to inspect contractor performance.
5.6.2 IAW FAR 52.246-4 and FAR 52.246-5, the contractor shall maintain an inspection process acceptable to the Government. The contractor shall maintain records of inspections which shall be made available to the Government as long as the contract requires.
5.7 Service Contract Reporting: In accordance with 10 United States Code 2330a, the Contractor shall provide an annual count of Contractor/Subcontractor personnel performing work for each fiscal year if the DoD is the requiring activity and if the acquisition is in excess of $3,000,000.00. The Contractor shall report all Contractor labor hours, including Subcontractor labor hours, required for performance of the services provided under the contract in the System for Award Management (SAM). Reporting shall be conducted for each fiscal year in accordance with the Service Contract Reporting User’s Guide located on the SAM website. The Contractor shall establish a record for the contract/order in SAM no later than 30 calendar days after contract/order award. 5.8 Invoicing/Payment and Receipt/Acceptance
5.8.1 IAW DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports, the contractor shall submit/process payment requests (Invoices, Receiving Reports or combos) and receipt/acceptance documents via WAWF. 5.8.2 CDRL deliverables may be submitted using WAWF or be submitted directly to the applicable MFT member IAW the CDRL. The CDRL will determine submittal requirements;
however, separately priced data must be accepted in WAWF in order for the contractor to receive payment, and both separately priced and non-separately priced data must be accepted in WAWF in order for the contract line item to be closed out.
5.9 Quality Control Plan/Quality Management System (QMS): The Contractor shall ensure the quality of services through a quality and/or inspection system. The Contractor shall submit a Quality Control Plan (QCP) addressing detection of quality program problems and defects, identification of root causes for quality related problems/defects, correction of root causes related to detected problems/defects, and follow-up to ensure quality related problems/defects do not recur. The plan shall include the schedule of quality assurance/control inspections planned by the Contractor. 100% compliance with the QMS is required. 5.10 Trafficking in Persons: The Contractor shall comply in accordance with the FAR and applicable supplements and shall be in compliance with all applicable guidance and clauses listed in the contract as it relates to Trafficking in Persons.
