This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items.

MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for one vessel capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available MSC web site at https://www.msc.navy/mil, under “Contracts,” then “Proforma” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

B. I. DRYVOY BOXES:

1. VESSEL REQUIRED:

One, U.S. or foreign flag. self-sustaining (the use of contractor-provided shore cranes and/or floating cranes, at the contractor’s expense, will equate to being self-sustaining) vessel or tug/barge unit to transport one, U.S. Navy range boat. The lift shall be conducted in accordance with the Navy Tow Manual Chapter 8-3 3.1 (available upon request).

2. CARGO DESCRIPTION:

ONE (1) NAVY RANGE BOAT

- DIMENSIONS AND DETAILS AS FOLLOWS:

A. Length: 115' 6" B. Width: 33' 10" C. Height from the keel to the main deck: 13' 7" D. Height from the keel to the top of the pilot house: 30' 1" E. Height of mast from the keel: 49’00” F. Range boat will need to be towed by awardee approximately 1,000 yards from Naha small boat basin to Military terminal prior to load. The Range will need to be towed from 10th Avenue Marine Terminal to US Navy Point Loma pier after discharge.

COMMENCING/ CANCELING: Two-day window, SSHEX, to be proposed by the offerors consistent with the ALD in Box 3 and such that the LAD in Box 5 is achieved.

7. TERMS/CONDITIONS/ATTACHMENT ADDED, DELETED OR MODIFIED:

C. CALL OUT MSC DRYVOY SECTION V, AS FOLLOWS:

i. Part V(a) Position Reports

ii. Part V(q) Liner terms and add the following-

a) All cargo and transport operation shall be in accordance with the U.S. Navy Tow Manual Chapter 8 (Heavylift Transport), and as approved by the Independent Marine Surveyor.

b) Contractor shall provide two points of access (port and starboard, forward or aft) for the range boat once stowed.

c) Fire Hose shall be laid out and fully available to Cargo while onboard the transit vessel.

D. Replace Part V(d) Deviation for Bunkers: Vessel shall present NOR fully bunkered for the intended voyage and no deviations for bunkers is allowed.

E. SPECIAL REQUIREMENTS:

(1) Independent Marine Surveyor (IMS).

a. Contractor shall hire a qualified independent marine surveyor (IMS) for the cargo load, transport, and offload (as required) at contractor’s expense to ensure the transport manual is prepared IAW the navy tow manual chapter 8-3.3.1 and to certify the seaworthiness of the lift to include the cradle.

b. The costs of an independent marine surveyor, selected by the contractor as mutually agreed by the charterer, shall be for the contractor’s account. Technical disputes upon loading or discharging (not including modifications to the charter) are to be resolved primarily at the discretion of the independent marine surveyor and with the consent of the contractor and the MSC on-site representative, with recourse to the contracting officer, only if agreement on-site is not possible.

c. Provide detailed marine survey reports for load and offload operations.

(2) Pre-load Meeting: There will be a pre-load meeting in Naha prior to load, time and location to be mutually agreed. Owner rep and IMS must attend.

(3) Pre-discharge Meeting: There will be a pre-discharge meeting in San Diego prior to discharge, time and location to be mutually agreed. Owner rep and IMS must attend.

F. Reporting Requirements

(1) Owner shall provide the MSC Area Commander with any report required under U.S.

Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.

(2) Health and Safety Plan: Owner shall provide in its proposal its company’s health and safety plans for its crew related to the novel coronavirus for this mission. While not evaluated, upon award, this plan shall become contractually binding on the owner.

(3) Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above or was otherwise reasonably preventable by following U.S Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.

(4) The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.

(5) Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the Owner and not the Charterer.

ADD: Owner agrees as a condition of this contract that the vessel will not proceed to Gibraltar for any purpose for its next port call after departing a Spanish port, even if the vessel is off-hire or if the charter has concluded and the ship was redelivered to the owner in Spain. Owner also agrees as a condition of this contract that the vessel will not proceed to Spain for any purpose for its next port call after departing Gibraltar, even if the vessel is off-hire or if the charter has concluded and the ship was redelivered to the owner in Gibraltar.

ADD: Identify those ports in which they have any active arrest warrants or similar actions pending that would either delay the vessel from performing, or otherwise prevent the vessel from free entry/departure.

AMEND PART IV(h)(1), the last and penultimate sentences to read as follows:

In the event of the existence of said risks, the Charterer shall, to the extent provided in this paragraph (h), assume provable additional costs of wages (including all additional bonuses and payments required) and insurance and all taxes associated therewith properly incurred by the Owner as a consequence of service under this Charter Party, except that no additional costs for wages or insurance shall be payable by Charterer if such additional costs were known or should have been known by Owner at the time that Final Proposal Changes were due, or in the case of awarding off initial offers, when initial offers were due. In such a case, paragraphs (2), (3) and (4) of this Article (h) shall not be applicable.

AMEND PART IV(w) ECMRA: Amend “https://doncmra.nmci.navy.mil” to read https://www.ecmra.mil.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
