This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items.
MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for one vessel capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available MSC web site at https://www.msc.navy/mil, under “Contracts,” then “Proforma” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.
Note:
1. As outlined in relevant Parts V and VIII below, submission of an offer requires the submission of relevant shipyard data information for all Jones Act vessels owned or controlled by the offeror. Please make sure to use the Excel spreadsheet provided for data submission and follow the format of the sample. Enter only data for shipyard work completed for the current year and four preceding years; there is no need to annotate “None.”

B. I. DRYVOY BOXES:
1. Vessel Required:
One, U.S. Flag, Jones Act vessel, with a minimum capacity of 125 ammunition TEUs.
“Vessel” includes both vessel and ABS certified tug/barge unit. Vessel must not exceed a maximum overall length of 700 feet / 213.4 m and a laden draft of 29.5 feet / 8.9 m.
2. Cargo Description: 20 Foot ISO shipping containers. Average container weight of 30,000 lbs and max container weight is 41,000 lbs.
Hazardous Material:
- The Net Explosive Weight is estimated at 273,540 pounds.
- Hazard Classes/Divisions 1.1D – 1.4S

Special requirements:
A. Reporting Requirements
(1) Owner shall provide the MSC Area Commander with any report required under U.S.
Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.
(2) Health and Safety Plan: Owner shall provide in its proposal its company’s health and safety plans for its crew related to the novel coronavirus for this mission. While not evaluated, upon award, this plan shall become contractually binding on the owner.
(3) Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of paragraph A(2) above or was otherwise reasonably preventable by following U.S Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.
(4) The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
(5) Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the Owner and not the Charterer.
B. Lashing Gear: Vessel must be fully outfitted with container deck fittings, semi-automatic twist locks, stackers, rods, turnbuckles, lashing gear, dunnage, and shifting boards in sufficient quantity to safely stow and secure cargo.
C. Certificates: Provide most recent and complete copies (with endorsements) of the following documents:
(1) Company Document of Compliance
(2) Vessel Safety Management Certificate
(3) Vessel International Ship Security Certificate as applicable
(4) Vessel/Barge Certificate of Inspection (COI) as applicable.
(5) Document of Compliance for the Carriage of Dangerous Goods Certificate as applicable.
D. Stow Plan: Provide detailed stow plan using the provided cargo list showing the vessel’s ability to support the requirement. If cargo stowage variances are required, proof of capability (Letter of Variance) must be provided.
E. Itinerary: Provide complete mission itinerary F. Forklift: A container handling forklift (provided by the contractor) shall be onboard the vessel. The container handling forklift will position containers on the vessel during upload and discharge operations. Forklift shall be in good working order and have backfire deflectors and a fire extinguisher as stated in DA PAM 385-64, paragraph 10-3.
G. Segregation: Contractor shall ensure segregation of all loaded munitions containers aboard the vessel in strict conformance with all applicable regulations concerning the safe and proper loading and stowage of Arms, Ammunition, and Explosives (AA&E).
Segregation of all commodities within the containers is the responsibility of the shipper.
ADD: Owner agrees as a condition of this contract that the vessel will not proceed to Gibraltar for any purpose for its next port call after departing a Spanish port, even if the vessel is off-hire or if the charter has concluded and the ship was redelivered to the owner in Spain. Owner also agrees as a condition of this contract that the vessel will not proceed to Spain for any purpose for its next port call after departing Gibraltar, even if the vessel is off-hire or if the charter has concluded and the ship was redelivered to the owner in Gibraltar.
ADD: Identify those ports in which they have any active arrest warrants or similar actions pending that would either delay the vessel from performing, or otherwise prevent the vessel from free entry/departure.
PART IV(h)(1): Amend the last and penultimate sentences to read:
In the event of the existence of said risks, the charterer shall, to the extent provided in this paragraph (h), assume provable additional costs of wages (including all additional bonuses and payments required) and insurance and all taxes associated therewith properly incurred by the owner as a consequence of service under this charter party, except that no additional costs for wages or insurance shall be payable by charterer if such additional costs were known or should have been known by owner at the time that final proposal changes were due, or in the case of awarding off initial offers, when initial offers were due. In such a case, paragraphs (2), (3) and (4) of this article (h) shall not be applicable.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
