A. PART I - DRYTIME BOXES:

1. Vessel Required:

A. U.S. or foreign flag, self-sustaining vessel(s) (multiple awards up to four vessels) capable of carrying a portion of the 467,531 square feet requirement which consists of military cargo (wheeled vehicles, tracked vehicles, containers and breakbulk) described below.

B. Each vessel shall have a minimum capacity (measured in square feet) of 85,000 square feet of cargo from the cargo list.

C. Minimum laden speed shall be 15 knots while laden.

53 days for each vessel chartered

5. Laydays:

Commencing/Cancelling: 22, 24, and 26 October 2020. Offerors to offer for dates available.

Where a successful offeror offers more than one layday, the Government will select the layday upon award.

Special requirements:

A. Reporting Requirements

1. Owner shall provide the MSC Area Commander with any report required under U.S.

Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.

2. Health and Safety Plan: Owner shall provide in its proposal its company’s health and safety plans for its crew related to the novel coronavirus for this mission. While not evaluated, upon award, this plan shall become contractually binding on the owner.

3. Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above or was otherwise reasonably preventable by following U.S Coast Guard or Center for Disease

Control COVID-19 guidelines in publication at the time of breach.

4. The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.

5. Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the

Owner and not the Charterer.

B. Lashing Gear: Vessel must be fully outfitted with container deck fittings, semi-automatic twist locks, stackers, rods, turnbuckles, lashing gear, dunnage, and shifting boards in sufficient quantity to safely stow and secure cargo.

C. Spreader Bar. RO-RO/LO-LO or LO/LO vessels must be equipped with a spreader bar(s) capable of lifting 40-foot and 20-foot containers, weight tested to 45,000 lbs. per crane.

D. Certificates: Provide most recent and complete copies (with endorsements) of the following documents:

a. Company Document of Compliance

b. Vessel Safety Management Certificate

c. Vessel International Ship Security Certificate

d. Vessel Certificate of Inspection (COI)

E. Stow Plan: Provide detailed stow plan, including vessel trim and stability values resulting from the proposed stow plan, using the provided cargo list showing the vessel’s ability to support the requirement. Stow plans may be cross-checked in ICODES for feasibility - to include square footage, weight, trim, and stability issues.

F. Fully Bunkered: Vessels shall be delivered fully bunkered.

G. Supercargo. Pursuant to PART VI(k), a minimum of 2 supercargo is required for each vessel.

H. Self-Sustaining: A contractor-provided mobile crane on vessel can equate to being self-sustaining. Offer must provide specification of self-sustaining equipment intended for use for this contract.

NOTE: Boxes 1A, 1B, 1C, 6A.2, 6B, 6C, 6D, 6E, and 6H must be addressed in sufficient detail to demonstrate compliance, and Items 2, 3, 4, 5, 6A.1, 6A.3, 6A.4, 6A.5, 6F, and 6G must be acknowledged.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

PART X(h) Multiple Awards: Add the following fourth sentence to read: Each vessel awarded shall have a stand-alone contract.

AMEND PART XI(a); first sentence to read: “The Government will award up to four contracts resulting from this solicitation to the responsible offerors (See Note (1) below) whose technically acceptable proposal with acceptable past performance represents the lowest price to the

Government.

AMEND PART XI(e)(a) to read, “The offeror’s price proposal will be evaluated based on the value of the charter hire rates offered for the entire charter period of (a) 53 days, price for fuel, and any other costs set forth in the offer. For evaluation purposes the period of performance will consist of (b) 53 days. Fuel calculations will be based upon (c) 37 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME

Boxes 68 and 70; (d) 1 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 69 and 70; and (e) 15 days in port idle, using the fuel consumption provided in DRYTIME Box 71. The evaluated price will be per vessel offered and will be computed based upon the above costs set forth in the offer, divided by the percentage of the cargo packing list (per vessel) in square feet that can be carried, to formulate a

“per percentage, by square feet, of the packing list” rate. Award will be made, if at all, for up to four vessels with the lowest “per percentage, by square feet, of packing list rate” that collectively can carry 100% of the packing list, or until the Government’s needs have been met, and being technically acceptable with acceptable past performance. The proposed prices must be determined to be fair and reasonable. This will represent the overall price to the government

Where a successful offeror offers more than one layday, the Government will select the layday upon award.”
