Q – Is any additional guidance available regarding foreign test center employee requirements?
Contractors with access to government facilities or SBU (sensitive but unclassified) information are subject to background investigations, but can the U.S. government perform background investigations on foreign nationals?
IRS’s response to Question #39
A - “Contractor personnel employed anywhere in the world must be citizens or legal permanent residents of the United States and must successfully pass a government background check before being assigned to work on the contract awarded pursuant to this solicitation. There will be no exceptions.”
IRS Clarification
The citizenship requirement for contractor personnel is not a new requirement. Test center administrators have access to candidates’ names, which is sensitive but unclassified information. We strongly encourage the offerors to carefully review IRM 10.23.2 in its entirety.
This IRM addresses all personnel security requirements of the contract in detail, including the citizenship requirements and whether/not they apply to the offerors’ subcontractors (partners).
IRM 10.23.2.1 states that all requirements of the IRM apply equally to the offerors’ subcontractors. Subcontractor is defined as any entity whose services the offeror will use in the fulfillment of their contractual obligations.
