(viii) FAR 52.212-1 Instructions to Offerors—Commercial Items (JAN 2017)

Each Offeror shall submit an offer that clearly and concisely describes and defines the Offeror’s response to the requirements contained in the RFQ and Statement of Work (SOW). By your submission, you are representing that your firm will perform all the requirements specified in the solicitation. It is not necessary or desirable for you to tell us so in your offer. It is necessary, however, to describe how you will accomplish/satisfy the requirements and specifically how that capability will be used for this effort.

Use of general or vague statements such as “standard procedures will be used”, “noted”, “good engineering practices”, or “contractor will comply” will not satisfy this requirement.

Simply repeating or paraphrasing the RFQ requirements without substantive, meaningful discussion will not be acceptable. Unnecessary elaboration or presentation beyond that which is sufficient to present a complete and effective proposal is not desired and may be construed as an indication of the Offeror’s lack of understanding or cost consciousness.

Offerors shall submit the following:

FACTOR I - TECHNICAL (15 PAGE LIMIT):

A. Technical Capability: At a minimum, Offeror shall propose an approach to meet the requirements set forth in the Statement of Work (SOW), Attachment A. Technical approach shall include in-depth information on the functions and capabilities of the proposed equipment as well as methodologies, technologies, and/or techniques that will be applied in successfully meeting the Government requirement. The proposed solution may include

4 2031ZA18Q00474 Bureau of Engraving and Printing specifications and drawings. Offerors shall also address training, warranties, delivery schedule, and preventative maintenance. Warranty shall address what phone tech hours are available and whether spare parts are available locally, nationally or overseas, and average downtime of maintenance calls received. Warranty shall also describe what is and what is not covered. Offerors shall also provide a list of spare parts that the BEP should maintain an inventory of. Product literature and brochures may be submitted, but shall not be the only documents provided for addressing technical. Failure to provide full specifications may result in the Offer being deemed unacceptable.

B. Sample Marking Requirement: In addition to the minimum requirements, Offerors will be provided with sample pieces of substrate to burn images of alphanumeric lettering along with required bar code info. A barcode will be provided for scanning and uploading the data into the laser for marking.

• Offerors can use as much surface area as needed on the sample pieces.

• Offerors shall return the samples and the document the amount of time in seconds it took to complete each marking written in indelible ink on the sample piece to BEP for evaluation. Sample must be received by no later than the solicitation closing date and time.

FACTOR II – PAST PERFORMANCE (4 PAGE LIMIT): No cost/price information is to be included with this section. Past Performance information shall include a list of no more than two (2) contracts or subcontracts. Offerors should reference their most recent and relevant projects for consideration for past performance. Recent is defined within the last 10 years.

Relevant is defined as work similar in size, scope, and complexity to the work identified in the SOW. Past performance may be Commercial, Federal, State, Local, or Foreign contracts that demonstrate recent and relevant experience. Offerors shall provide the following information for each reference:

a. Name of Customer

b. Contract Number or other identification number

c. Contract Type

d. Total Contract Value

e. Contract Period of Performance

f. Description of product provided and related services performed in support of the Contract.

Include as much detail as need to demonstrate the contract being similar scope as described in the solicitation.

g. Point of Contact with correct/current telephone number

The BEP may contact references. Therefore, Offeror shall ensure that all contact information is correct and current.

FACTOR III - PRICE (no page limitations): Offeror shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and services necessary to provide and install a new plate marking laser. Offeror shall submit a firm fixed

5 2031ZA18Q00474 Bureau of Engraving and Printing price for equipment, software, installation, training, travel, and annual preventative maintenance.

Offeror shall provide a full break down of all cost.

(ix) FAR 52.212-2 Evaluation—Commercial Items (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

FACTOR I – TECHNICAL

A. Technical Capability: The Government will evaluate technical capability for acceptability.

Offerors will be evaluated on the ability to fulfill the contract requirements based on:

• The Offeror’s demonstrated understanding of, and ability to oversee, meet and carry out, the objectives, scope, tasks and all other requirements as found on the SOW and to perform at a level that meets the BEP’s requirements per specifications.

• The proposal will be evaluated to determine whether the Offeror’s methods and approach to meeting the solicitation requirements provide the Government with a high level of confidence of successful completion within the required delivery schedule.

B. Sample Marking Requirement: The returned samples will be evaluated under (7x’s) magnification with a loupe subjectively and up to (150x’s magnification) with the Optical Gaging Products (OGP) SmartScope for the following factors:

• Clean sharp square edges. Residual slag or burrs will result in lower ratings. This will be evaluated subjectively by eye but also by taking a profile scan with the BEP’s OGP SmartScope.

• The amount of time needed to complete the image in each substrate will also be evaluated.

• Image quality will be determined by BEP’s hand held scanners (Motorola Model DS6707) ability to read the image with repeatability and after no more than three (3) attempts.

An evaluation rating of ACCEPTABLE or UNACCEPTABLE will be assigned upon completion of the evaluation. If the Offeror receives a report rating of “Unacceptable,” the Offeror will not be considered for award.

FACTOR II – PAST PERFORMANCE: The Government will assess the Offeror’s capability to perform under this contract by evaluating the Offeror’s past performance experience on previous same or similar contracts. The BEP may contact any references provided by the Offeror during the evaluation process to verify recent and relevant experience and the level of performance. The BEP may, at its discretion, obtain and evaluate information from sources other than those provided by the Offeror, such as those found in the Past Performance Information Retrieval System (PPIRS).

6 2031ZA18Q00474 Bureau of Engraving and Printing

In conducting a past performance evaluation assessment, the offeror will be assigned one of the ratings below:

An evaluation rating of ACCEPTABLE, UNACCEPTABLE, or NEUTRAL will be assigned upon completion the evaluation. If the Offeror receives a report rating of “Unacceptable,” the Offeror will not be considered for award.

FACTOR III – PRICE: The Government will evaluate price to determine fair and reasonableness. As such, the Government will use any combination of the proposal analysis techniques stipulated under FAR Subpart 13.106-3 to aid in the price evaluation process.

BASIS FOR AWARD: Award will be made on the basis of the lowest evaluated price of offers meeting or exceeding the acceptability standards for non-cost (i.e., Technical and Past Performance) factors. A proposal is technically acceptable if it is fully compliant with all of the requirements of terms and conditions herein. The Government will not award a contract on the basis of an unacceptable offer. Offeror’s proposed prices shall be evaluated to determine fair and reasonable pricing.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision)

(x) FAR 52.212-3, Offeror Representation and Certifications-Commercial Item (NOV 2017) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal. (1) □ Are, □ are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) □ Have, □ have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property;

(3) □ Are, □ are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) □ Have, □ have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).

(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126).
