Services LLC on 20 February 2024. The GAO is required to make a decision on the protest by 30 May 2024. An extension to the contract with HDSS is necessary to continue performance through the protest period. This is the second post-award GAO protest for this requirement. The GAO dismissed the previous protest in December 2023 as academic and the government took corrective action by conducting a new past performance evaluation and new award decision.

2) Contract W9124B-24-C-0002 was awarded to Akima Intra-Data LLC on 9 February 2024, and subsequently received the GAO protest on 20 February 2024.

The period of performance on the existing bridge contract W9124B-22-C-0003 will end on 10 March 2024. There are no extensions remaining on the contract. GAO requires 100 days from 20 February 2024 to render a decision on the protest.

If the government conducted full and open competition for this requirement, it would take 220 days to solicit, conduct source selection, and award a new contract.

b. Alternatives:

1) Suspension of Contract Support. The DES services are ongoing and critical to mission accomplishment. Suspension of contract support will cause critical disruption to the Fort Irwin Garrison and poses significant life, health, and safety issues, negatively affecting the soldiers’ deployment readiness, quality of life, and introduces an unacceptable risk of mission failure. Therefore, this alternative is not viable.

2) Use of In-House Resources. The Fort Irwin Garrison lacks sufficient manpower, technical expertise, and resources to perform the required DES requirement. The United States Army does not contemplate acquiring adequately trained personnel within the Government in the near future. Attempting to initiate actions to increase the Government workforce to accomplish this mission would take years and result in mission failure during the time required to adequately recruit and staff a trained workforce. Therefore, this alternative is not viable.

3) Extension of the current contract. Negotiating a contract with the incumbent is the only viable solution to provide continuity of operations and technical support without jeopardizing the Fort Irwin Garrison ongoing mission and ensuring there will be no degradation of services in this highly technical requirement. Award to any other source would result in a delay in fulfilling the agency’s requirements and would not be in the best interest of the Government.
