SECTION C PERFORMANCE WORK STATEMENT

SECTION 2 – GENERAL

2.01 INTRODUCTION

This project consist of providing all materials, equipment, labor, transportation, and incidentals for the sewer line upgrade of the Bradshaw District Office located at 344 S. Cortez Street. The work includes, but is not limited to, location and marking of all utilities, concrete and asphalt cutting, excavation and shoring, removal and replacement of the existing sewer line(s), covering and compaction of the replaced sewer line and patch work to the asphalt/concrete. The building is located two blocks south of the

Courthouse Square on the west side of Cortez Street in Prescott, AZ 86303. The sewer line is located on the south end of the building and runs along the building in the vegetation bedding.

2.02 BACKGROUND

The Bradshaw main office is approximately 10,944 square feet and was constructed in 1956. There are three restrooms upstairs that have a total number of 1 drinking fountain, 6 toilets, 2 urinals, and 5 sinks.

The downstairs has a total number of 1 drinking fountain, 2 toilets, 3 sinks, 1 urinal and one shower. The building has service connections to electricity (APS), water (City of Prescott), telecommunications

(AT&T) and sewer (City of Prescott).

2.03 PROJECT LOCATION

This project is at the Bradshaw District Office located at 344 S. Cortez Street. The building is located two blocks south of the Courthouse Square on the west side of Cortez Street in Prescott, AZ 86303. The sewer line is located on the south end of the building and runs along the building in the vegetation bedding. The optional bid item is located in the enclosed parking lot on the west side of the building.

2.04 PROJECT REQUIREMENTS

A. Base Bid Items: Is to update the existing clay sewer pipes that connect the upstairs portion of the building to the City of Prescott’s sewer line with new Schedule 40 PVC DWV sewer pipe.

The existing clay pipe is to be located and marked, excavated, replace approximately 15 linear feet at an approximate depth of 7 feet, removing the existing pipe from Forest Service property and properly disposing of it, install directional clean-out, installing new sewer backflow prevention valve with a deep bury kit, ensuring proper downhill slope, pressure testing for leak and backfilling with suitable soil. Concrete and asphalt maybe required to be cut prior to excavation. All City of Prescott, county of Yavapai and state of Arizona codes shall be strictly followed, required permits obtained and inspections performed.

B. Optional Bid Items: Is to update the existing sewer pipes that connect the downstairs portion of the building to the City of Prescott’s sewer line with new Schedule 40 PVC DWV sewer pipe. The existing clay pipe is to be located and marked, excavated, replace approximately 75 linear feet at an approximate depth of 1.5 feet, removing the existing pipe from Forest Service property and properly disposing of it, install directional clean-out, installing new sewer backflow prevention valve with a deep bury kit, ensuring proper downhill slope, pressure testing for leak and backfilling with suitable soil. Concrete and asphalt maybe required to be cut prior to excavation. All City of Prescott, county of Yavapai and state of Arizona codes shall be strictly followed, required permits obtained and inspections performed.

2.05 GENERAL SITE CONDITIONS, FACILITIES AND TEMPORARY CONTROLS

A. This site is located within the municipality of Prescott and is easily accessed via paved surface roads.

B. Contracting Officer’s Representative (COR) - The COR is a Forest Service official designated by the Contracting Officer to perform day-to-day contract administration, including site inspections for quality assurance.

C. A site can be made available to the Contractor for staging and storage during the duration of the project and will be located by the COR at the beginning of work. Any damage resulting from the Contractor’s use of this site will be repaired or replace at the Contractor’s expense at the direction of the COR.

D. Potable water will be available along with cell phone capability. All temporary services and use areas shall be completely removed and the use areas shall be restored upon completion of use.

E. Transportation to and from the work site for the Contractor's personnel and materials will be provided at the Contractor's expense.

F. The Contractor shall take reasonable measure to secure equipment and contract work against theft and vandalism. The Forest Service is not responsible for the theft and/or vandalism of any materials or equipment left at the project site.

G. The work zones shall be delineated and marked adequately warn visitors, government contractors and all government employees of equipment operations and other hazardous conditions. The Contractor is responsible for providing barrier materials and maintaining barriers such as temporary barricades, barrier tape, curbs, etc. at all work zones. The Contractor shall remove all temporary facilities and restore the site to its prior condition as a part of the project closeout procedures. Any damage to existing improvements shall be repaired at the

Contractor’s expense according to the direction of the COR.

H. No Government furnished supplies will be provided.

2.06 USE OF PREMISES

A. Contractor shall have limited use of buildings indicated. Contractor's use of premises is limited only by the Government's right to perform work or to retain other contractors on portions of Project and as follows:

B. The Government will not occupy premises during construction; although other contractors will be performing other construction on, in and on the surrounding areas of the building.

C. Due to neighboring residential areas, perform construction during normal waking hours from

7:00am to 6:00pm Monday through Friday and 8:00 a.m. to 5:00 p.m. on Saturday and Sunday.

D. Driveways, Walkways, and Entrances: Keep driveways, walkways and entrances serving premises clear and available to emergency vehicles and pedestrians. Do not use these areas for parking or storage of materials, unless approved by the COR.

E. Smoking is not permitted within the building, or within 25 feet of any entrance.

F. Confine storage of materials to areas as approved by the COR.

G. Contractor shall provide adequate signing and barricades and take necessary safety measures to protect the public during all construction operations. Contractor shall minimize disturbance of all undisturbed areas.

2.07 CONSTRUCTION SCHEDULE

A. Work shall begin as soon as possible after the notice to proceed is given by the Contracting

Officer.

B. Contractor shall give the COR 24 hours notice prior to beginning work.

2.08 PROVISIONS FOR SAFETY AND PUBLIC ACCESS

A. When excavating for line removal and replacement, contractor shall abide by the city of

Prescott road construction code compliance, proper depth of sewer line and trenching widths.

B. Contractor shall also abide by OSHA’s safety and construction guidelines on trenching and shoring.

C. Contractor shall provide appropriate measures for any temporary street closures, pedestrian safety and traffic controls when excavating and trenching for line replacement and connection to city’s main sewer line.

D. Contractor will assure that no trenching will be left open overnight but instead take any and all necessary measures to cover any open areas for safety reasons.

E. Contractor shall remove and properly dispose of existing clay sewer pipe.

2.09 PROVISIONS FOR PROTECTION OF NATRUAL RESOURCE

A. Confines all operations to work limits of the project. Prevent damage to natural surroundings.

Restore damaged areas, repairing or replacing damaged trees and plants, at no additional expense to the Government.

B. Provide temporary barriers to protect existing trees and plants and root zones.

C. Do not remove, injure, or destroy trees or other plants without prior approval. Consult with

COR and remove agreed-on roots and branches that interfere with construction.

D. Do not fasten ropes, cables, or guys to existing trees.

E. Carefully supervise excavating, grading, filling, and other construction operations near trees to prevent damage.

2.10 CONSTRUCTION FACILITIES

A. Controls – Project site is located within city limits. Emphasis will be placed on the safety of the public and Contractor personnel and on protecting the Contractor’s work.

B. Security – the Contractor shall take reasonable measures to secure equipment and contract work against theft and vandalism. The Forest Service is not responsible for theft and vandalism.

C. Work zone barriers –Work zones shall be delineated and marked to adequately warn visitors from operating equipment and hazardous conditions. The Contractor is responsible for providing barrier materials and maintaining barriers such as temporary barricades, barrier tape, curbs, etc., at work zones.

D. Work limits – ground disturbance and equipment shall be confined to the minimal area in each area of work. The Contractor is responsible for establishing the work limits and marking or otherwise communicating the limits to Contractor personnel.

E. Fire protection – refer to contract Fire Plan requirements that determine Contractor responsibility for measures and equipment to prevent fires, work restrictions during fire danger, and assistance to be rendered in case of fire.

F. Equipment Washout – there will be no equipment washout onsite.

G. Clean up – the Contractor shall remove all temporary facilities and restore prior conditions as part of project closeout. Any damage to existing improvements shall be repaired at the

Contractor’s expense. Any disturbance to soil and vegetation outside of work limits caused by the Contractor shall be restored or mitigated according to direction from the COR.

SECTION 3 – MOBILIZATION

3.01 SUMMARY

A. This work shall consist of preparatory work and operations necessary for the movement of personnel, equipment, supplies, and incidentals to and from the project site, and for all other work and operations that must be performed or that cause costs to be incurred prior to beginning work on the various items on the project site.

3.02 PROGRESS PAYMENTS

A. Progress Payments will be made as follows:

1. When 5 percent or more of the original contract amount is earned from other pay items, 50 percent of the amount for mobilization, or 5 percent of the original contract amount, whichever is less, will be paid.

2. When 10 percent or more of the original contract amount is earned from other pay items, 100 percent of the amount for mobilization, or 10 percent of the original contract amount, whichever is less, will be paid.

3. Upon completion of all work on the project, any unpaid amount for mobilization will be paid.

4. The total of all payments shall not exceed the original contract amount for this item.

3.03 BASIS OF PAYMENT

SECTION 4 - SPECIFIC PROJECT REQUIREMENTS

4.01 SEWER SERVICE LINE REPLACEMENT

The purpose of this project is to eliminate an aging infrastructure. The project scope includes:

A. Replacement of an existing 4” clay sewer pipe line to be replaced with a new Sch 40 PVC

DWV sewer pipe line. Sewer line to be connected to the city’s street main sewer line on

Aubrey Street. Project location is the Prescott National Forest building located at: 344 S

Cortez St., Prescott, AZ 86303.

1. Replacement shall start from the Clean-out located on the South side of the building and connected to the city’s street main sewer line on Aubrey Street. Length of sewer service line replacement is Approximately 52 linear feet.

B. Proper fittings for new pipe line as per code.

C. Two directional clean-outs as shown on plan as per code.

D. One Back flow prevention valve with deep bury kit as per code.

E. Tracing wire as per code.

F. Permits & Blue Staking:

1. Before commencing any work to said project, contractor must make sure that all and any applicable city permits are provided. This includes but not limited to the R/W permit and the Sewer Line Repair permit provided by the city of Prescott. All required city inspections shall be coordinated with the city of Prescott.

2. Contractor to locate and mark existing city of Prescott Main sewer line and sewer service line connected to Prescott National Forest building. Blue stake city services must be involved.

G. Trenching:

1. Trenching will affect approximately 16 linear feet of curbing and 4 feet wide sidewalk that will need to be replaced. Trenching will affect 27 linear feet of existing asphalt parking area on side of building. Trenching will also affect city street curb and gutter and street asphalt paving to Main Sewer Line. All removed parking asphalt, street asphalt and street curb and gutter must be replaced according to code.

H. Safety:

1. When excavating for line removal and replacement, contractor shall abide by the city of

Prescott road construction code compliance, proper depth of sewer line and trenching widths.

2. Contractor shall also abide by OSHA’s safety and construction guidelines on trenching and shoring.

3. Contractor shall provide appropriate measures for any temporary street closures, pedestrian safety and traffic controls when excavating and trenching for line replacement and connection to city’s main sewer line.

4. Contractor will assure that no trenching will be left open overnight but instead take any and all necessary measures to cover any open areas for safety reasons.

5. Contractor shall remove and properly dispose of existing clay sewer pipe.

I. Sloping and backfill:

1. Contractor to verify proper slope on the newly installed sewer service line from building to the city’s Main Sewer Line.

2. Before backfilling and compacting trench with native dirt contractor shall test for leaks.

SECTION 5 - PROJECT ADMINISTRATION AND COORDINATION

5.01 ADMINISTRATION

A. Site Examination. Project site must be examined before submitting a construction cost budget.

B. Kick-off Meeting. Upon receipt of a written Notice to Proceed from the Prescott Forest

Service, contractor shall conduct a kick-off meeting with the Forest Service and the City of

Prescott to review the scope of the project, develop a project schedule, and confirm deliverables.

C. Multi-Agency Coordination. The Main Sewer Line pipeline to where the Sewer Service Line is being connected to is in a public street owned by the City of Prescott. There are existing public utilities in these streets. It is very important to coordinate with these entities before any trenching and construction can be started.

SECTION 6 – AS-BUILT PREPARATION

6.01 AS BUILTS

A. Upon receipt and acceptance of the field as-built construction drawings from the Prescott

Forest Service, contractor shall prepare final as-built drawings incorporating any changes that occurred during the construction and show true locations and connection of the sewer service line and other utilities affecting this project.

B. Contractor shall submit final as-builts to the Prescott Forest Service in AutoCad and PDF format.

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 60 days. The time stated for completion shall include final cleanup of the premises.

b) During the first Thirty (30) days of performance, the contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death or termination of employment. The Contractor shall notify the Contracting officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph © to the

Contracting Officer at least 15 days prior to making any permanent substitutions.

c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the

Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to select any approved changes of key personnel.

52.204-9 PERSONAL IDENTITY VERICATION OF CONTRACTOR

EMPLOYEES (JAN 2011)

(a) The contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 4620-002 series.

(b) Should the results of the PIV process require the exclusion of a contractor’s employee, the contracting officer will notify the contractor in writing.

(c) The contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.

(d) The responsibility of maintaining a sufficient workforce remains with the contractor.

Employees may be barred by the Government from performance of work should they be found ineligible or to have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.

(e) The contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system.

(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the Contracting Officer Representative (COR), unless otherwise specified in this contract. The Government will notify the contractor if there is a change in the PIV Sponsor, the office address, or the office hours for registration; however, it is the contractor’s responsibility to meet all aspects of paragraphs (c), (d), and (e).

51.204-7 System for Award Management (Oct 2018)

(a) Definitions. As used in this provision—

“Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts

(see subpart 32.11) for the same entity.

“Registered in the System for Award Management (SAM)” means that–

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into

SAM

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and

Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer

Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.

“Unique entity identifier” means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)

(1)An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the

Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the

Offeror is registered in the SAM.

(c)If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

(1) Company legal business name.

(2) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(3) Company physical street address, city, state, and Zip Code.t

(4) Company mailing address, city, state and Zip Code (if separate from physical).

(5) Company telephone number.

(6) Date the company was started.

(7) Number of employees at your location.

(8) Chief executive officer/key manager.

(9) Line of business (industry).

(10) Company headquarters name and address (reporting relationship within your entity).

(d) Processing t ime should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://ww.sam.gov for information on registration.

52.222-40 Notification Of Employee Rights Under the National Labor Relations Act. (Dec 2010)

(a) During the term of this contract, the Contractor shall post an employee notice, of such size and in such form, and containing such content as prescribed by the Secretary of Labor, in conspicuous places in and about its plants and offices where employees covered by the National Labor Relations Act engage in activities relating to the performance of the contract, including all places where notices to employees are customarily posted both physically and electronically, in the languages employees speak, in accordance with 29 CFR 471.2 (d) and (f).

(1) Physical posting of the employee notice shall be in conspicuous places in and about the Contractor’s plants and offices so that the notice is prominent and readily seen by employees who are covered by the

National Labor Relations Act and engage in activities related to the performance of the contract.

(2) If the Contractor customarily posts notices to employees electronically, then the Contractor shall also post the required notice electronically by displaying prominently, on any website that is maintained by the Contractor and is customarily used for notices to employees about terms and conditions of employment, a link to the Department of Labor’s website that contains the full text of the poster. The link to the Department’s website, as referenced in (b)(3) of this section, must read, “Important Notice about Employee Rights to Organize and Bargain Collectively with Their Employers.”

(b) This required employee notice, printed by the Department of Labor, may be—

(1) Obtained from the Division of Interpretations and Standards, Office of Labor-Management

Standards, U.S. Department of Labor, 200 Constitution Avenue, NW., Room N-5609, Washington, DC

20210, (202) 693-0123, or from any field office of the Office of Labor–Management Standards or

(2) Provided by the Federal contracting agency if requested;

(c) The required text of the employee notice referred to in this clause is located at Appendix A, Subpart

(d) The Contractor shall comply with all provisions of the employee notice and related rules, regulations, and orders of the Secretary of Labor.

(e) In the event that the Contractor does not comply with the requirements set forth in paragraphs (a) through (d) of this clause, this contract may be terminated or suspended in whole or in part, and the

Contractor may be suspended or debarred in accordance with 29 CFR 471.14 and subpart 9.4. Such other sanctions or remedies may be imposed as are provided by 29 CFR part 471, which implements

Executive Order 13496 or as otherwise provided by law.

(f) Subcontracts.

(1) The Contractor shall include the substance of this clause, including this paragraph (f), in every subcontract that exceeds $10,000 and will be performed wholly or partially in the United States, unless exempted by the rules, regulations, or orders of the Secretary of Labor issued pursuant to section 3 of

Executive Order 13496 of January 30, 2009, so that such provisions will be binding upon each subcontractor.

(2) The Contractor shall not procure supplies or services in a way designed to avoid the applicability of

Executive Order 13496 or this clause.

(3) The Contractor shall take such action with respect to any such subcontract as may be directed by the

Secretary of Labor as a means of enforcing such provisions, including the imposition of sanctions for noncompliance.

(4) However, if the Contractor becomes involved in litigation with a subcontractor, or is threatened with such involvement, as a result of such direction, the Contractor may request the United States, through the Secretary of Labor, to enter into such litigation to protect the interests of the United States.
