STATEMENT OF WORK

Title of Project: Method Development for free-base nicotine levels (FBNLs) in mainstream tobacco smoke

C.1 Background and Need

The Portland State University (PSU), Department of Chemistry has extensive experience with method development and research for free-base nicotine levels in tobacco smoke constituents. PSU’s Department of Chemistry research group has a 20-year-long history of work on a wide range of tobacco-related topics. Of particular interest has been the: a) physical chemistry governing the behavior of tobacco smoke constituents in mainstream and environmental tobacco smoke; and b) the analytical chemistry by which both major and minor smoke constituents can be determined. The goal of this project is to determine the nicotine dosing characteristics, the potential addiction in the amount of free‐base nicotine in cigarette smoke and its effects on the location, route, and speed of absorption in the body, and the sensory perception effects of the inhaled smoke. This project will answer critical gaps in the current knowledge related to the effect of free-base nicotine levels (FBNLs) in mainstream tobacco smoke and tobacco products and the measured amount of super-addictive "freebase" nicotine cigarettes deliver to the smoker.

C.2 Project Objective The purpose of the acquisition is to generate and develop solid-phase micro-extraction-based approach to determine free-base nicotine in trapped mainstream cigarette smoke constituents and tobacco and their effects related to the generation of free-base nicotine levels. This information will provide critical information to the tobacco community related to gaining an understanding of the levels of free‐base nicotine and its effects.

C.3 Scope of Work The scope of work is to provide recommendations regarding the finalization of an accurate and robust overall machine smoking plus analytical protocol for FBNLs in mainstream tobacco smoke. PSU’s Dept. of Chemistry team will carefully examine the current CDC method for determining free-base nicotine levels (FBNLs) in mainstream tobacco smoke samples collected by machine smoking. This examination will:

1) be informed by all relevant peer-reviewed and non-peer reviewed publications on the subject (including the now available industry documents);

2) consider all criticisms that have been directed at the CDC method and provide scientific input for any required rebuttal;

3) examine with particular care the effects of water or other matrix effects in tobacco smoke both as regards: a) confounding effects of water on the analytical determination of FBNLs, and b) the actual chemical effects of water on FBNLs;

4) conduct hypothesis-verifying analytical measurements of FBNLs in mainstream tobacco smoke samples obtained: a) at Portland State University, and b) from CDC.; and

5) provide recommendations regarding the finalization of an accurate and robust overall machine smoking plus analytical protocol for FBNLs in mainstream tobacco smoke.

C.4 Technical Requirements –

· Identify the particulate matter in various brands tobacco products with a wide range of FBLN concentrations.

· Determine whether differences exist in the hypothesis-verifying analytical measurements of FBNLs in mainstream tobacco smoke samples.

· Examine the specific effects of water, tar, and other particulate matter constituents in tobacco smoke as it relates to the accurate analytical determination and the actual chemical effects of water on FBNLs;

· Provide data on FBNL in tobacco smoke in selected products.

· Transfer any new methodologies to the CDC tobacco laboratory.

C.5 Reporting Schedule – A report outlining progress, determination and findings delivered will be sent to Dr. Cliff Watson at cow1@cdc.gov during the contract period and a final report within 30 days of completion.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
