Medical Services Scope of Work

NIOSH Pittsburgh

A. Statement of Work A. 1 Background

The contractor shall provide the medical services in the appropriate specialties for the National Institute of Occupational Safety and Health, Pittsburgh, PA, in accordance with the Statement of Work.

The National Institute of Occupational Safety and Health (NIOSH) provides physicals and medical surveillance programs to CDC/NIOSH Pittsburgh employees .

Medical services to be provided are physical exams for new employees who positions will require them to go into underground mines; audiograms with interpretation for employees in the Hearing Conservation Program; review of the OSHA Medical Questionnaire for employees in the Respiratory Protection Program and follow-up physicals as needed; eye examination for employees in the Laser Protection Program; Immunization Program for international travel; an annual on-site flu clinic; and onsite wellness clinics such as blood pressure screenings, body mass index, cholesterol levels, etc.

It is essential that the contractor administering the medical surveillance program for the NIOSH-Pittsburgh facility be located nearby to the facility (within approximately 10 miles).

The following objectives are established for the contractor to provide the minimum services:

- Employee physicals

- Testing

- Medical monitoring and surveillance

- Monitored care when appropriate

- Records and Data Management

- Other occupational medical services described herein

A. 2 Services required:

Any estimated quantity provided in this scope of work is not a guaranteed minimum, and is used solely for estimation purposes and as a determination as to the acceptability and reasonableness of the prices proposed by the offeror. The Government will make a determination as to the acceptability and reasonableness of the prices proposed by the offeror. Prices shall be fully burdened and inclusive of overhead, G&A, profit, etc. for the performance periods. Services include:

A.3 Description of Services

Physical Exam

An initial physical exams is provided for new or reassigned employees whose position description requires them to go underground into mines. This physical is comprised of the following: vision, height, weight, pulse, temperature, lab blood work (CMP12+LP+TP+TSH+6AC+CBC/D/P), chest x-ray, spirometry, audiogram, blood pressure, urine lab test, and EKG. All components of the physical are to be provided at one location. A copy of the employee’s position description will be provided along with an OF-178 Certificate of Medical Examination for the physician to complete. The charge per exam must include the administrative time of the physician to complete necessary paperwork, dictation, overhead, supplies, etc. The completed OF-178 will be returned to the NIOSH Pittsburgh Human Resources Office.

Hearing Conservation

Hearing Conservation (audiometric testing): Audiometric screening shall be performed as needed for workers in high-risk noise positions in accordance with 29 CFR, 1910.95. In addition, the contractor will provide medical follow up with anyone exhibiting standard threshold shift (STS).

Respirator Clearances

Conduct medical clearance for respirator use in accordance with 29 CFR 1910.134 and upon completion, will provide clearance decisions to the NIOSH Pittsburgh Respiratory Protection Program administrator. Pittsburgh operations may require respiratory protection against multiple contaminants in a broad variety of exposure situations, and that these requirements may not be predictable, each participant will generally need to be cleared for several types of respirators under varying levels of exertion and physical stressors. The contractor will provide clearance decisions that are specific to the types of respirators and usage conditions each participant may encounter. The contractor will also maintain a list of clearances in an electronic format that can be exported to Microsoft Excel for use in Respiratory Protection Program administration. This information will be provided as part of the monthly report. SCBA clearances will include same clearance requirements as other respirators plus a Pulmonary Function Test and possibly a stress test (to be determined by contractor based on health status and age of employee).

Laser Eye Exam

Provide eye exam for laser users in accordance with American National Standards Institute (ANSI) Z136.1, Safe Use of Lasers. Provide baseline eye examinations for laser users of class 3B and 4 laser systems in accordance with ANSI Z136.1-2000. Provide eye examinations in case of exposure.

The examination must include:

Visual Acuity

Amsler Grid Test Color Vision

Ocular Fundus (If any of the above exam results are abnormal)

Automated External Defibrillator (AED) Program

A review of the NIOSH AED program will be performed annually. Contractor provides physician oversight and Medical Direction of NIOSH's Public Access Defibrillation (PAD) program. The physician will review, approve, and sign off on NIOSH-Pittsburgh’s AED program policy and will conduct a yearly program audit to ensure the following:

· Event and Post Event Notification: The Contractor will provide a PAD report form to be completed by the AED user when any type of emergency care or treatment on a person in cardiac arrest is performed using an AED. Once notified, the physician will review data and commentary from the event and write a summary of the event, to include CPR compression and the function of the AED and potential changes that might need to be addressed in the emergency response procedure.

· Provide prescription for any new AED to be purchased.

Immunization Program

Administer necessary immunizations to employees identified by the Project Officer. The Contractor shall provide individual employees with records of immunizations documented in their chart as may be required for occupational health or international travel purposes, in accordance with the CDC/ATSDR Occupational Immunization Program. The Contractor shall also enter this data into an electronic records system. These immunizations may include, but are not limited to, the following licensed vaccines, toxoids, or globulins: tetanus-diphtheria toxoids, immune globulins, hepatitis-A vaccine, hepatitis-B vaccine, influenza vaccine, immune mumps and rubella vaccine, meningococcal vaccine, and poliomyelitis vaccine. Vaccines may be furnished by NIOSH when it is advantageous to the government.

The Immunization Program provides immunizations at no cost to employees who have potential occupational exposure to infectious agents. The Program provides immunizations to workers who may be at potential risk of exposure to the disease agents.

Influenza Clinic

Administer influenza vaccine annually to the NIOSH Pittsburgh workforce. The influenza immunization campaign shall be conducted at the NIOSH Pittsburgh facility. The Contractor and Project Officer will review historical data regarding the number of persons who received the vaccine in the prior year and any employee population increase to determine the number of vaccinations to plan for each year. Influenza immunizations are offered annually to all employees by the contractor with three half-day flu clinics held onsite at the NIOSH Pittsburgh facility in October. Additional influenza vaccines may be administered at the contractor’s office.

B.1 Technical Requirements

Operations – Provide personnel and medical supplies to support operations that include the following services:

· Provide qualified medical personnel. The contractor’s workforce shall be board certified by their appropriate occupational health or medical discipline.

· Provide administrative oversight to manage personnel, pharmaceuticals, medical records, equipment and supplies.

· Conduct physical examinations, including: analysis of clinical results and patient interaction. Examinations will include: vital signs (height, weight, blood pressure, pulse, and respirations) as well as the actual physical exam and assessment performed by the physician.

· Provide respirator certifications as needed for job specific occupational exposure. Employees who may be exposed to hazardous atmospheres in the conduct of their work will require respirator clearance.

· Maintain appropriate corresponding medical inventories including a supply of vaccines in order to accomplished the requirements in the SOW.

· Provide employee medical record maintenance and administrative support for medical records of current and former employees in accordance with Federal, state, and local laws.

· Protect the privacy of employees and confidentiality and physical security of all employee medical records, and provide access to employee medical and behavioral health records, in a manner consistent with: 1) The Privacy Act as codified in 10 CFR 1008; 2) “Access to Exposure and Medical Records” as codified in 29 CFR 1910.1020 (OSHA Standard); and 3) The Health Insurance Portability and Accountability Act.

· Provide copies of medical records to other professional medical and behavioral health providers and third-party medical claims processor(s) as appropriate and in a manner consistent with all applicable laws and standards.

· Provide consultation services for occupational health issues for services provided by this contract.

· The contractor shall supply pharmaceuticals, and other controlled medical supplies, as appropriate, and required to accomplish the work under this contract.

· The contractor shall furnish the infrastructure, equipment, and supplies (consumable medical supplies and general office supplies, to include lab equipment, etc.) to enable the services described herein.

B.2 Reporting Schedule

- Monthly billing will include a detailed report of services rendered during the month by price, category, and patient. Billing statement must list all services rendered including physical exam, immunizations, questionnaires, and any other services provided. This will serve as the monthly report.

B.3 Special Considerations

-Privacy Act: The Contractor will be required to design, develop, or operate a system of records on individuals, to accomplish an agency function subject to the Privacy Act of 1974, Public Law 93-579, December 31, 1974 (5 U.S.C.552a) and applicable agency regulations. The system covered under this Act is Employee Medical File System Records – OPM/GOVT 10. Violation of the Act may involve the imposition of criminal penalties.

- Insurance Requirements: The contractor shall, at its own expense, provide and maintain during the entire performance of the contract, the types and kinds of minimum amounts of insurance required by law. Including but not limited to: Professional Medical Liability: $1,000,000. (See clause 52.237-7, Indemnification and Medical Liability Insurance). A copy of the insurance certificate(s) shall be required upon award of the contract.

-Licensure Requirements: The contractor shall, at its own expense, provide and maintain during the entire performance of the contract, the types and kinds of licensure and certifications appropriate to the medical specialties and to the state for the performance of this contract.

B.4 Government Furnished Property

- The Government will provide space for the contractor during influenza clinics and wellness clinics.

B.5 Deliverables–

Deliverables –

1) The contractor shall provide a monthly detailed report of all services rendered during the month by price, category, and patient. This is to be attached to the monthly billing statement in electronic format.

2) The contractor shall provide each employee who undergoes a physical:

1) a copy of all forms completed, test results, exam reports, etc.,

2) post-exam counseling only (no formal follow-up communication is expected/required),

3) an advisement letter explaining medically significant data with any abnormal findings,

4) Written (typed in English) recommendations for addressing these concerns.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its post acceptance rights --

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government’s convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor’s records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.

(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

52.228-5 -- Insurance -- Work on a Government Installation (Jan 1997)

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government’s interest shall not be effective --

(1) For such period as the laws of the State in which this contract is to be performed prescribe; or

(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors’ proofs of required insurance, and shall make copies available to the Contracting Officer upon request.

Online Representations and Certification Application (ORCA) (Dec 2005)

All potential Contractors are required to complete electronic annual representations and certifications at http://orca.bpn.gov in conjunction with registration in the Central Contractor Registration (CCR) database per FAR 4.1102 and FAR 4.1201. Certifications in ORCA are required prior to the submission of contract proposals.

(a) Contractors shall update the representations and certifications submitted to ORCA as necessary, but at least annually, to ensure they are kept current, accurate, and complete. All Contractors with current contracts shall notify the Contracting Officer in writing when changes are made to ORCA. The representations and certifications are effective until one year from date of submission or update to ORCA.

Contracting Officer

(a) The Contracting Officer is the only individual who can legally commit the Government to the expenditure of public funds. No person other than the Contracting Officer can make any changes to the terms, conditions, general provisions, or other stipulations of this contract.

(b) No information, other than that which may be contained in an authorized modification to this contract, duly issued by the Contracting Officer, which may be received from any person employed by the United States Government, or otherwise, shall be considered grounds for deviation from any stipulation of this contract.

Minimum Required Insurance (Jul 1999)

In accordance with FAR 52.228-5, Insurance, Work on a Government Installation, incorporated by reference in Section I, the Contractor shall furnish a certificate of insurance of the following types and minimum amounts which shall be obtained and maintained during the entire period of performance of this contract:

(a) Workman’s Compensation and Employees Liability Insurance - as specified by applicable statute, but not less than $100,000;

(b) General Liability Insurance - Bodily Injury Liability - $500,000 per occurrence;

(c) Automobile Liability Insurance - $200,000 per person, $500,000 per occurrence bodily injury; $20,000 per occurrence property damage.

NOTE: IF WORK UNDER THIS CONTRACT INCLUDES ASBESTOS ABATEMENT, THE INSURANCE COVERAGE CERTIFICATE SHALL INCLUDE A STATEMENT THAT CARRIER UNDERSTANDS THIS PROJECT INCLUDES ASBESTOS ABATEMENT WORK.

Security Clearance Requirements (Jul 1999)

(a) Definitions.

“Employees” means both contractor and subcontractor employees unless otherwise noted:

The phrase “CDC owned or leased facilities” includes ATSDR, NIOSH/PRC/Pittsburgh, Pa.; NIOSH/Morgantown, W.V.; NIOSH/SRC/Spokane, Wa.; NIOSH/Cincinnati, Ohio; NCHS/Research Triangle Park, N.C.; NCHS/Hyattsville, Md. NCID/Fort Collins, Colorado; NCID/Anchorage, Alaska, and NCID/San Juan, Puerto Rico.

(b) General

All contract employees who will be performing work under this contract on-site (i.e., in a CDC owned or leased facility) for a period exceeding 90 days in duration (45 days if employee is designated to work in Building 10, 15, or 17 at 1600 Clifton Road, Atlanta, GA, or at CDC’s Lawrenceville, GA facility) shall receive a favorable suitability determination prior to reporting to work at an on-site facility. Any contract employee(s) who cannot obtain a favorable suitability determination, will not be permitted to work at an on-site facility (see paragraph B below on temporary determinations.)

The Contractor shall be responsible for managing its workforce to ensure that sufficient contract employees who meet all suitability requirements are available to perform the duties required under the contract. New or replacement contract employees must have previously received a favorable suitability determination in sufficient time to perform work at an on-site facility under the contract. If it has been over one (1) year since a contract employee has worked in a position on a Federal contract for which a security clearance was required, a new National Agency Check and Inquiry (NACI) must be obtained.

(c) Temporary Determinations/Clearances

The Contracting Officer may, as appropriate, authorize and grant temporary suitability determinations to contract employees. However, the granting of a temporary determination shall not be considered as assurance that full clearance will follow. The granting of a temporary determination shall not prevent, preclude or bar the withdrawal or termination of any temporary determination. Prior to the Government's issuance of a temporary determination, the Contractor shall obtain and provide to the Contracting Officer a state-wide criminal records check for all on-site contract employees. The Contractor shall also obtain and provide to the Contracting Officer a state-wide motor vehicle violations check for any contract employee required to operate a motor vehicle as part of their duties under the contract at an on-site facility. All criminal record checks and motor vehicle violation checks shall cover a twelve (12) month period beginning twelve (12) months prior to the date of the contract award. Criminal record checks and motor vehicle violation checks may be obtained through local state, county or city law enforcement agencies at contract employee’s place of residence. Where state-wide criminal record and motor vehicle violation systems are not available, county-wide or city-wide checks may be substituted. All substitutions shall be certified by the law enforcement agency that a state-wide criminal record system is not available.

(d) Required Information for NACI Clearance:

Unless otherwise specified, the Contractor shall submit the completed forms specified below to the appropriate office as directed by the Contracting Officer not later then 5 calendar days from the effective date of the contract. Items (1) through (6) must be completed by contract employees who require access to on-site facilities in the performance of the contract. Additionally, the contractor shall furnish, on a monthly basis, item (7) (if the information requested in Item (7) is provided as part of the Contractor’s standard invoice, no additional submission is required). The Government will furnish the necessary forms to the Contractor.

(1) two (2) completed Forms FD-258, "FBI Fingerprint Charts"***

(2) one (1) completed Standard Form 85, "Questionnaire for Non-Sensitive Positions"

(3) one (1) completed "Declaration for Enrollment"

(4) one (1) resume or curriculum vitae or completed job application form

(5) one (1) copy of the state-wide criminal records check

(6) one (1) copy of the motor vehicle violations check (when applicable)

(7) a complete listing of all current Contractor and Subcontractor on-site employees by name, work location and employer.

The CDC, Human Resource Management Offices (HRMO) have the necessary equipment to complete fingerprint charts (FD-258). The Contractor may contact the Contracting Officer for arrangements regarding utilization of the HRMO fingerprinting equipment. The fingerprint charts may also be completed through a local state, county or city law enforcement agency at the employee's place of residence.

Using the required information specified above, a National Agency Check and Inquiry (NACI) will be processed by the CDC through the Office of Personnel Management and the Federal Bureau of Investigations (OPM/FBI) on each contract employee who will be performing duties on-site.

(d) Removal of Contractor Employees

The Contracting Officer may request the Contractor to immediately remove any contract employee from the on-site facility who has failed to receive a suitability determination and whose continued employment is deemed contrary to the public interest, inconsistent with the best interests of security, or is identified as a potential threat to the health, safety, security, general well being or operational mission of the on-site facility and its population. The Contracting Officer may also request the Contractor to immediately remove any contract employee from the on-site facility should it be determined that the individuals are being assigned to duty who have been disqualified for suitability reasons, or who are found to be unfit for performing duties during their tour(s) of duty. Contract employees who are requested to be removed from the on-site facility are required to leave the work site immediately.

The Contracting Officer will make all determinations regarding the removal of any contract employee from the on-site facility, except under certain conditions. When a Contracting Officer is not available, either during the day or after normal business hours, or in situations where a delay would not be in the best interest of the Government, or a potential threat to the health, safety, security, general well being or operational mission of the facility and its population, the Project Officer will have the authority to direct immediate removal of the contractor employee from the on-site facility. The Contracting Officer shall subsequently provide the official notification to the Contractor for removal of a contract employee from the CDC facility. When removal is directed due to a nonsuitability determination as a result of the NACI, no further information will be provided. If removal is directed for other reasons relating to specific conduct of the employee during performance of the work, the Contracting Officer’s official notification will provide information as to these reasons.

(e) Identification Badges/Cardkey Access:

(1) Identification Badges:

The Contractor shall require each contract employee who has been authorized unescorted access to an on-site facility, either through the temporary clearance process or the formal NACI process, to display an identification badge as required and furnished by the CDC. The Contractor shall submit to the Project Officer a completed Identification Badge Request Form (CDC Form 0.1137) for each contract employee who has been authorized unescorted access to an on-site facility. Contact the Project Officer for details on additional procedures, specific addresses and hours of business for issuance of Identification Badges for all other CDC locations.

(2) Cardkey Access:

Unescorted access to certain on-site facilities at CDC may only be gained through the use of a Cardkey. If a contract employee has been determined to need regular unescorted access to one of the Cardkey access designated areas, a Cardkey Request Form (CDC Form 0.834) must be completed and submitted to the Project Officer for written approval. Contact the Project Officer for details of procedures and specific addresses and hours of business for issuance of Cardkey Access.

(3) Return of Identification Badges/Cardkeys

The Contractor shall arrange for the return of any employee identification badges and/or cardkeys immediately upon their separation of the duties at the on-site facility. Contact the Project Officer for location of the depositories for the return of badges. Cardkeys shall be returned to the appropriate Physical Security Activity Office.

Smoke Free Environment (Jul 1999)

In compliance with Department of Health and Human Services (DHHS) regulations, all contractor personnel performing work within CDC/ATSDR facilities shall observe the CDC/ATSDR smoke-free working environment policy at all times. This policy prohibits smoking in all CDC/ATSDR buildings and in front of buildings which are open to the public. This policy is also applicable to contractor personnel who do not work full-time within CDC/ATSDR facilities, but are attending meetings within CDC/ATSDR facilities.

(a) Holidays

The Contractor shall observe the above holidays on the date observed by the Government. Observance of such days by Government personnel shall not “on‑its‑face” because for an additional period of performance, or entitlement of compensation except as set forth within the contract. Contractor employees performing duties within Government facilities are automatically relieved from duty by virtue of the fact that Government employees are dismissed early or given the day off, (with the exception of 24‑hour/day service requirements). No form of holiday or other premium compensation will be reimbursed; however, this does not preclude reimbursement for authorized overtime work.
