Attachment 2 U.S. Customs and Border Protection
Sole Source Determination For actions above the micro-purchase threshold but not exceeding the SAT
Version 1.0 September 2016
Date: 8/16/2019 PR Number: 20113842
1. Nature and/or description of the item/service being procured and anticipated cost:
The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP), Office of Field Operations (OFO), Buffalo Field Office (BFO), Area Port of Champlain, NY proposes to enter into a Purchase Order on a basis of other than full and open competition.
The BFO, Area Port of Champlain is requesting to establish an order with NCC Systems for an Access Control System. Primary focus is for the contract vendor to provide and install Genetec hardware to replace and update the current outdated system.
2. Sole Source Determination Rationale in accordance with FAR 13.106-1(b)(1)(i) and (ii).
(Check one and explain below):
_________ Only one source reasonably available.
____ _____ Urgent and compelling circumstances exists.
_________ Exclusive licensing agreement exists.
_________ Brand name. If the brand name requirement applies to a portion of the procurement, please identify that portion.
_________ Industrial Mobilization ______X___ Other. Explain:
The Area Port of Champlain, NY is located in a rural area of upstate New York. The availability of vendors that can meet the requirements listed in the SOW are very limited as demonstrated in FY 18. The few vendors that were identified may have be able to meet our needs, but additional costs would be required due to excessive in mileage, as well as not able to provide immediate critical service should repairs or assistance be needed. The access control system is also to be considered a security feature which allows access to the facility to those with approved access cards. Should the access control system fail the facility is open to unauthorized persons accessing secure areas. NCC System is within a reasonable driving distance from the Area Port of Champlain ensure security requirements can address in an expedited manner.
NCC Systems has installed similar systems at our other rural upstate New York locations, which fall under the Area Port of Champlain, NY. Therefore, they are well versed in our requirements, to include their ability to link systems they have already provided at associated locations. NCC Systems is required as a follow-on to continue install interconnected systems across our locations. Similar project for the Port of Massena, NY which is 80 miles away from the Area Port of Champlain, NY was put out for solicition in FY18 and NCC Systems was the only vendor to bid on the solicitation, which is a direct result in this Sole Source Determination. NCC Systems is a Service Disabled Veteran Owned Small Business and has current DUNS and CAGE numbers.
