Facilities Management and Engineering Statement of Work
For U.S. Border Patrol, Yuma Sector
Solid Waste Removal/Trash Pickup and Recycling
1.0 BACKGROUND
The Yuma Sector Border Patrol Stations and Headquarters requires recycling, solid waste removal and trash pick-up. This service is required in order to maintain a clean and orderly work environment. See frequency chart below for additional details.
2.0 SCOPE OF WORK
The Contractor shall provide all labor, material, equipment, transportation, training, and supervision to remove all trash and debris and provide recycling at various locations throughout Yuma Sector for the specified service in accordance with location, size of containers, and frequency listed.
Locations may be added by mutual agreement between the parties with coordination of the Contract Specialist. Locations may be deleted by the Government with 30 days’ notice to the Contractor.
The Contractor shall not interrupt, interfere, or cause the cease of operations at the various locations during solid waste removal or recycling.

2.3 Place of Performance

3.0 DESCRIPTION OF TASKS AND DELIVERABLES
3.1 Permits and Licenses: The Contractor shall obtain and maintain in effect all necessary permits and licenses required by Federal, State or Local government, or subdivisions thereof, or of any other duty constituted public authority. The contractor shall obey and abide by all applicable laws and ordinances pertaining to these services.
3.2. Schedules
3.2.1 Solid Waste: Trash shall be removed and disposed of on a regular set schedule. The schedule will be coordinated with the Point of Contact (POC). The schedule shall be set in accordance to the necessities of each of the six sites. The six sites consist of Yuma Sector – Headquarters, Yuma Sector – Maintenance, Yuma Border Patrol Station, Yuma Sector – Annex, Interstate 8 Checkpoint and Wellton Border Patrol Station.

Unscheduled debris removal and disposal for pick-up of a trash container will be initiated by the POC, Kelly Lape or by the COTR, Ricardo Rios. The Contractor will schedule pick-up the next work day between 8:00 a.m. and 4:30 p.m. with the exception of Government holidays. Next day service is imperative to avoid backup of scheduled service.
Unscheduled pick-ups will be charged at an agreed upon rate and the amount, if any, will be specified on each monthly bill.
3.2.2 Recycling Waste: For locations where recycling is currently available, large recycling containers shall be provided and service to remove and recycle material on a regular set schedule will be established. If/as recycling becomes available in other locations additional recycling bins and service shall be provided. The schedule will be coordinated with the POC. The schedule shall be set in accordance to the necessities of each of the six sites. Containers located within the various buildings will be brought outside for scheduled service. The six sites consist of Yuma Sector – Headquarters, Yuma Sector
– Maintenance, Yuma Border Patrol Station, and Yuma Sector – Annex, Interstate 8 Checkpoint and Wellton Border Patrol Station.

3.3 Hours of Operation: The Contractor shall perform services according to set schedule between the hours 5:00 a.m. to 5:00 p.m. excluding the Federal holidays listed below. If removal schedule occurs on a Federal holiday, the recycling, trash and debris removal shall be completed on either the workday before or after the holiday.

3.4 Contractor Furnished Equipment and Services: The Contractor shall furnish appropriate equipment, tools, labor, supervision and employee training necessary for the performance of the work of this contract unless otherwise specified. The Contractor shall be responsible for maintaining his equipment in workable conditions and shall not relieve the contractor’s responsibility and/or performance in case of a breakdown under this contract. Any costs for correcting damaged caused by the contractor shall be borne by the contractor.
3.5 Government Furnished Equipment and Services: None
3.6 Government Furnished Property: None
3.7 Contractor Employees: The Contractor and his/her employees shall become familiar with and obey all location regulations, including fire, traffic, and security regulations.
The Contractor and his/her employees shall always carry valid picture identification when working on the premises. In addition, Contractor shall ensure that contractor personnel shall be cable employees, trained and qualified in trash removal service. Contractor personnel operating the garbage disposal vehicle(s) must hold proper endorsements.
Employee training shall also include all applicable Occupational Safety and Health (OSHA) and other related standards.
3.8 Work Requirements: The Contractor agrees to the performance of work under this scope of work.
3.8.1 The Contractor shall comply with all local laws, ordinances, and regulations regarding sanitation and solid was disposal.
3.8.2 The Contractor will not create any litter at loading locations, during any transportation, and or at disposal locations.
3.8.3 The Contractor will clean up hydraulic fluid leaks and/or spills caused by Contractor’s equipment while on Government property. The clean-up shall be in compliance with Federal EPA, state and local regulations.
3.8.4 The Contractor agrees that solid waste will be collected and disposed of only at incinerators, landfills, or other facilities, which are approved by EPA as being in conformance with existing Federal Regulations, including any amendments.
3.8.5 The Contractor agrees that recycled material will be collected and disposed of at facilities, which are approved by EPA as being in conformance with existing Federal Regulations, including any amendments.
3.8.6 The Contractor shall identify all vehicles used in the performance of the service with the name/logo of the company for vehicle identification.
3.9 Work Environment
3.9.1 The Contractor shall safeguard the public, Government personnel, property, materials, supplies, and equipment exposed to contractor operations and activities.
3.9.2 Avoid interruptions of Government operations in the performance of this scope of work.
3.9.3 If due to the fault, negligence, and/or dishonesty of the Contractor or its employees, any Government owned or controlled property is lost or damaged as a result of the Contractor’s performance of this scope of work, the Contractor shall be responsible to the Government for such loss or damage and the Government, at its option, may in lieu of payment thereof, require the Contractor to replace at his own expense, all property lost or damaged.

4.0 GENERAL INFORMATION
4.1 Disclosure of Information
4.1.1 Any information made available to the contractor by the government or its customers shall be used only for the purpose of carrying out the provisions of this contract. This information shall not be divulged or made known in any manner to any persons except as may be necessary in the performance of the contract.
4.1.2 In the performance of this contract, the contractor assumes responsibility for the protection of the confidentiality of government records.
4.1.3 The Contractor will adhere to the requirements found in Part 24 of the Federal
Acquisition Regulation, Protection of Privacy and Freedom of Information.
4.2 Employment Eligibility
4.2.1 DHS will consider only US Citizens and Lawful Permanent Residents for employment on this contract. The Contractor must agree that each person employed by his firm or any Subcontractor(s) shall have a Social Security Card issued by the U.S. Social Security Administration, (a) be a United States citizen or
(b) a person lawfully admitted into the United States, eligible for employment.
Subject to existing laws, regulations and other provisions of this contract, illegal or undocumented aliens shall not be employed by the Contractor to work on, under, or with this Contract. (c) The Contractor will submit a Background Information Form for any/all drivers that enter the property. The Contractor will ensure that this provision is expressly incorporated into any and all subcontract or subordinate agreements issued in support of this contract. Proof must be provided if requested by the Government Authorized Representative.
