Section 7a Compliance Analysis

For the Former Trenton Chemical Facility at Jefferson Avenue in Trenton, Michigan

Requested in Conjunction with a Baseline Environmental Assessment

Section 7a(1) of Part 201, Act 451 (1994 PA, as amended) provides that a person who owns or operates property that he/she has knowledge is a facility must: 1) undertake measures to prevent exacerbation of existing contamination; 2) exercise due care by undertaking response activity necessary to mitigate unacceptable exposure to hazardous substances and allow for the intended use of the property in a manner that protects the public health and safety; and 3) take reasonable precautions against the reasonably foreseeable acts or omissions of a third party and the consequences that could result from those acts or omissions. Additionally, pursuant to Section 29a(1), a person may petition the MDEQ for a determination that the proposed use of the property satisfies the person’s obligations under Section 7a. This report serves as such a petition for the property currently known as the “Former Trenton Chemical Facility” (subject property) located on Jefferson Avenue in Trenton, Wayne County, Michigan. The information necessary to support this petition is provided in the following four subsections.

1.0 Detailed Characteristics of Property Use

As discussed in Section 3.0 of the BEA report, the intended future development of the subject property is as part of a wildlife preserve and interpretive center. The property is currently unoccupied. Figure 2 in the BEA is a map of the historical subject property use.

2.0 Hazardous Substance Information

Regulated/hazardous substances that are expected to be present in soil and groundwater at the property include those identified in the body of the BEA report and as detailed in historical analytical data referenced in said report. The identified substances include; benzene, ethylbenzene, toluene, xylene, lead, arsenic and asbestos in soil, and benzene, chlorobenzene, methylene chloride, vinyl chloride, arsenic, barium, cadmium, lead and thallium in groundwater. The identified substances are assumed to be associated with former processes that took place at the subject property. The subject property has been categorized as a facility as defined by Part 201 due to the presence of elevated levels of lead, arsenic and xylenes in the soils and benzene, cholorobenzene, methylene chloride, vinyl chloride, arsenic, barium, cadmium, lead and thallium in groundwater. Applicable chemical-specific concerns are limited to direct contact with contaminated soils and groundwater and direct contact with an inhalation of airborne contaminated particulates during construction activities.

3.0 Plan for Response Activities (PRA)

Currently there are no active response activities scheduled by the proposed purchaser, Wayne County Parks and Recreation Department, to mitigate exacerbation and/or contact with existing contamination. Appropriate remedial actions have already been implemented. The existing soil cap and restrictive covenant at the subject property currently provide an effective barrier from contact with impacted soils and groundwater. The future development of the subject property as part of a wildlife preserve and interpretive center, which may include building(s), parking lot(s) and landscape cover should continue to provide an effective future barrier to direct contact with soil and also provide for fugitive dust control.

4.0 Evaluation and Demonstration of Compliance with 7a Obligations

Proposed future use of the subject property may include redevelopment as a wildlife preserve and interpretive center, and may include buildings, landscaped areas and parking areas. It is not anticipated that hazardous substances or chemicals will be used or stored at the subject property. Therefore, the proposed use will not exacerbate existing contamination at the subject property.

5.0 Construction – Compliance Analysis Plan

Exposure Routes: Currentl subject property conditions, including the soil cap in place and restrictive covenant directives, serve as a barrier to direct contact exposure, drinking water exposure, emissions of volatile organic compounds, if any, and atmospheric entrainment of contaminated particulate matter. During construction activities, contaminated soils may be exposed. Due to the nature of identified contaminants, exposure pathways appear limited to construction workers who may be potentially exposed, directly and/or indirectly, via oral ingestion, inhalation of organic vapors, dermal contact, and inhalation of contaminated airborne soils and particulates; and the general public which may be exposed or organic vapors and contaminated airborne soils and particulates.

Hazardous Substances – Exposure Rates: Exposure frequencies and durations are not expected to exceed rates associated with normal construction activities (e.g., soil excavation, transport, and disposal, surface and subsurface activities). Only trained, authorized personnel will have access to the subject property.

Description of Required Response Activities: Other than appropriate management of excavated soils and extracted shallow groundwater during construction and proper capping of the subject property after completion of construction, no additional response activity is required on behalf of the owner.

Soil Removal Activities: Future development plans for the facility may include construction activities including, but not limited to, excavation of contaminated and non-contaminated soils. Soil relocation shall be performed in accordance with Section 20120c of Part 201. Soil excavation due to construction requirements will be appropriately managed, in that:

1) the excavated soil will be returned to the excavation; if appropriate;

2) where possible, the soil may be relocated on the subject property and properly contained (e.g.; capped);

3) the soil will be characterized to determine proper offsite disposal requirements, and soil requiring offsite disposal will be transported and disposed into an appropriate properly licensed landfill facility (when necessary, soil to be disposed offsite may be temporarily relocated within the site of environmental contamination prior to final offsite disposal); and/or,

4) existing exposure barriers that are damaged will be repaired or replaced with an equivalent or more effective alternative, or prior to future use, if a barrier is warranted, one will be placed.

Shallow Groundwater Removal Activities: Future development plans for the facility may include construction activities including, but not limited to extraction of contaminated and non-contaminated groundwater. Offsite transportation and disposal of groundwater shall be performed in accordance with Section 20120c of Part 201. Groundwater that is extracted due to construction requirements will be appropriately managed, in that:

1) the groundwater will be characterized to determine proper offsite disposal requirements, and will be transported and disposed into an appropriate properly licensed treatment facility (when necessary, groundwater to be disposed offsite may be temporarily containerized and relocated within the site of environmental contamination prior to final offsite disposal);

2) groundwater may be treated at the subject property using appropriate treatment mechanism(s) (i.e. carbon adsorption filtration, air stripping, etc.). If permitted, treated water will be discharged into the public sanitary sewer system and/or transported offsite for disposal; and/or

3) existing exposure barriers that are damaged will be repaired or replaced with an equivalent or more effective alternative, or prior to future use, if a barrier is warranted, one will be placed.

Offsite soil and groundwater disposal activities will be recorded by appropriate documentation, including, but not limited to: manifests, trucking logs, receipts, and other required documentation consistent with Section 20120c(6).

Construction Activities: Construction-related hazardous substance storage, handling, and use areas at the facilities will be identified. Storage and management of construction- related hazardous substances will be performed in a manner designed to maintain public and worker safety and environmental health, and in a manner and location that will permit distinguishing between existing contamination and new releases. A plan will be prepared designating appropriate construction- related hazardous substance storage and handling locations.

Releases of construction-related hazardous substances will be managed in accordance with procedures described in “Release of Hazardous Materials from Construction Use” below.

Prior to commencement of construction activities, a copy of the approved compliance analysis will be provided to project managers representing contractors and subcontractors involved with subject property construction activities. Post-construction activities by subsurface workers will be preceded by notice to those (e.g. subsurface workers) who may have exposure to the contaminants.

Existing Contamination – Not Previously Known: If existing contamination is encountered during construction activities that was not previously known to exist, and is not consistent with known existing contamination, then such contamination shall be characterized and managed in accordance with Part 201 and/or Part 213 of the NREPA. Contaminated materials (i.e. soil and/or groundwater) will be characterized in place or will be staged in a properly designated area until characterization is completed and appropriate relocation destinations are determined. In addition, all appropriate actions will immediately be taken in accordance with all applicable laws and regulations to prevent, abate, or minimize such release, threat of release, or endangerment. If during performance of construction activities an event occurs that presents an imminent and substantial endangerment through a release or threat of release the Pollution Emergency Alerting System (PEAS, 1-800-292-4706) shall be immediately notified.

Release of Hazardous Materials from Construction Use: If there is a release of hazardous materials from onsite usage during construction activities (e.g., release from temporary storage tanks, etc.), actions consistent with requirements of Part 201 and/or Part 213, as applicable, shall be implemented, including but not limited to: determine the extent and severity of the release; report the release to the Pollution Emergency Alerting System (PEAS, 1-800-292-4706) if subject to reportable quantities or if there is a threat of imminent and substantial endangerment; immediately stop or prevent the release at its source, immediately identify and eliminate any threat of fire or explosion or any direct contact hazards; and diligently pursue response activities necessary to achieve applicable cleanup criteria.

Fugitive Dust Control Plan: The following Fugitive Dust Control Program will be implemented during construction activities.

1) Unpaved Roads and Parking Areas

Applicant shall apply a dust suppressant to all unpaved roadways. Application frequency shall be at daily intervals, except when the surface is wet or snow covered.

2) Paved Roads and Parking Areas

Applicants shall utilize a sweeper on all paved roads and paved parking areas.

Frequency of sweeping on paved roads shall be at daily intervals, except when the surface is wet or snow- covered. Frequency of sweeping on paved parking areas shall be at 30 day intervals except when the surface is wet or snow- covered.

3) Recordkeeping

Applicant shall maintain a record of sweeping frequency and frequency of dust suppressant application.

4) Traffic Speeds

Vehicular traffic on all construction roadways shall be limited to a maximum speed of 15 miles per hour and posted near the construction site entrance.

SUMMARY OF THE WORK

SECTION 01 1000

PART 1 - GENERAL

1.01 PROJECT TITLE: VISITOR CENTER STORAGE BUILDING.

1.02 WORK UNDER THESE SPECIFICATIONS

The Contractor shall furnish all materials, labor, equipment, and superintendence for the work described below and within the construction documents. The work includes but is not limited to;

project mobilization and demobilization, project management and oversite, demolition and construction of items described below, quality control, cleanup, and removal of all debris and waste generated during performance of the work.

I-1 Base Bid: Work includes, but is not limited to the following:

All work associated with constructing the storage building with the exception of the following: foundation, floor slab, and underground electrical and telecommunications conduits. These items were constructed under a previous contract.

1.03 LOCATION AND INSPECTION OF SITE

A. The work site is located at the Detroit River International Wildlife Refuge located near Trenton, Michigan. See cover sheet for project location. The address for the Visitor Center and Headquarters is: 5437 West Jefferson Avenue, Trenton, MI 48183. The Refuge Manager may be contacted for further information concerning the project location by telephone at (808) 372- 8898.

B. All prospective bidders, contractors, subcontractors, and related persons are encouraged to visit the site of the proposed Work and to assess the location and extent of the Work prior to submitting bids/quotes. Persons may inspect the site by contacting the Refuge Manager for an appointment.

1.04 DRAWINGS AND SPECIFICATIONS FOR CONSTRUCTION

A. The successful bidder will be provided, upon request, one digital copy of the construction drawings and specifications in .pdf format via email. These files will be provided at no additional cost to the successful bidder.

B. Construction drawings are drawn on a 22” x 34” standard “D” size sheet at 100%. When plotting drawings at different percentages bar scales on drawings shall be used for measuring.

C. Exact location of all affected utilities will be the responsibility of the contractor. Drawings may not completely show all utilities. Site verification is required in addition to contacting any local authorities and utility companies to determine exact locations of utilities.

1.05 WORK NOT INCLUDED IN THIS CONTRACT

A. All items indicated “NIC” on the drawings or in the specifications are items not included in this contract.

B. Work to be performed under other contracts and not included as a part of this contract is generally shown as “By Others” on the Contract Documents.

1.06 ITEMS PROVIDED BY THE GOVERNMENT

A. Work to be accomplished by the Government or manufactured items to be provided by the Government are generally shown as “By Government” on the Contract Documents.

1.07 TEMPORARY FACILITIES

A. Maintain and restore all government roads, service areas, landscaping, and utilities used to pre-construction condition.

B. Temporary toilet facilities and utilities shall be provided by the Contractor for the duration of the project.

1.08 TELECOMMUNICATION SERVICES

A. Provide telecommunications to field office at time of project mobilization. Services shall include, at a minimum, one cellular telephone.

1.09 SITE ACCESS AND RIGHT OF WAY

A. The construction access limits on Government property will be established by the Government and provided to the Contractor at the preconstruction meeting. The Contractor shall be responsible for complying with these limits and governing all work accordingly.

B. The Contractor is reminded all materials, items, and equipment stored on Government property for the duration of the work is at the Contractors own risk. The Government is not responsible for lost, stolen, or damaged property.

C. All bidders are reminded that they are responsible for contacting the local entity such as township, county, or state having jurisdiction in the project vicinity to insure bidders are aware of any requirements of the local entity. These requirements are between the entity and the bidder. Load limits and other restrictions shall be obeyed.

D. Work scheduled on Saturdays, Sundays, Federal Holidays or other than normal working hours shall be approved in advance by the Government Contracting Officer.

1.10 SAFETY - IN ADDITION TO FAR 52.236-13 ACCIDENT PREVENTION

A. The Contractor shall fill out and submit the “Preconstruction Safety Checklist” to the Government Contracting Officer prior to beginning construction.

B. The Contractor shall designate a safety officer to ensure a safe work site. The safety officer shall perform daily work site inspections to assure compliance with all safety regulations and standards.

C. The Contractor’s Safety Plan shall be available on-site. The Contractor shall provide Safety Data Sheets (SDS) for all hazardous materials brought on-site. SDS shall be made available in a conspicuous location.

D. All equipment and work activities shall comply with OSHA Regulations and all accidents incidental to work performed under this contract shall be reported in accordance with OSHA reporting requirements. Additionally a copy of the accident report shall be provided to the Government Contracting Officer.

E. The Contractor shall provide and install barricades, signs, or other warning devices to delineate the construction area.

F. Provide at least one non-freezing type fire extinguisher of the appropriate class for each group of workers performing flammable procedures on the construction site.

G. Provide and maintain on the construction site a basic first aid kit for the workers to use.

1. Provide first aid supply commensurate with size of project with items necessary for first aid treatment of all injuries. The first aid kit shall include items identified on SDS (see paragraph C of this section) in applicable locations.

2. Advise all workers of the location of first aid supplies.

3. Post telephone numbers of nearest hospital or ambulance service and fire station in conspicuous location. Advise all workers of location of telephone numbers.

H. Provide necessary Personnel Protective Equipment (PPE) as identified by SDS and OSHA regulations.

I. Provide documentation workers have been trained in the use of PPE prior to individual use.

PART 1 - GENERAL

1.01 GENERAL

A. Refer to the technical specifications for all submittals required.

B. Contractor shall coordinate submittal review with construction schedule.

1. Review Time: Government response and return of submittal in .pdf format to Contractor within 10 business days of receipt.

B. When specifically requested by the Contracting Officer, Contracting Officers Representative, or the Government’s on-site observer, the Contractor shall provide paper copies of approved submittals, manufacturer’s written installation instructions, and/or recommendations for review and approval prior to accomplishing equipment installation.

1.02 SUBMITTALS

A. The Contractor shall provide a “Standard Submittal Form” for submittals provided to the Government. A copy of the form is provided in the specifications. Upon request, one digital copy of the form in .doc format will be provided via email.

B. The Contractor shall email digital copies in .pdf format of all submittals to the Government except for items noted otherwise in the specifications. The Contractor shall submit material samples and digital submittals exceeding 18 megabytes via mail. Submitted material samples will become the property of the Government and will not be returned to the Contractor.

C. The approval of submittals shall not relieve the Contractor to comply with the terms and conditions of the Contract Drawings, Specifications, and Manufacturer’s Installation Instructions. The Contractor shall be responsible to determine correct dimension, design, connection, detail and satisfactory construction of all Work.

D. The approval of submittals does not constitute acceptance of a change order by the Government. Contract change orders shall be submitted to the Government Contracting Officer following the modification/change order procedures in Section 01 3100 Project Coordination.

E. The Contractor shall provide and maintain in proper order and in good, clean condition, at the project site, a copy of approved submittals.

A. The Contractor shall submit to the Government via the submittal process in digital .pdf format a copy of each delivery ticket for all material delivered to the construction site.

B. The delivery ticket shall show brand name, catalog number, and number of items received.

1.10 WASTE MANIFESTS

A. The Contractor shall submit to the Government via the submittal process copies of all waste manifests.

B. Manifests shall state type of waste (i.e., construction debris, hazardous asbestos, etc.), location of disposal, landfill designation, EPA registration of landfill, and EPA registration for transportation of any hazardous wastes.

PART 2 -PRODUCTS

2.01 EXISTING PRODUCTS

A. Existing materials and equipment indicated to be removed, but not to be re-used, relocated, reinstalled, delivered to the Government, or otherwise indicated as to remain the property of the Government, become the property of the Contractor; remove from site.

B. Specific Products to be Reused: Reuse materials and equipment already existing on the project site as indicated.

2.02 NEW PRODUCTS

A. Provide new products unless specifically required or permitted by the Contract Documents.

B. DO NOT USE products having any of the following characteristics:

1. Made outside the United States, its territories, Canada, or Mexico.

2. Made using or containing CFC's or HCFC's.

3. Made of wood from newly cut old growth timber.

4. Containing lead, cadmium, asbestos.

2.03 PRODUCT OPTIONS

A. Several manufacturer's products may have been identified and included within the specifications. Identified products shall be used as a basis of design. Product substitutions that are equal to or better than the basis of design will be considered as outlined in the specifications.

2.04 PRODUCT SUBSTITUTION PROCEDURES

A. Government will consider requests for substitutions only after contract is awarded.

B. Document each request with complete data substantiating compliance of proposed substitution with Contract Documents.

C. A request for substitution constitutes a representation that the submitter:

1. Has investigated proposed product and determined that it meets or exceeds the quality level of the specified product.

2. Agrees to provide the same warranty for the substitutions as for the specified product.

3. Agrees to coordinate installation and make changes to other Work that may be required for the Work to be complete with no additional cost to the Government.

4. Waives claims for additional costs or time extension that may subsequently become apparent.

5. Agrees to reimburse the Government for review or redesign services associated with re-approval by authorities.

D. Substitutions will not be considered when they are indicated or implied on shop drawings or product data submittals, without separate written request, or when acceptance will require revision to the Contract Documents.

E. Substitution Submittal Procedure (after contract award):

1. Submit one copy of request for substitution for consideration. Limit each request to one proposed substitution.

2. Submit shop drawings, product data, and certified test results for specified product and proposed substitution attesting to the proposed product equivalence. Burden of proof is on the proposer.

3. The Government will notify the Contractor in writing of decision to accept or reject request.

PROJECT COORDINATION

SECTION 01 3100

PART 1 - GENERAL

1.01 JOBSITE ADMINISTRATION

A. Superintendence, Subcontract Administration, Quality Control, and Construction Inspection are the responsibility of the Contractor.

B. Final decisions relative to items of conflict shall be made by the Contracting Officer.

C. The Government shall have the authority to temporarily suspend the Work for such time as necessary because of the failure on the part of the Contractor to perform any of the provisions of the Contract. No extension of contract performance time will be permitted until the Government determines that the deficiencies in performance, which caused the temporary suspension, have been corrected.

D. The Contractor shall have responsible superintendence on site during all project operations.

The Contractor shall submit to the Government in writing a project superintendence plan.

Changes to the superintendence plan shall be approved by the Government prior to implementation.

E. The Contractor shall notify the Contracting Officer in writing at least ten (10) days prior to the anticipated date of completion of all Work specified herein. Upon completion of the Work, the Contracting Officer, or their designee, shall proceed with the final inspection which shall be completed as promptly as practicable. The time required for such inspection and for performing any corrective Work shall be included in the contract performance time.

1.02 MODIFICATION/CHANGE ORDER PROCEDURES

A. In the event of the need for a Change Order, the Contractor will receive a letter requesting a price quote for proposed changes to the Contract.

B. The Contractor shall not perform work outside of the contract documents without written approval from the Contracting Officer. All expenses of Work performed outside of the contract documents without prior approval will be the responsibility of the contractor.

C. For evaluation purposes, the Contractor's quote shall be broken down to show the costs of labor and materials for each proposed category of Work included with the change, along with the total cost for Contractor's overhead, profit, and bond for the proposed changes.

D. All Contract time extensions required as a result of a proposed change must be justified and supported in detail at the time of the proposal.

1.03 REQUESTS FOR INTERPRETATION PROCUDURES (RFI'S)

A. Definition: A request seeking one of the following:

1. An interpretation, amplification, or clarification of some requirement of Contract

Documents arising from inability to determine from them the exact material, process, or system to be installed or when an item of work is described differently at more than one place in the Contract Documents.

2. A resolution to an issue which has arisen due to field conditions and affects design intent.

B. Preparation: Prepare an RFI immediately upon discovery of a need for interpretation of the Contract Documents.

1. Prepare a separate RFI for each specific item.

a. Review, coordinate, and comment on requests originating with subcontractors and/or materials suppliers.

b. Do not forward requests which solely require internal coordination between subcontractors.

C. Submission: Submit all RFI's in .pdf format via email.

D. Content: Include identifiers necessary for tracking the status of each RFI, and information necessary to provide an actionable response

1. Official project name and contract number.

2. Owner's and contractor's name and contact information.

3. Discrete and consecutive RFI number, and descriptive subject/title.

4. Issue date.

5. Reference to particular Contract Document(s) requiring additional information/interpretation. Identify pertinent drawing and detail number and/or specification section number, title, and paragraph(s).

6. Annotations: Field dimensions and/or description of conditions which have engendered the request.

E. Attachments: Include sketches, coordination drawings, descriptions, photos, submittals, and other information necessary to substantiate the reason for the request.

F. Review Time: Government respond and return RFI's in .pdf format via email to Contractor within ten business days of receipt.

1. Response period may be shortened or lengthened for specific items, subject to mutual agreement, and recorded in a timely manner in progress meeting minutes.

H. Responses: Content of answered RFIs will not constitute in any manner a directive or authorization to perform extra work or delay the project. If in Contractor's belief it is likely to lead to a change to Contract Sum or Contract Time, promptly contact the Government Contracting Officer.

1. The Contractor shall not perform work outside of the contract documents without written approval from the Contracting Officer. All expenses of Work performed outside of the contract documents without prior approval will be the responsibility of the contractor.

2. Response may include a request for additional information, in which case the original RFI will be deemed as having been answered, and an amended one is to be issued forthwith.

1.04 PRECONSTRUCTION CONFERENCE

A. Soon after award of the Contract and prior to commencing construction, the Contractor shall attend a preconstruction conference with representatives of the Government at the project location. Timely notification of the meeting will be given to the Contractor. Time, date, and place of the conference will be determined by the Contracting Officer. Requirements pertaining to contract administration, construction operations, project superintendence, and the project schedule will be discussed. The project schedule shall be in accordance with Section 01 3000 Submittals. The preconstruction safety checklist and project schedule shall be submitted for review during this conference.

1.05 PROGRESS MEETINGS

A. Weekly progress meetings will be conducted by the Contractor with representatives of the Government at the project site or by telephone for the purpose of coordinating, expediting, and assessing the work progress. Dates and times will be determined at the Preconstruction Conference.

B. The Contractor shall provide reports of progress on the project, discuss the work schedule for the coming period, and present all conflicts, discrepancies or other difficulties for resolution.

PART 2 - PRODUCTS (NOT APPLICABLE)

B. Certificates: When specified, submit certification by the manufacturer and Contractor or installation/application subcontractor to Government, in quantities specified for Product Data.

1. Indicate material or product conforms to or exceeds specified requirements. Submit supporting reference data, affidavits, and certifications as appropriate.

2. Certificates may be recent or previous test results on material or product, but must be acceptable to Government.

C. Manufacturer's Instructions: When specified in individual specification sections, submit printed instructions for delivery, storage, assembly, installation, start-up, adjusting, and finishing, for the Government's information. Indicate special procedures, perimeter conditions requiring special attention, and special environmental criteria required for application or installation.

D. Erection Drawings: Submit drawings for Government's benefit as contract administrator or for Government.

1. Submit for information for the limited purpose of assessing conformance with information given and the design concept expressed in the contract documents.

2. Data indicating inappropriate or unacceptable Work may be subject to action by

Government or Government.

1.03 REFERENCES AND STANDARDS

A. For products and workmanship specified by reference to a document or documents not included in the Project Manual, also referred to as reference standards, comply with requirements of the standard, except when more rigid requirements are specified or are required by applicable codes.

B. Conform to reference standard of date of issue current on date of Contract Documents, except where a specific date is established by applicable code.

C. Obtain copies of standards where required by product specification sections.

D. Should specified reference standards conflict with Contract Documents, request clarification from Government before proceeding.

E. Neither the contractual relationships, duties, or responsibilities of the parties in Contract nor those of Government shall be altered from the Contract Documents by mention or inference otherwise in any reference document.

PART 2 PRODUCTS - NOT USED

PART 3 EXECUTION

3.01 CONTROL OF INSTALLATION

A. Monitor quality control over suppliers, manufacturers, products, services, site conditions, and workmanship, to produce Work of specified quality.

B. Comply with manufacturers' instructions, including each step in sequence.

3.02 MOCK-UPS

A. Assemble and erect specified items with specified attachment and anchorage devices, flashings, seals, and finishes.

B. Accepted mock-ups shall be a comparison standard for the remaining Work.

3.03 TOLERANCES

A. Monitor fabrication and installation tolerance control of products to produce acceptable Work.

Do not permit tolerances to accumulate.

B. Comply with manufacturers' tolerances. Should manufacturers' tolerances conflict with Contract Documents, request clarification from Government before proceeding.

C. Adjust products to appropriate dimensions; position before securing products in place.

3.04 DEFECT ASSESSMENT

A. Replace Work or portions of the Work not conforming to specified requirements.

B. If, in the opinion of Government, it is not practical to remove and replace the Work, Government will direct an appropriate remedy or adjust payment.

1.01 1.1 REGULATORY REQUIREMENTS

A. All work shall be accomplished in strict accordance with OSHA and all other regulations, codes, and laws in effect at the time the work is performed for the location where it is to be performed.

B. All completed construction shall comply with OSHA, NFPA, and Architectural Barriers Act (ABA) codes and regulations.

1.02 MEANS AND METHODS

A. Means and methods used in the performance of this Contract must be in accordance with all applicable Federal Acquisition Regulations in addition to OSHA regulations, 29 Code of Federal Regulations, acceptable industry practices as recognized by societies, associations, building codes, manufacturers’ specifications, and any applicable state safety and health requirements.

1.03 PERMITS

A. All permits required to support construction activities shall be obtained and paid for by the Contractor.

C. Pollution Control: Provide methods, means, and facilities to prevent contamination of soil, water, and atmosphere from discharge of noxious, toxic substances, and pollutants produced by construction operations. Comply with federal, state, and local regulations.

1.05 COORDINATION

A. Coordinate scheduling, submittals, and work of the various sections of the Project Manual to ensure efficient and orderly sequence of installation of interdependent construction elements, with provisions for accommodating items installed later.

B. Notify affected utility companies and comply with their requirements.

C. Verify that utility requirements and characteristics of new operating equipment are compatible with building utilities. Coordinate work of various sections having interdependent responsibilities for installing, connecting to, and placing in service, such equipment.

D. Coordinate space requirements, supports, and installation of mechanical and electrical work that are indicated diagrammatically on Drawings. Follow routing shown for pipes, ducts, and conduit, as closely as practicable; place runs parallel with lines of building. Utilize spaces efficiently to maximize accessibility for other installations, for maintenance, and for repairs.

E. In finished areas except as otherwise indicated, conceal pipes, ducts, and wiring within the construction. Coordinate locations of fixtures and outlets with finish elements.

F. Coordinate completion and clean-up of work of separate sections.

G. After Government occupancy of premises, coordinate access to site for correction of defective work and work not in accordance with Contract Documents, to minimize disruption of Government's activities.
