PERFORMANCE WORK STATEMENT (PWS)

MISSOURI RIVER PROJECT - GROUNDS MAINTENANCE SERVICES

US ARMY CORPS OF ENGINEERS, MISSOURI RIVER PROJECT

9901 PERSHING DRIVE

OMAHA, NE 68112

PART 1

GENERAL INFORMATION

1. GENERAL: This is a non-personnel services contract to provide all labor, supervision, certain equipment/supplies, and transportation to provide grounds maintenance services at the Corps of Engineers’ Missouri River Project Office. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 DESCRIPTION OF SERVICES. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide grounds maintenance at the Corps of Engineers’ Missouri River Project (MRP) as defined in this Performance Work Statement except for those items specified as government furnished property and services. The Contractor shall perform to the standards in this contract.

1.2 BACKGROUND. The Corps of Engineers Missouri River Project Office is located along the Missouri River in north Omaha, Nebraska. The facility includes numerous warehouse, shop, and administrative buildings, maintenance yards, grassed and landscaped areas, and other trees and bushes.

Grounds maintenance services are required to provide a neat and orderly appearance of the facility.

1.3 OBJECTIVES. Provide quality and timely grounds maintenance at the Missouri River Project Office.

Contractor shall provide for safe, careful, and efficient operations of all equipment and protection of Government property under the direction of the Government Point of Contact (POC) identified in the contract

1.4 SCOPE. Grounds maintenance services consists of furnishing all equipment, material, supplies, and labor required to satisfactorily perform include mowing and trimming, fertilization, weed control, and landscape maintenance at the Missouri River Project Office. Section 5 contains the specific job tasks for this contract.

1.5 PERIOD OF PERFORMANCE. The period of performance shall be for one (1) Base Year of the corresponding months and four (4) option years. The Period of Performance reads as follows:

Base Year: Contract Award – 31 Oct. 2020 Option Year 1: 1 April. 2021 – 31 Oct. 2021 Option Year 2: 1 April. 2022 – 31 Oct. 2022 Option Year 3: 1 April. 2023 – 31 Oct. 2023 Option Year 4: 1 April. 2024 – 31 Oct. 2024

1.6 GENERAL INFORMATION

1.6.1 Quality Control. The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which they assure that their work complies with the requirement of the contract.

1.6.2 Quality Assurance. The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). The POC shall be allowed at any time or place the contractor is on government property, to observe and photograph all work activities conducted through the duration of the PWS. If the contractor is found to be operating in an unsafe and delinquent manner, the contract will be terminated and the contractor shall be held liable for any damages and pay for the completion of the contract by a different source. The POC may inspect the work and equipment as contract progresses. The contractor shall not be paid for any work performed that is deemed defective to the POC. Any defective service(s) noted by the POC shall be corrected at no additional cost to the Government. The contractor shall be responsible to perform only the work specified within the PWS, and shall receive no compensation for work performed that is not specified within the PWS. No government personnel will be allowed to assist the contractor in actual ground maintenance operations or supervisions of the contractor’s personnel.

1.6.3 Recognized Holidays. Contractors shall not work on the Federal Holidays. These holidays include:

1.6.4 Hours of Operation. The Contractor shall be required to complete services during normal duty hours of work, 7:00 a.m. to 3:30 p.m., Monday through Fridays, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the Contractor shall not be reimbursed when the government facility is closed for the above reasons. Requests for additional work hours shall require written approval from the POC, 7 days in advance of the proposed work period.

The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.5 Place of Performance. The work to be performed under this contract shall be performed at the Corps of Engineers Missouri River Project Office, 9901 Pershing Drive, Omaha, NE 68112. The Missouri River Project Office is located along the Missouri River just north of Interstate 680 and Mormon Bridge.

1.6.6 Type of Contract. The government will award a firm fixed price purchase order. An award shall be made to the successful contractor based on “Best Value” rather than low price. The proposals will be evaluated based on the factors stated in Section 1.12.

1.6.7 Security Requirements. All Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes. Directions for background check are in paragraph 1.6.7.3

1.6.7.1 Submit a complete, updated and signed, list of all Contractor and subcontractor personnel, including their titles and intended working hours, who will be working on site prior to start of work. This listing shall be revised and resubmitted when personnel changes occur.

1.6.7.2 Personnel Risk Assessment. A minimum of seven days prior to engaging in work submit, to the CO or Project POC, a Personnel Risk Assessment (PRA) for each employee requiring authorized unescorted access to the Jobsite. The Contractor employee will only be allowed authorized unescorted physical access after the PRA is shown to and approved by the Government.

1.6.7.3 Authorized Unescorted Access Requirements. Perform a PRA on all Contractor personnel that require authorized unescorted access to the Jobsite. Costs associated with the execution of the PRA shall be at the expense of the Contractor. The content of the PRA is defined by the requirements as follows:

a. Criminal Check - Obtain a criminal background check, completed within the last seven years, on all Contractor personnel that require authorized unescorted access to the Jobsite. A minimum of a 7-year criminal background check with the state patrol office shall be performed from all states of residence and employment, for the past seven years. The COR through the Contacting Officer will approve, disapprove, or revoke authorized unescorted access to the Jobsite as a result of the seven-year background check in accordance with Army Directive 2014-05 Enclosure 2.

b. Identity Verification - Contractor employees shall provide positive verification of individual identity prior to authorized unescorted access to the Jobsite. Acceptable forms of identity verification are documents issued by a federal Government agency that include: the individual's photograph, name, and date of birth, such as a passport or military identification (ID) card.

Additionally, a state issued driver's license or ID card is acceptable for identity verification.

c. The Criminal Check and Identity Verification shall be updated at least every seven years for each employee requiring authorized unescorted access to the Jobsite.

d. Escort Requirements - Contractor personnel not cleared for authorized access to the Jobsite may be escorted by Government or Contractor personnel that have authorized unescorted access to the Jobsite. All costs related to the escorting of non-cleared personnel shall be at the expense of the Contractor. Additional burden shall not be placed upon the Government to provide these escorts.

Prior to access, coordination with the Project Security Officer is required, including but not limited to:

(1) Verification of identity with photo identification

(2) Name of escorting individual and verification of unescorted status

(3) Time of entry into the Jobsite

(4) Time exiting the Jobsite.

1.6.8 Special Qualifications. Contractor shall furnish a minimum of two (2) individuals to perform the mowing as specified in the PWS. The Contractor is responsible for ensuring 1) all personnel are a minimum of sixteen (16) years of age, 2) all personnel involved with the operation of vehicles on public roadways possess and maintain a valid United States issued operator license during the period(s) of performance of this contract 3) all vehicles and equipment operated on public roadways are legally registered, licensed, and insured to do so and meet all State and local laws 4) all personnel are trained and have working knowledge of the specific vehicles/equipment they will operate and tasks they are directed to perform and 5) all personnel fulfill the security requirement as presented in this PWS.

1.6.8.1 All Contractor employees, to include subcontractor employees, requiring access to Army installations, facilities and controlled access areas shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The Contractor shall submit certificates of completion for each affected Contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within 5 calendar days after completion of training by all employees and subcontractor personnel.

1.6.8.2 The Contractor and all associated sub-contractors shall brief all employees on the local iWATCH, Corps Watch, or See Something, Say Something program (training standards provided by the requiring activity ATO). This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after contract award.

1.6.8.3 All new Contractor employees will complete Level I OPSEC training within 30 calendar days of their reporting for duty. Additionally, all Contractor employees must complete annual OPSEC awareness training. http://cdsetrain.dtic.mil/opsec/index.htm

1.6.8.4 All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas. There are NO classified materials at this project location.

1.6.8.5 The Prime Contractor Company must have (or will have) a Facility Clearance (FCL) at the appropriate level (IAW the NISPOM DOD 5220.22-M and AR 380-49) prior to the start of the contract awarded period of performance. Contractor personnel performing work under this contract must have the required security clearance, per AR 380-67, at the appropriate level at the start of the period of performance. Security Clearances and FCL requirements are required to be maintained for the life of the contract IAW the DD254 attached to the contract. If no FCL, the supporting Government Contracting Activity will sponsor the prime contract company in obtaining the FCL. This location does NOT require a Facility Clearance/FCL.

1.6.8.6 The Contractor must pre-screen Candidates using the E-verify Program (https://www.e-verify.gov/) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

1.6.9 Post Award Conference/Periodic Progress Meetings. The Contractor shall meet with the POC prior to commencement of work to discuss performance requirements and administration of the contract. The Contractor at this meeting shall submit for approval the following: Work Plan, Quality Control Plan, Accident Prevention Plan, and certificates of insurance. The Work Plan shall include a list of materials, equipment, and supplies for approval. Personnel requirements and a detailed work schedule with approximate time of performance at each facility shall also be included in the work plan. Once approved, this plan shall not be changed without the approval of the POC. The Contractor shall visit all work areas with the POC prior to commencement of work. This will provide an opportunity to discuss specific work areas and quality of performance issues. The POC and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor’s performance. At these meetings the POC will apprise the contractor of how the government views the contractor’s performance and contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.10 Pre-Bid Site Visit. It is highly recommended that a bidder make an on-site visit to the Missouri River Project Office prior to submittal of bid. The MRP is considered a restricted area and the Contractor must contact the POC to schedule a site visit.

1.6.11 Government Point of Contact (POC). The POC monitors all technical aspects of the agreement and assists in agreement administration. The POC is authorized to perform the following functions: assure the Contractor performs the technical requirements of the contract; performs inspections necessary in connection with contract; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including http://www.myarmyonesource.com/cmsresources/Army%20OneSource/Media/Videos/Family%20Programs%20and%20Services/iWatch_Program/iWATCH%2060_4streaming.wmv http://www.myarmyonesource.com/cmsresources/Army%20OneSource/Media/Videos/Family%20Programs%20and%20Services/iWatch_Program/iWATCH%2060_4streaming.wmv specifications; monitor contractor’s performance and notifies both the Contracting Officer and contractor of any deficiencies; coordinates availability of government furnished property; and provides site entry of contractor personnel (if required). The POC is not authorized to change any of the terms or conditions of the resulting order. The following are the government POC’s for this contract:

1.6.12 Key Personnel. The following personnel are considered key personnel by the government:

Contractor, contract manager, and contract manager alternate. The Contractor shall provide a contract manager who shall be responsible for performance of work. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall by designated in writing the POC and provided in the Work Plan. The contract manager and alternate shall have full authority to act for the Contractor on all contract related matters related to the daily operation of this contract. The Contractor, contract manager, and alternate contract manager shall be available between 7:30am and 4:00pm CST, Monday through Friday, accept Federal holidays or when the government facility is closed for administrative reason.

1.6.13 Identification of Contractor Employees. All contract personnel attending meetings and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

1.6.13.1 Appearance. The Contractor shall ensure that contract personnel present a neat and professional appearance at all times. Contractor’s personnel shall remain fully clothed at all times while performing under this contract. This includes shirts with sleeves (short or long), long pants, and steel toed boots.

Offensive pictures, sayings, tank tops, and spandex or similar fabric worn as outerwear are strictly prohibited.

1.6.13.2 Conduct. Contractor personnel’s conduct shall not reflect discredit upon the Missouri River Project or the Department of the Army. Rude, threatening or obscene language, gestures, or attitudes will not be tolerated. The Contractor shall remove any employee for reasons of misconduct or security from the jobsite. The removal from the job site of such a person shall not relieve the Contractor of the requirement to provide sufficient personnel to perform adequate and timely service.

1.6.14 Environmental Requirements: The Contractor shall comply with all Federal, state, and local environmental laws, rules and regulations.

1.7 SITE SAFETY AND HEALTH.

1.7.1 Emphasis shall be placed on safety on all phases of operations by the Contractor.

1.7.2 The Contractor shall adhere to EM 385-1-1 Safety and Health Requirements Manual, available at the Project Office. The Contractor shall develop an Accident Prevention Plan (APP) and receive an approval from the POC prior to commencement of work.

1.7.3 The Contractor shall provide and have available at all times a fully stocked first-aid kit in each vehicle used in this contract and instruct employees in its use.

1.7.4 The Contractor shall meet with all employees prior to commencement of this contract to fully discuss the contract safety program.

1.7.5 A fire extinguisher shall be in any contractor vehicle and/or equipment at all times while performing tasks outlined in the contract.

1.8 UNSATISFACTORY PERFORMANCE.

1.8.1 All services performed under this contract shall be performed in a strictly first-class manner.

1.8.2 If any service is not performed in compliance with the terms of this contract and to the satisfaction of the POC, the Contractor shall perform the services again within 48 hours of notification by the POC.

This shall be done at no additional cost to the Government. In the event the Contractor fails to correct the deficiencies within a 48 hour period or if the Contractor cannot be contacted, the Government has the right to have the services performed by other forces at the Contractor's expense.

1.8.3 It is the responsibility of the Contractor to ensure that all contract services are performed in accordance with these specifications.

1.8.4 The Contractor shall be notified by the POC of deficiencies in service.

1.8.5 Upon receipt of notification of deficiency in service, the Contractor will immediately correct the deficiency and /or take steps to prevent recurrence of the deficiency.

1.8.6 Damage to Property: Contractor will immediately report any damage to Government or private property due to flying rocks or debris from equipment or Contractor’s negligence to the POC orally. The Contractor will submit a report to the POC within 48 hours of the incident that will include date and time the damage was incurred, item damaged, and associated circumstances. Damage could include but is not limited to: fences, signs, posts, tables, carsonite markers, trees, shrubs, turf, buildings, vehicles, etc. The Contractor will subsequently replace/repair any damage to Government or private property. Replacement trees, shrubs, and hedges shall be the same type and size in accordance with instructions from the POC. If the damage to any property has not been repaired or replaced by the Contractor within 30 days of notification, the replacement cost shall be deducted from the next monthly invoice submitted for payment.

All other repairs/replacements must be completed as coordinated with the COR.

1.8.7 Damage to Vegetation. Damage to woody vegetation shall be defined as follows: "Damage includes but is not limited to broken limbs, bark loosened or torn from trunks, vegetation being run over or mowed off." Repair of loosened or torn bark is not considered, for purposes of this contract, to be satisfactory compensation for loss. All tree and shrub damage will be computed using the most current values established by the Council of Tree and Landscape Appraisers. When damage involves only a percentage of a tree, a corresponding percent estimate of damage will be assessed. The total amount of damage to a particular tree(s) or shrub(s) will be deducted from the sum to be paid for that area mowing and trimming.

A copy of the CTLA Formula, from the Tree and Shrub Valuation Method to be used, will be available for viewing upon request

1.8.8 Vehicle Operation and Parking: While performing work under this contract, vehicles shall be operated and parked only on roads, parking areas, or pullouts unless the COR approves use of other areas.

1.9 WEAPONS. The Contractor shall have no weapons on his/her possession in the contract area.

1.10 ALCOHOL. The Contractor shall not be under the influence of alcohol while performing contract activities.

1.11 PAYMENT PROCEDURES. Payment will be made upon submittal of invoice for work successfully performed, completed and accepted.

1.12 BEST VALUE: Award to the successful contractor shall be based on “Best Value” rather than low bid. Bids will be rated on the following factors and references from previous employers and must be provided on each of the following items with the exception of price:

a. Equipment. Please provide a written narrative of your abilities. This shall include a list of equipment including mowers, trimmers, etc.

b. Past Performance. Provide two references of similar projects (magnitude) with the contact information, to include telephone number, e-mail address, and physical address.

c. Price. The bid price shall be inclusive of all costs that might be incurred by the contractors during the contract such as, but not limited to, fuel, labor, mileage, equipment, equipment rental fees, licenses, insurance, required plans and training, etc.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. Contractor. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. Contracting Officer. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. Defective Service. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.4. Deliverable. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.5. Key Personnel. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.6. Physical Security. Actions that prevent the loss or damage of Government property.

2.1.7. Quality Assurance. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.8. Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of Contractor performance.

2.1.9. Quality Control. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.10. Subcontractor. One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

2.1.11. Workday. The number of hours per day the Contractor provides services in accordance with the contract.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.1 SERVICES. The Government shall furnish Quality Assurance (QA).

3.2 FACILITIES. Not Applicable

3.3 UTILITIES. Not Applicable

3.4 EQUIPMENT. Not Applicable

3.5 MATERIALS. The government will furnish 1) aerial maps of all areas requiring grounds maintenance services within this contract; 2) A copy of EM 385-1-1 Safety and Health Requirements Manual, if requested.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 GENERAL. The Contractor shall furnish all supplies, products, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 SECRET FACILITY CLEARANCE. Not applicable.

4.3 MATERIALS/EQUIPMENT. The Contractor shall furnish all necessary materials, such as but not limited to insurance, licenses, work plan, accident prevention plan, quality control plan, reporting requirements, invoices, etc. to complete the requirements of this PWS.

4.4 GENERAL LIABILITY INSURANCE. The Contractor shall hold general liability insurance in the amounts specified in the clause of this contract and show proof of such as stated in Paragraph 1.6.9 POST AWARD CONFERENCE/PERIODIC PROGRESS MEETINGS of this PWS before work can comment/continue. The insurance policy shall be valid for the duration of the period(s) of performance and updated annually.

4.5 RULES AND REGULATIONS. The Contractor shall abide by all USACE regulations as listed in CFR, Title 36. Exceptions to these regulations may be made at the discretion of the POC.

4.6 EMPLOYEE SAFETY.

4.6.1 GENERAL SAFETY. The Contractor shall be responsible for the safety of their employee(s), and for any injury or damage done by said personnel, and shall protect the government from any claims. All personnel are required to wear manufacturer’s recommended personal protection equipment during all work activities conducted in completion of this PWS. The contractor’s equipment shall meet or exceed all current federal, state, and local safety requirements. The Contractor is responsible complying with all applicable safety requirements and practices set forth in the most recent version of EM 385-1-1 entitled “Safety and Health Requirements Manual”.

4.6.2 OPERATIONS OF EQUIPMENT/VEHICLE. Equipment and vehicles shall be kept in a good state of repair. Any vehicles or equipment found to be unsafe will not be used until unsafe conditions have been corrected. No person shall be permitted to ride with arms or legs outside the vehicle body, in a standing position on the body, on running boards, or seated on side fenders, cabs, cab shields, rear of vehicle, or on the load. Riding on vehicles or equipment is prohibited unless a seat is provided. Only the operator shall be allowed to ride on the equipment designed for one man operation. Vehicles or equipment shall not be operated in a manner that will endanger persons or property nor shall the safe operating speeds be exceeded. No vehicle or equipment shall be stopped, parked, or left standing on any road or adjacent thereto in such a manner as to endanger other vehicles using the road. No vehicle or equipment shall be left unattended until after the motor has been shut off, the key removed, parking brake securely set, and gear engaged in low, reverse, or park. Equipment shall be locked or secured to prevent starting by unauthorized persons. If stopped on hill or grade, front wheels shall be turned or hooked into the curb or the wheels securely choked.

4.6.3 ONSITE SAFETY. The contractor shall provide and maintain, at a minimum, the following on-site safety equipment/requirements:

a) The Contractor shall provide and maintain at least on nonfreezing-type A-B-C fire extinguisher in each vehicle, vessel, and piece of motorized equipment (ATV, UTV, etc). Place in a location readily accessible to personnel.

b) The Contractor shall provide and maintain a first aid kit commensurate with the size of the project and with the items necessary for first-aid treatment of all injuries.

c) The Contractor shall advise personnel of the location of first-aid kits and fire extinguishers.

d) The Contractor shall post telephone numbers of nearest hospital or ambulance service and fire station in a conspicuous location and advise all personnel of locations and telephone numbers.

4.6.4 ACCIDENT PREVENTATION PLAN. In accordance with EM 385-1-1, the Contractor shall submit an accident prevention plan to be followed by all contractor personnel during performance of work.

The plan shall be developed only after careful analysis of the work involved and shall be tailored specifically to the conditions of this contract and shall address the following items:

a) Responsible Individuals

b) Indoctrination of New Employees

c) “Tool Box” Safety Meetings

d) Fire Prevention and Protection

e) Housekeeping

f) Mechanical Equipment Inspection

g) First Aid and Medical Facilities

h) Sanitation

i) Personal Protective Equipment/Devices

j) Accident Reporting

4.7 WORK PLAN. The Contractor shall submit a Work Plan in accordance with Section 1.6.

4.8 QUALITY CONTROL PLAN. The Contractor shall submit a Quality Control Plan in accordance with Section 1.6.

4.9 FERTILIZER/WEED CONTROL PLAN. The Contractor shall submit a Fertilizer/Weed Control Plan in accordance with Section 5.4.

4.10 MOWING SCHEDULE. The Contractor shall submit a mowing schedule in accordance with Section 5.3.4.

PART 5

SPECIFIC TASKS

5. SPECIFIED TASKS:

5.1 GENERAL. The Contractor shall provide grounds maintenance services include mowing and trimming, fertilization and weed control, and landscape maintenance at the MRP as provided below. The Contractor shall submit a weekly work schedule on Thursday by 1300, for the work being conducted the next week for approval by the POC.

5.2 BID ITEM TASKS. The following is a description of the tasks associated with each bid item on the bid schedule. The work areas are identified in Attachment 4 of this PWS.

5.2.1 Main Mowing Area. The following tasks shall be completed by the Contractor under Bid Item 0001 – Main Mowing Area (Approximately 7 acres):

(1) Contractor shall mow all areas to look well-manicured, with a neat and professional appearance at all times. Maintain grass height between two (2) and four (4) inches, uniform in appearance, and free of cutting windrows, skips, gaps, rutting, and scalping according to Part 5.3 of this PWS.

(2) Contractor shall maintain the Landscaped Areas as depicted on attachment 4 surrounding the administration building to be well manicured, with a neat and professional appearance at all times, free of weeds by raking, spraying, or other approved means in accordance with Part 5.4.

Contractor shall complete up to 20 mowing’s of the Main Mowing Area. These mowing’s are not guaranteed, as frequency shall be determined by the current condition of the mowing area with approval received from the POC prior to that week’s mowing.

5.2.2 Secondary Mowing Area. The following tasks shall be completed by the Contractor under Bid Item 0002- Secondary Mowing area (Approximately 11.6 acres):

appearance at all times. Maintain grass height between four (4) and six (6) inches, uniform in appearance, and free of skips, gaps, rutting, or scalping according to Part 5.3 of this PWS.

Contractor shall complete three (3) mowing’s of the Secondary Mowing Area. These mowing are not guaranteed, as frequency shall be determined by the current condition of the mowing area with approval received from the POC prior to that week’s mowing.

5.2.3 Wildflower Mowing Area. The following tasks shall be completed by the Contractor under Bid Item 0003- Wildflower Mowing Area (Approximately 3.4 acres):

appearance at all times. Maintain grass height between six (6) and twelve (12) inches, uniform in appearance, and free of skips, gaps, rutting, or scalping.

Contractor shall complete up to one (1) mowing of Wildflower Mowing Area. This mowing is not guaranteed, but will generally be conducted in the fall as determined by the condition of the mowing area with approval received from the POC prior to that week’s mowing.

5.2.4 Fertilization/Weed Control Plan. The Contractor shall develop and execute a complete fertilization and weed control plan for the Main Mowing Area, Parking Lot and Embankment for the entire mowing season under Bid Item 0004 - Fertilizer/Weed Control Plan in accordance with Part 5.4 of this PWS.

5.2.5 Landscape Maintenance. The Contractor shall complete annual maintenance of following tasks shall be completed by the Contractor under Bid Item 0005 – Landscape Maintenance in accordance with Part 5.5.

5.2.7 Typical Schedule/Frequency of Bid Items. The following is the typical schedule and frequency of mowing’s under this contract. The Contractor may diverge from this schedule with approval from the POC. This is not a guarantee of work and is intended for planning purposes only.

as total acreage was scaled from existing maps and aerial photographs.

5.3 MOWING AND TRIMMING.

5.3.1 Policing, Cleanup & Disposal of Debris. Prior to each mowing, the Contractor shall pick up and remove all debris, litter, or trash (including but not limited to paper, cups, bottles, cans, wire, limbs and other portable objects) within areas to be mowed and landscaped areas. The purpose of policing is to prevent debris, rubbish or trash from being scattered by mowing operations. The Contractor shall clean all clippings resulting from mowing and trimming operations from sidewalks, curbs, parking areas, and roadways immediately after cutting and trimming. The Contractor shall remove all pruned vegetation, removed weeds, limbs, mulch and other debris resulting from mowing and trimming, fertilization, weed control and landscape maintenance activities from the MRP the same day as the debris is generated, and properly dispose of off-site.

5.3.2 Mowing. Contractor shall mow and trim all areas to a well-manicured, neat and professional appearance at all times. The Contractor will take precautions to maintain mowing blades in a sharp condition at all times to provide a quality and uniform cut. Mowing shall be accomplished so that discharge is directed away from vehicles, buildings, roads and parking areas. In the case of fungal disease outbreaks, clippings will be collected until the disease is controlled.

5.3.3 Area to be Mowed and Trimmed. Approximately 22 acres of turf will be mowed and trimmed at the MRP in three (3) separate mowing areas. The areas to be mowed and trimmed are located both within and outside the perimeter security fence to Pershing Drive and are shown on Attachment 4 in Part 7 and described in Sections 5.2.1 and 5.2.2 of this PWS. Any questions concerning the area to be mowed and trimmed should be clarified with the COR prior to service. No mowing services will be performed within the fenced boundary of the U.S. Coast Guard facility. The Contractor will independently verify acreage to be mowed as necessary.

5.3.4 Schedule/Frequency. The Contractor shall submit a mowing schedule for the entire mowing year scheduling the 15 mowing’s of the Main Mowing Area within two weeks of the award of the base contract and by March 1st of each Option year awarded. The additional five mowing will be scheduled as necessary based on the turf and weather conditions, but will generally occur on off-weeks of the 15 scheduled mowing during times of greater precipitation. The Secondary and Wildflower Mowing Areas will be schedule as necessary and coordinated with the Contractor by the POC in conjunction with already scheduled work.

5.3.5 Ground Conditions. The Contractor shall not start work unless the grass and ground are dry enough for smooth cutting and equipment will not cause rutting of the ground. The Contractor shall use good judgment in determining whether conditions are suitable for mowing operations. In cases where the Contractor and the POC disagree about the suitability of conditions for mowing operations, the KO will determine whether work shall progress or stop.

5.3.5 Trimming. Trimming shall be accomplished within the designated area to be mowed and trimmed every time the area is mowed. All areas shall be trimmed concurrent with mowing. Trimming will be performed around all areas inaccessible to mowers to include building foundations, walls, fences, poles, signs, guard posts, trees, shrubs, transformers, junction boxes, vent pipes, electrical posts, spigots rock or gravel stockpiles, ridges, depressions, edges of operational structures, rip-rapped areas, side hills, road shoulders, backside of ditches, fences, and similar fixed and/or temporary obstacles or objects. Trimmed grass height shall match surrounding mowed grass height. The Contractor shall utilize shields or other measures to prevent bark cuts or other such damage when trimming around trees and shrubs with trimming equipment. Special care will be exercised to not damage vines and shrubs, especially in the fence line and around buildings. At the Contractor’s expense and with approval of the COR, an approved chemical herbicide may be used around structures such as fence lines to control growth of vegetation.

5.4 FERTILIZATION AND WEED CONTROL.

5.4.1 Program. The Contractor shall develop and implement fertilization and weed control program in accordance with the parameters identified below. The Fertilization and Weed control program will maintain designated areas in a well maintained and professional appearance at all times. This program will be submitted as part of the Contractor’s initial bid package and prior to award of option years. Fertilization and weed control services shall be applied within the Main Mowing Areas; and Weed control services shall be applied within the Parking Lot and Embankment areas of the MRPO shown on Attachment 4 in Section 7 of this PWS. Any questions concerning the area to be treated should be clarified with the POC prior to service. The Contractor will independently verify acreage to be treated as necessary.

5.4.1.1 Turf Grasses. Continual control of weeds is required throughout the year for all the Main Mowing Areas with the area identified in Attachment 4. Turf grasses will be treated each spring to eliminate and control annual grass and weeds such as crabgrass, foxtail, goose grass, etc. through the use of a pre-emergent and subsequent spraying or spot treatment throughout the year. Treatment to eliminate and control broadleaf weeds such as dandelion, clover, chickweed etc., will be performed throughout the year.

Turf grasses will also be fertilized in the spring coincident with pre-emergent application. Fall fertilization of Main Mowing Areas will be included at the discretion of the Contractor and as part of the Fertilization/Weed Control Plan.

5.4.1.2 Landscaped Areas. Continual elimination and control of weeds is required throughout the year in any Landscaped Areas identified in Attachment 4 to include mulch beds, rock beds, flower beds, around shrubs, and at the base of trees. Control of weeds can be accomplished by pulling, raking, spraying, or other approved means. This work will be completed in conjunction with and as part of work completed with Bid Item 0001 – Main Mowing Areas.

5.4.1.3 Parking Lot. The parking lot to be sprayed is a gravel surfaced area consisting of approximately 1.2 acres identified as “Parking Spray Area” in Attachment 4 and shall be sprayed with an herbicide/s to provide season long elimination and control of all vegetation. This work shall be accomplished between June 1st and June 30th with subsequent spraying or spot treatment throughout the year as required.

5.4.1.4 Embankment. The Embankment, approximately 4400 lineal feet, of the Missouri River shall be sprayed from the top of the embankment to the edge of the water with an approved herbicide to eliminate and control noxious weeds and woody vegetation this work shall be accomplished between June 1st and June 30th with subsequent spraying or spot treatment throughout the year as required.

5.4.2 Application. Fertilizer and weed control products will be applied at the rates specified by the product’s manufacturer and in strict compliance to all Federal, State and local laws, regulations or ordinances. All applications of fertilizers or weed control products will be coordinated with and approved by the POC. All grass, trees, shrubs, flowers and/or ground cover damaged or destroyed from improper chemical selection or application shall be replaced in kind at no additional expense to the Government.

The Contractor shall remove granular fertilizer or weed control products from all pavements immediately after application.

5.4.3 Products.

5.4.3.1 Fertilizer Product. The Contractor will apply a granular, slow-release nitrogen fertilizer containing an 18-0-3 grade (or equivalent) with IBDU insoluble nitrogen. Fertilizer grade refers to the minimum percentages of nitrogen (18%), phosphorous (0%), and potassium (3%), (Fed. Spec. D-F-241d). Soluble nitrogen shall be derived from urea. Slow-release nitrogen shall be derived from slow release nitrogen from polymer compounds of nitrogen, such as urea-formaldehyde (UF), or isobutyidene diurea (IBDU).

Coated soluble compounds, such as sulfur or plastic-coated urea, shall not be considered sources of slow-release nitrogen. The Contractor may propose use of an alternative fertilization product based on soil conditions. Use of an alternate product must be approved by the COR prior to application.

5.4.3.2 Weed Control Products. Contractor will apply EPA-approved pesticides to control weeds. (The term “pesticide” refers to pesticides and herbicides). When applied in close proximity to the Missouri River, pesticides appropriate for applications around waterways, shall be used. Before applying pesticides, the type of weed shall be identified and the control selected accordingly, using the most effective control for the species. Any chemicals used shall be the least toxic available in regards to warm-blooded animals, amphibious animals, and fish per Nebraska Department of Agriculture guidelines.

5.4.4 Chemical Application Guidelines.

5.4.4.1 Chemical Application Licenses. The application of any pesticide shall be done by persons certified and licensed for their use by the State of Nebraska. The Contractor must supply all such licenses as part of the Contractor’s initial bid package and prior to the award of annual options.

5.4.4.2 Reporting and Record Keeping: The COR shall be provided with both the package labeling and a

Safety Data Sheet (SDS) for each proposed chemical product, and approve its usage, before the product is applied. The Contractor must record any pesticide and/or fertilizer application after each application and report the data to the COR. All pesticide application records will be in accordance with ER 1130-2-540, paragraph 3-3k of the current edition of Project Operations – Environmental Stewardship Operations and Maintenance Guidance and Procedures. The Contractor shall submit to the COR, within 24 hours after completion of an application, written reports showing quantities of active pesticide ingredients, applied areas treated with the herbicide, and amount of product applied. Similar reports will be submitted to the COR, within the same time frame, of each fertilizer application for the sake of maintaining MRP historical records. See Attachments 2 and 3 in Section 7 of this PWS for the required Pesticide Application Record Sheet and Fertilizer Application Record Sheet.

The contractor shall be responsible for any and all notification requirements for pesticide application within public places. The specific public use area is the bike trail located outside the Missouri River Project fence running parallel with John J Pershing Dr.

5.4.4.3 Spills. The Contractor must report and appropriately respond to and remediate any chemical accidents, such as spill or drift. Report will be made immediately to the COR and a written report provided within seven (7) calendar days of each such incident if required by the COR. The Contractor will include the date and time the spill, quantity spilled, response and remedial actions, and associated circumstances as applicable.

5.5 Landscape Maintenance. The Contractor shall conduct annual landscape maintenance for the Missouri River Project Officer, which includes pruning of shrubs, vines, and ground cover; tree pruning; and replenishment of mulch around the Landscaped Areas, adjacent parking lots, and trees. All materials removed (e.g. branches, vines, ground cover, etc.) as part of the landscape maintenance shall be removed from the site. This work shall be conducted between 1 April and 15 May. A Landscape Maintenance Plan will be submitted as part of the Contractor’s initial bid package and prior to the award of option years. This plan shall include a description and rough location of each landscape maintenance item to be performed under this work item.
