Issued by
Department of the Navy Naval Sea Systems Command

About this file

This justification and approval document seeks to award a sole source contract to Wieland Thermal Group for evaporator tube kits to increase the cooling capacity of aircraft carrier air conditioning plants by 10%. The Naval Sea Systems Command intends to procure up to 25 kits over five years, with each kit containing 510 evaporator tubes. As the original equipment manufacturer qualified Wieland's proprietary Turbo-B tube design which has over one million service hours, and no equivalent products meet requirements while offering increased capacity, only Wieland is considered able to meet the Navy's needs. Interested vendors must be authorized Wieland resellers to submit quotations in response to solicitation N6449820Q5075 by April 8, 2020 for the Department of the Navy to determine fair and reasonable pricing prior to award.

J&A Number: 0233-20-002-00 Code: 0233 P.R. Number: 20-BAS-011

BRAND NAME JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0223.

2. Description of Action Being Approved

Award of a Firm Fixed Price (FFP) contract on a brand name basis for Wieland Thermal Group (“Wieland”) brand evaporator tube kits, consisting of Turbo-B® evaporator tubes, in support of the CVN-68 Ship Class air conditioning (A/C) plants.

3. Description of the Supplies or Services

The proposed acquisition will provide for the furnishing of up to twenty-five (25) Commercial off the Shelf (COTS) evaporator tube kits, each kit consisting of five hundred ten (510) Turbo-B® evaporator tubes. Each evaporator tube kit will replace all existing evaporator tubes in one CVN Class A/C plant evaporator heat exchanger. The Turbo-B® tubes are higher efficiency than the original tubes in the evaporator heat exchanger and are of a special design that is proprietary to the manufacturer, Wieland. These tubes will be installed by Ship Change Document (SCD) No. 8168 to increase the maximum cooling capacity of the A/C plant by 10%.

The anticipated period of performance is five (5) years from date of contract award including a base year and four (4) option years. The total estimated value of this acquisition is .

Fiscal Year 2020 funding for the FFP contract is estimated as follows:

Base Option 1 Option 2 Option 3 Option 4

O&MN

Certifying technical and requirements personnel have verified the Government’s minimum needs.

4. Statutory Authority Permitting Other Than Full and Open Competition

41 U.S.C. 1901(e)(2), a sole source (including brand name) acquisition under the authority of

DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

PHILADELPHIA DIVISION

5001 SOUTH BROAD STREET

PHILADELPHIA PA 19112-1403

IN REPLY REFER TO:

Simplified Procedures for Certain Commercial Items, as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority

The CVN-68 Class A/C plants produce chilled water (CW) for various shipboard cooling applications and are considered mission critical equipment. Each CVN-68 Class A/C plant can currently produce up to 363 tons of cooling. There are ten (10) A/C plants per CVN-68 Class aircraft carrier. According to the Ship Systems Status Program (SSSP), additional loads will continue to be added to the CW system over the life of the platform necessitating higher cooling capacities from the ships’ A/C plants. If no additional cooling capacity is provided, eventually ship cooling loads will exceed the A/C plant’s cooling capacity resulting in higher CW temperatures.

Consequently, cooling of mission critical equipment would suffer.

Wieland’s Turbo-B® evaporator tubes have a proven service history in large-capacity Navy A/C plant applications. The Turbo-B® evaporator tubes have been in Navy service over the past 15 years since Johnson Controls, Inc. – York Navy Systems, the sole Original Equipment Manufacturer (OEM) for Navy A/C plants, qualified the Turbo-B® tubes as part of the OEM vendor qualification process and incorporated their design in several large-capacity Navy A/C plant configurations.

The Turbo-B® evaporator tubes have logged over 1,000,000 combined service hours across the following A/C plant configurations: the 200-Ton HFC-134a A/C plants used aboard DDG-51 Flight IIA Class and LPD-17 Class ships, the 250-Ton HFC-236fa A/C plants used aboard LCC- 19 Class ships, the 450-Ton HFC-134a A/C plants used aboard SSN-774 Class submarines, the 500-Ton HFC-134a A/C plants used aboard the (LHA-6) and (DDG-1000) Class ships, and the 800-Ton HFC-134a A/C plants used aboard the

(CVN-76) and the (CVN-77). Additionally, approximately 34 of the applicable 80 total A/C plants to receive these tubes (hulls CVN-68 – 75) have already been back fitted with the Turbo-B® evaporator tubes.

Wieland is the only known source that manufactures the patented and trademarked Turbo-B® line of heat exchanger tubes. The tubes are designed with modified integral helical fins on the outside to enhance initiation of nucleate boiling, which improves the overall heat transfer coefficient. The tubes are also designed with inside helical ridges that also add to the overall heat transfer coefficient by providing increased surface area and turbulation. Both design features improve the rate of refrigerant boiling in Navy A/C plant evaporators, thereby increasing the overall cooling capacity of the A/C plant.

In addition to offering a 10% increase in maximum cooling capacity, the Turbo-B® tubes meet the original MIL-T-22214 requirements, and have already been qualified to the Navy’s shock and vibration requirements as part of the OEM vendor qualification process. No other tubes on the market meets these requirements while also offering a 10% increase in maximum capacity.

Furthermore, Turbo- B® tubes are a drop-in replacement whereas alternate commercial tube designs would require extensive modifications to the Navy A/C plant heat exchanger design, which would result in an additional cost to the Government and unacceptable delays in fulfilling the agency’s requirements.

The essential detailed design data for the Turbo-B® line of tubes is proprietary to Wieland.

Wieland developed all of the detailed design information, which includes information on manufacturing procedures and methods and inspection and testing techniques and procedures.

Wieland has indicated that it is not interested in selling the required data or data rights, since the data rights associated with this equipment also have a commercial application. In addition to technical data, Wieland is the only source possessing the required special tooling and test equipment to manufacture and certify the material specified under the proposed contract.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

This Justification and Approval (J&A) will be posted along with a combined synopsis/solicitation on the SAM Beta website in accordance with FAR 13.501(a)(1)(iv). Any responses received will be evaluated upon the vendor’s ability to provide the requested material as an authorized reseller.

Market research was conducted through a survey and analysis of alternative equipment brands that are available in Industry. The thorough analysis conducted reviewed the available brands to see if there were any possible alternatives. At this time, no other brand name equivalents exist to satisfy the Government’s need. Additionally, a Sources Sought notice was posted to SAM.beta.gov on 21 February 2020. To date, two resellers of Wieland responded stating they could provide the items being requested.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will make a determination as to whether the cost to the Government for the supplies covered by the J&A are fair and reasonable prior to award. The Contracting Officer expects adequate price competition from authorized resellers and will use cost and pricing analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Competition

NSWCPD will continue to monitor the marketplace and identify potential sources of the supplies identified in this J&A. Any sources discovered that could potentially satisfy this specific procurement will be taken into account for any future requirements.
