This justification is based upon the statutory authority of 41 U.S.C. 1901, as implemented by Federal Acquisition Regulation Subpart 13.5

If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources are available, A/RMCs 1 or 2 are valid.

History the OEM, SAFRAN CAGE 1TQN0. This item commercial common to the Boeing 737 and or offered for commercial sale with a commercial item description, a commercial vendor catalogue/ price list and has a commercial technical manual assigned. This item does not have a criticality determination as the part is a commercial FAA governed item and SAFRAN is the only capable source with access to the technical data required to manufacture, test and certify that it is airworthy prior to delivery to the Navy. In the absence of a Government assigned criticality code, it is imperative that the Government deal strictly with the OEM for procurement of this item. The Government does not physically have in its possession any engineering or technical data to contract for spares with other than the OEM at this time. The Government does not have the empirical engineering data available that would allow for realistic competitive sustainment efforts at this time. Furthermore, NAVSUP WSS is obligated to follow the supply support strategy as outlined in the attached NAVAIR program office, PMA- 290 letter, 5000 Ser PMA-290/128 dated Dec 07 2018.

The proposed contract action was synopsized in the government-wide point of entry on 01/19/2023

The following sources have expressed an interest, in writing, in this acquisition

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

For the item(s) listed on this J&A, Market research identified the OEM as SAFRAN (1TQN0) and they are the sole responsible source with the technical data, tooling and equipment necessary for the manufacture of

it. In addition, due to the sourcing restrictions imposed by NAVA R PMA-290 letter, 5000 Ser PMA-290/128 dated Dec 07 2018, Market Research is limited to identifying and contracting only with the OEM, the designated distributor of the OEM or the Prime Aircraft manufacturer Boeing and for the reasons discussed in paragraph 5 above, no additional market research was conducted because it is not practicable for any other source to provide the required material to the Government.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

To promote competition the NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also future requirements will be advertised in the government-wide point of entry in order to encourage potential vendors to submit Source Approval Requests. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible.
