Sample Justification for Other Than Full and Open Competition, Lease Extension

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PROJECT NUMBER: 1FL2432

Agency Name: Social Security Administration (SSA)

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The SSA currently leases 13,731 Rentable Square Feet (RSF) with a Common Area Factor (CAF) of

1.04, yielding 13,203 ANSI BOMA Office Area square feet (ABOA). The Location Code is: (FL3087ZZ)

1201 East Oak Street, Kissimmee, FL, 34744-5583, under lease number GS-04B-43139. The current lease expires April 17, 2022.

Approval is requested to extend the current lease for one and a half (1.5) years (18 months) with the incumbent lessor without full and open competition for continued occupancy at this leased location. The agency will be relocating to another location and this additional time is required to design and construct the new location. Additionally, the extension will avert the Government from placing itself in a high risk holdover situation and occupying space without the proper lease contract in place. The procedures for pursuing a lease extension are detailed in GSAR 570.405: Lease Extension.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

(INCLUDING ESTIMATED VALUE).

SSA submitted a continuing occupancy agreement on 7/26/2021 for 13,731 rentable square feet of office and related space. To satisfy the SSA mission requirements, the facility must be within the congressional area of responsibility. There is no vacant Federal Space available.

The short term requirement is for a 1.5 year extension. The estimated cost is:

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.405.

4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location. GSAR 570.405(c) The Government unexpected delays outside of its control in acquiring replacement space. Multiple market surveys and projects advertisement had to be conducted to arrive at the lease award for the new location.

Furthermore the SSA has encountered delays in the Design Intent Drawing (DID) process that added another 120 days to the post award phase to design the new location.

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Market research was performed on 8/3/2021 using CoStar, LoopNet and Bullseye, to identify a rental rate market range for the agency’s immediate space requirements of 13,731 RSF (13,302 ABOA) of contiguous space. The standard procurement time frame to award and to buildout a new space is 24 to

36 months. The current lease will expire in less than 7 months. It would be impractical and unreasonable to relocate SSA to another location before the current lease expiration date of 4/17/2022. The

Government will not be able to award a new lease and buildout space that include FEI windows, customer waiting area, demountable walls, conference and training rooms, employee restrooms, LAN rooms, CCTV, IDS, and duress alarms in 7 months.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market research conducted by the Lease Contracting Officer in Kissimmee, Florida showed the rental rate ranges for a fully serviced lease. CoStar, Bullseye target, and the GSA lease portfolio were used to establish this rental range.

Therefore, the proposed rental rates for this lease extension of are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

SSA has occupied the above referenced space under Lease No. GS-04B-43139 since April 18, 2005. Full and open competition is being conducted under the long-term procurement Project 5FL0388 and this short-term extension is required to facilitate that long-term procurement.

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

In advance of an existing lease contract’s expiration, considerations will be given to allow for sufficient time to conduct a full and open procurement. The Government will consider the time and cost of moving from the existing location, and the time and cost to build out new space when deciding whether it is economically advantageous to stay at the existing building or undergo a competitive action.

Additionally, consideration will be given to the customer agency’s mission and security requirements (if applicable) to include limiting any agency space requirements that may be deemed unduly restrictive and thus favor the incumbent. The Government will remain conscious of the effort to continuously encourage competition when practicable.

11. CONTRACTING OFFICER CERTIFICATION.
