Questions and Answers Solicitation No. 19UP3019Q0031 Rental of Shooting Range Complex

Question 1. Reference 1. SECTION 1 - THE SCHEDULE, DESCRIPTION/ SPECIFICATIONS/ WORK STATEMENT, clause 1. b) says: "Underground construction certified for live fire exercises. Safety measures/requirements: walls, ceiling and flooring constructed/equipped so that they can absorb live fire ammo energy to prevent penetration and ricochet.". Would the Government consider changing RFQ wording to "Indoor construction certified for live fire exercises. Safety measures/requirements:

walls, ceiling and flooring constructed/equipped so that they can absorb live fire ammo energy to prevent penetration and ricochet." This will provide the following:

- given the limited number of underground shooting range facilities in Ukraine fitting original requirements, this change will increase the level of full and open competition, resulting in more competitive price offer;

- better air conditioning compared to underground facility;

- similar or better level of safety and comfort during training in different temperature ranges in summer and winter.

Answer: The Amendment #0001 of solicitation was issued to revise paragraph 1(b) in Section 1, SCHEDULE OF SUPPLIES/SERVICES, BLOCK 20, DESCRIPTION/ SPECIFICATIONS/ WORK STATEMENT. The facility for firearms and tactical trainings can be underground or indoor construction certified for live fire exercises.

Question 2. SECTION 1 - THE SCHEDULE, DESCRIPTION/SPECIFICATIONS/WORK STATEMENT, clause 1. c) says: "Two shooting ranges next to each other: one long (100 m) and one short (50 m) galleries.". Would the Government consider changing RFQ wording to "Minimum two shooting ranges: one long (100 m) and one short (50 m) galleries. Short gallery can be smaller if interactive/multimedia equipment allows shooting with effect similar to 50 m gallery". Given the limited number of shooting range facilities in Ukraine fitting original requirements, this change will increase the level of full and open competition, resulting in more competitive price offer.

Answer: The Amendment #0001 of solicitation was issued to revise paragraph 1(c) in Section 1, SCHEDULE OF SUPPLIES/SERVICES, BLOCK 20, DESCRIPTION/ SPECIFICATIONS/ WORK STATEMENT. Minimum two shooting ranges next to each other are required: one long (100 m) and one short (50 m) galleries. However, multimedia/interactive equipment is not required, and availability of at least one 100m and one 50m galleries is a specific requirement.

Question 3. SECTION 1 - THE SCHEDULE, DESCRIPTION/SPECIFICATIONS/WORK STATEMENT, clause 4. Could the Government provide historical data on actually ordered hours in the 2017 and 2018 contracts for the rental of shooting range, gym, and classroom respectively?

Answer: Rental of shooting range in 2017/2018 – 404 hours, rental of gym in 2017/2018 – 96 hours; rental of shooting range in 2018/2019 – 1,250 hours; rental of gym in 2018/2019 – 500 hours; rental of classroom in 2018/2019 – 70 hours.

Question 4. SECTION 1 - THE SCHEDULE, DESCRIPTION/SPECIFICATIONS/WORK STATEMENT, clause 4. Could the Government provide historical data on training schedule in the 2017 and 2018 contracts, e.g., three times a week - full day sessions, or continuous weekly sessions every first and third week of each month, etc.

Answer: The historical data is not helpful in this case, since training requirements and schedules change every year. Please be advised that trainings usually take at least 4 hours a day and 10-20 days a month. Schedules will be provided to the Contractor 10-15 days before beginning of the next month.

Question 5. SECTION 1 - THE SCHEDULE, I. PERFORMANCE WORK STATEMENT, clause C.

What are the expected award and contract start dates?

Answer: We anticipate that the contract will be effective in September 2019. However, the contract award date depends on the number of received quotes and duration of evaluation process.

Question 6. SECTION 3 - SOLICITATION PROVISIONS, clause A.2.(2) says: "The copies of legal documents may be submitted in the original language, but must be accompanied by an English translation.". Could the Government confirm, that notarized translation is not required and translated documents without notarization will be considered acceptable?

Answer: General translation of copies of legal documents is acceptable. The notarized translation of documents is not required.

Question 7. SECTION 3 - SOLICITATION PROVISIONS, clause A.2.(5) requires "Financial statement for the one last year". Could the Government confirm, that financial statements provided in UAH in original language accompanied by an English translation without notarization will be considered acceptable?

Answer: General translation of financial statement is acceptable. The notarized translation of documents is not required.

Question 8. SECTION 3 - SOLICITATION PROVISIONS, clause A.2.(8) says: "If offeror already possesses the locally required licenses and permits, a copy shall be provided.". Could the Government confirm, that English translation is not required for the licenses and permits and the documents provided in Ukrainian language will be considered acceptable?

Answer: General translation of licenses and permits is acceptable. The notarized translation of documents is not required.

Question 9. SECTION 5 - REPRESENTATIONS AND CERTIFICATIONS, 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018), clause (b).

Should the Offeror's NAICS Code match the solicitation/contract NAICS (713990 - All Other Amusement and Recreation Industries)?

Answer: Offeror’s NAICS Code may not match NAICS code of services indicated in the solicitation.

Question 10. SECTION 1 - THE SCHEDULE, I. PERFORMANCE WORK STATEMENT, clause C.

Could the Government confirm, that notification of award will be published on fbo.gov website?

Answer: All offerors will be provided with the information on results of solicitation, and Award Notice will be posted on www.fbo.gov .
