JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)
1. I recommend that U. S. Embassy Jakarta use other than full and open competition for the acquisition of LE Staff Health Insurance services covering the period of 6 (six) months from February 1, 2023, to July 31, 2023. The estimated cost is $1,300,000.00
2. Nature and/or description of the action being approved. This six-month contract is being awarded to the incumbent contractor PT Asuransi Jasa Indonesia (Jasindo) to continue services beyond the date of contract number SID320117D0005. Post has encountered significant delays in the current solicitation process and, therefore, needs to award the six-month contract to allow sufficient time to complete a new solicitation process.
3. A description of the supplies or services required to meet the agency’s needs.
Comprehensive Locally Employed Staff (LES) health insurance services including in and outpatient care, preventive, dental, optical, maternity, and HIV.
4. An identification of the statutory authority permitting other than full and open competition. 41 USC 253(c)(2), FAR 6.302-2, Unusual and compelling urgency
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited). Jasindo is the current contractor with sufficient knowledge on health insurance requirements to meet the technical and operational requirements for this six
(6) month contract. The contractor has been performing satisfactory on their current contract for the last five (5) years.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a SAM.gov notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70) FAR 5.202 (a) (2).
The current contractor has requested economic price adjustment, showing the current premium was comparable with market conditions.
7. A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
The bi-weekly premium for each category of this emergency contract are the same as bi-weekly premium on Option Year 4 of the current contract, which were obtained using full and competition procedures, and therefore, determined as fair and reasonable. In addition, the Contracting Officer performed an extensive cost analysis, including economic price adjustment, and determined that the pricing was in line with current market condition.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
A market survey was conducted for this six (6) months contract, and still we found the current contractor is in place with sufficient knowledge of the LES Heath insurance and has performed satisfactory for the last five years. The contractor already has established accounts for all the Embassy employees and their dependents.
The delay to bring in another contractor to perform could be the cause of interrupted services for our employees and their dependents and this is unacceptable to the government.
9. Any other facts supporting the use of other than full and open competition. Based on the projected timelines and considering both local and U.S. calendars, in addition to the challenges of a 12-hour time differential with Washington, DC, Post anticipates an award within the six months extension timeframe.
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.
Since the requirement was not advertised nor did we perform any market surveys for this requirement , no sources expressed an interest in this requirement.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. An RFP 191D3-22-R0016 for follow-on services was issued on August 15, 2022 on SAM.gov. However, after the solicitation was issued it was discovered that some of the benefit levels are incorrect. Based on the changes required to the benefit levels and the age of the solicitation the A/OPE/GAM Desk Officer advised to cancel the solicitation and an amendment was issued to cancel this solicitation. This will allow post to work with GTM/OE on the correct benefit levels for employees and their dependents for Indonesia. This will allow post to draft a new solicitation with the correct benefit levels for a base plus four (4) option years and will be issued on SAM.gov for full and open competition
