FOB: Preliminary inspection of the machine shall be at Origin by DLA Aviation with final inspection and acceptance at destination by DLA Aviation upon completion of installation at the customer’s facility by the contractor.

Fifteen days’ advance notification is requested to be given to DLA-Aviation prior to each inspection if in the United States. Thirty-day notification is requested for overseas locations.

Preliminary inspection of the machine, IUID Tags and technical data shall be at Origin by DLA Aviation with final inspection and acceptance at destination by DLA Aviation upon completion of installation at the customer’s facility by the contractor. The QAP requires fifteen (15) business days advance notice of each origin inspection. DLA-Aviation requests that you provide thirty (30) days advance notification for each oversea inspection.

The freight cost in this contract will be a Not to Exceed amount. This is a firm-fixed-price contract, and the funding cannot be adjusted upward after award. Freight for this contract will be paid based on the actual costs only.

All payment requests for freight shall be accompanied by actual invoices. Payment requests for freight without actual invoices will be denied.

Special Notes Continued:

1. The Performance Period/Completion Date for all items is 365 days after receipt of order. Refer to the completion date reference in Line Item number one. If any line items do not contain a delivery/completion date the date in Line Item one shall apply.

2. There will be at least a minimum charge of $2,500.00 for each re-inspection that has to be performed by the government due to machine not ready for inspection.

3. All questions and issues shall be addressed to the Contract Administrator assigned to this contract. Per FAR clause 52.247-27, Solicitations Not Affected by Oral Agreement, no oral statement of any person shall amen or otherwise affect the terms, conditions or specifications stated in the solicitation or contract. All amendments to the solicitation or modifications to the contract must be made in writing by the Contracting Officer, who is the ONLY individual authorized to make changes on behalf of the Government.

4. Upon completion of all contractual requirements, the vendor must submit a Material Inspection and Receiving Report Form DD250 for signature by the Government representative. The signed DD250 must be submitted DLA Aviation-VICA via email to avniperweb@dla.mil.

5. Packaging/Marking is to be accordance with latest revision of ASTM-D-3951-10.

6. The entire solicitation and amendment 0001 to amendment 0003 is hereby incorporated into the contract by reference (solicitation-only clauses are self-deleting).

7. Quality Assurance Provision (QAP) Number 175 shall apply. Coordination with the Administrative Contracting Officer to schedule inspection at origin is critical. It is the vendor’s responsibility to make arrangements for the origin inspection a minimum of 15 days prior to expected shipment date.

8. The contract will be administered by DLA Aviation, Richmond.

9. Hartech Group is requesting Installment Payments and the bonds will be submitted 10 days after contract award.

10. A Post Award Conference will be held within 60 days after award of contract.

52.246-9061 WARRANTY OF INDUSTRIAL PLANT EQUIPMENT (IPE) – FSG 34 (SEP 2008) – DLAD

(a) Definitions: "Acceptance," as used in this clause, means the act of an authorized representative of the Government by which the Government assumes for itself, or as an agent of another, ownership of existing and identified supplies, or approves specific services rendered, as partial or complete performance of the contract. "Supplies," as used in this clause, means the end items furnished by the Contractor and related services required under this contract. The word does not include "Data."

(b) Contractor's obligations.

(1) The Contractor warrants that for one (1) year all supplies furnished under this contract will be free from defects in material and workmanship and will conform with all requirements of this contract. Warranty period begins from the date of acceptance.

(2) Any supplies or parts thereof corrected or furnished in replacement by the Contractor shall be subject to the conditions of this clause to the same extent as supplies initially delivered. This warranty shall be equal in duration to that set forth in paragraph (b)(1) of this clause and shall run from the date of delivery of the corrected or replaced supplies.

(3) When the machine is inoperable because of a defect, deficiency and/or nonconformance subject to the Contractor's warranty and after the Contractor has received written notice of the defect, deficiency or nonconformance, the warranty shall be extended for the time period during which the machine was inoperable (i.e., length of time from when Contractor receives notification until machine is operable.)

(4) The Contractor shall not be obligated to correct or replace supplies if the facilities, tooling, drawings, or other equipment or supplies necessary to accomplish the correction or replacement have been made unavailable to the Contractor by action of the Government. In the event that correction or replacement has been directed, the Contractor shall promptly notify the Contracting Officer, in writing, of the nonavailability.

(5) The Contractor shall also prepare and furnish to the Government data and reports applicable to any correction required (including revision and updating of all affected data called for under this contract) at no increase in the contract price.

(6) When supplies are returned to the Contractor, the Contractor shall bear the transportation costs from the place of delivery specified in the contract (irrespective of the f.o.b. point or the point of acceptance) to the Contractor's plant and return. When defective items are returned to the Contractor from other than the place of delivery specified in the contract, or when the Government exercises alternate remedies, the Contractor's liability for transportation charges incurred shall not exceed an amount equal to the cost of transportation by the usual commercial method of shipment between the place of delivery specified in the contract and the Contractor's plant and subsequent return.

(7) The warranties expressed herein are in lieu of any implied warranties of merchantability and "fitness for a particular purpose."

(c) Remedies Available to the Government.

(1) In the event of a breach of the Contractor's warranty in paragraph (b)(1) and (b)(2) of this clause, the Government may, at no increase in contract price-

(i) Require the Contractor, at the place of delivery specified in the contract (irrespective of the f.o.b. point or point of acceptance) or at the Contractor's plant, to repair or replace, at the Contractor's election, defective or nonconforming supplies, or

(ii) Require the Contractor to furnish at the Contractor's plant the materials or parts and installation instructions required to successfully accomplish the correction.

(iii) Where it is impracticable for the Government to pursue remedies at (i) and (ii), the Government may arrange for the repair or replacement of defective or nonconforming supplies by the Government or by another source at the Contractor's expense. Where the Government is to accomplish the repair, the Contractor at the Government's option will furnish the material or parts and the instruction required to successfully accomplish the repair.

(2) If the Contracting Officer does not require correction or replacement of defective or nonconforming supplies or the Contractor is not obligated to correct or replace under paragraph (b)(4) of this clause, the Government shall be entitled to an equitable reduction in the contract price.

(3) The Contracting Officer shall notify the Contractor in writing of any breach of the warranty in paragraph (b) of this clause within a reasonable period, but not later than 45 days after discovery of the defect. The Contractor shall submit to the Contracting Officer a written recommendation within 2 working days as to the corrective action required to remedy the breach. After the notice of breach, but not later than 5 days after receipt of the Contractor's recommendation for corrective action, the Contracting Officer may, in writing, direct correction or replacements in paragraph (c)(1) of this clause, and the Contractor shall, notwithstanding any disagreement regarding the existence of a breach of warranty, comply with this direction within 5 days of receipt. If it is later determined that the Contractor did not breach the warranty in paragraph (b)

(1) and (b)(2) of this clause, the contract price will be equitably adjusted.

(4) If supplies are corrected or replaced, the period for notification of a breach of the Contractor's warranty in paragraph (c) of this clause shall be 45 days from the discovery of the defect.

(5) The rights and remedies of the Government provided in this clause are in addition to and do not limit any rights afforded to the Government by any other clause of the contract.

(6) The Contractor shall be liable for the reasonable costs of disassembly and/or reassembly of larger items when it is necessary to remove the supplies to be inspected and/or returned for correction or replacement.

Warranty terms shall be in accordance with the Warranty Clause 52.246-9061, WARRANTY OF INDUSTRIAL PLANT EQUIPMENT (IPE) – FSG 34 cited above.

(a) Applicability. This clause does not apply to the extent that the Contractor is supplying end products mined, produced, or manufactured in --

(1) Israel, and the anticipated value of the acquisition is $50,000 or more;

(2) Mexico, and the anticipated value of the acquisition is $83,099 or more; or

(3) Armenia, Aruba, Australia, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Korea, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan, Ukraine, or the United Kingdom and the anticipated value of the acquisition is $182,000 or more.

(b) Cooperation with Authorities. To enforce the laws prohibiting the manufacture or importation of products mined, produced, or manufactured by forced or indentured child labor, authorized officials may need to conduct investigations to determine whether forced or indentured child labor was used to mine, produce, or manufacture any product furnished under this contract. If the solicitation includes the provision 52.222-18, Certification Regarding Knowledge of Child Labor for Listed End Products, or the equivalent at 52.212-3(i), the Contractor agrees to cooperate fully with authorized officials of the contracting agency, the Department of the Treasury, or the Department of Justice by providing reasonable access to records, documents, persons, or premises upon reasonable request by the authorized officials.

(c) Violations. The Government may impose remedies set forth in paragraph (d) for the following violations:

(1) The Contractor has submitted a false certification regarding knowledge of the use of forced or indentured child labor for listed end products.

(2) The Contractor has failed to cooperate, if required, in accordance with paragraph (b) of this clause, with an investigation of the use of forced or indentured child labor by an Inspector General, Attorney General, or the Secretary of the Treasury.

(3) The Contractor uses forced or indentured child labor in its mining, production, or manufacturing processes.

(4) The Contractor has furnished under the contract end products or components that have been mined, produced, or manufactured wholly or in part by forced or indentured child labor. (The Government will not pursue remedies at paragraph (d)(2) or paragraph (d)(3) of this clause unless sufficient evidence indicates that the Contractor knew of the violation.)

(d) Remedies.

(1) The Contracting Officer may terminate the contract.

(2) The suspending official may suspend the Contractor in accordance with procedures in FAR Subpart 9.4.

(3) The debarring official may debar the Contractor for a period not to exceed 3 years in accordance with the procedures in FAR Subpart 9.4.

SCOPE.

Scope. The content of this specification describes the minimum requirements for two

(2) Computer Numeric Control (CNC) Vertical Grinders to be installed at the Fleet Readiness Center South East (FRCSE) Jacksonville, Florida. The contractor shall provide complete installation services as described herein and be responsible for the operation and interfacing of the end item systems. The machine described in this document is intended for use in the aerospace manufacturing and repair industry.

Order of Precedence. In the event of a conflict between the text of this document and the references cited herein, the text of this document takes precedence. Nothing in this document, however, supersedes applicable laws and regulation unless a specific exemption has been obtained.

REQUIREMENTS.

Design. The item offered shall be new and a current commercially available model. A current model is defined as the manufacturer’s currently produced model which, on the date this solicitation is issued, has been designed, engineered, sold or is being offered for sale through advertisements or manufacturer’s published catalogue or brochures. Products such as a prototype unit, pre-production model, or experimental unit do not qualify as meeting the requirements specified herein. The machine shall include all components, parts, and features necessary to meet the performance requirements specified herein. All parts subject to wear, breakage or distortion shall be accessible for adjustment, replacement, and repair.

Measuring and Indicating Device Graduations. All measuring and indicating devices on the machine shall be graduated in the inch/pound.

Controls. All electrical, mechanical, hydraulic, and pneumatic operating controls shall be located convenient to the operator's work station(s).

Safety and Health Requirements. All machine parts, components, mechanisms, and assemblies furnished on the machine, whether or not specifically required herein, shall comply with all of the requirements of OSHA 29 CFR 1910.

Safety Guarding. Covers, guards, or other safety devices shall be provided per ANSI B11.9. The safety devices shall not interfere with the operation of the machine. The safety devices shall prevent unintentional contact with the guarded part, and shall be easily removed to facilitate inspection, maintenance, and repair of the parts.

Audible Noise Level. Audible noise emitted by the equipment shall not exceed 84 decibels (dB), measured on the “A” weighted scale of a standard Type II sound level meter, at the operator's work position or any point at a distance of three (3) feet from the

19-20-1201 SPE4A8-21-P-0043 Page 4 of 104 equipment. Noise generated by the work piece shall be excluded in determining compliance of the equipment with the 84 dB requirements.

Mercury Restriction. The machine shall not contain mercury or mercury compounds nor be exposed to free mercury during manufacture with the exception of fluorescent lighting where required.

Asbestos Restriction. Asbestos and materials containing asbestos shall not be used on or in the machine.

Lead. Lead and materials containing lead shall not be used on or in the machine with the exception to radiation cladding and lead solder in circuits.

Use of Polychlorinated Biphenyl (PCB). The use of polychlorinated biphenyl (PCB) on or in the equipment is prohibited. The machine shall be considered PCB free providing certification to be verified containing less than 5 parts per million (<5ppm) in accordance with 40 CFR part 761.

Environmental Protection. Under the operating, service, transportation, and storage conditions described herein, the machine shall not emit materials hazardous to the ecological system as prohibited by Federal, state, or local statutes in effect at the point of installation.

Lubrication. Means shall be provided to ensure adequate lubrication (oil, grease, coolant, etc.) for all moving parts. Recirculating lubrication systems shall include a filter that is cleanable or replaceable. Each lubricant reservoir shall have at least a 24-hour capacity. Means shall be provided to indicate a low lubrication condition. When a low lubrication condition occurs, the machine shall complete the current operation and come to a complete stop. The machine shall indicate that lubrication is required and the designated personnel shall refill the lubrication reservoirs according to machine manuals. All oil holes, grease fittings, and filler caps shall be easily accessible.

Replacement Parts. All parts subject to replacement shall be manufactured to definite dimensions and tolerances. Replacement parts shall be interchangeable without requiring modification. Replacement parts are those that are subject to wear or failure such as gears, bearings, shafts, feed screws, drive belts, pumps, and seals. Electrical replacement parts shall include but not be limited to, motors, relays, fuses, switches, magnetics, pushbuttons, light bulbs, braking mechanisms, and solid-state devices. Tooling and accessories normally supplied as standard items shall also be considered replacement parts.

Construction. The machine shall be constructed of parts that are new, without defects, and free of repairs. The structure shall withstand all forces encountered during operation of the machine to its maximum rating and capacity without distortion.

Castings and Forgings. All castings and forgings shall be free of defects, scale, and mismatching. No processes such as welding, peening, plugging, filling with solder or paste shall be used for reclaiming any defective part.

Fastening Devices. All screws, pins, bolts, and other fasteners shall be installed to prevent unintentional loosening. Fastening devices subject to removal or adjustment shall not be permanently installed.

Threads. All threaded parts used on the machine and its related attachments and accessories shall conform to FED-STD-H28A and the applicable “Detailed Standard” section referenced therein.

Gears. All gears of axis drive trains shall conform to or exceed all provisions of AGMA 2001-C95, AGMA 2011-A98, and AGMA ISO 1328-1-B14. All gears shall be of proper width and size to transmit full-rated torque and horsepower throughout the speed ranges without failure for the expected service life of the machine. Gears in drive trains shall be hardened and ground steel.

Surfaces. All surfaces shall be clean and free of harmful or extraneous materials. All edges shall be either rounded or beveled unless sharpness is required to perform a necessary function. The condition and finish of all surfaces shall be in accordance with the manufacturer's commercial practice.

Welding, Brazing, or Soldering. Welding, brazing, or soldering shall be employed only where specified in the original design. None of these operations shall be employed as a repair measure for any defective part.

Painting. The machine shall be painted in accordance with the manufacturer’s commercial practice. All paint shall be of the lead free type.

Workmanship. Workmanship of the machine shall meet all requirements specified herein and shall be of a quality equal to that prevailing among manufacturers producing equipment of the type covered by this purchase description.

Components. The machine shall consist of not less than the following components:

Base. The base shall be a stress relieved, heavy duty, ribbed casting or steel weldment having characteristics that minimize both thermal and vibration effects, while providing the strength and size to assure maximum rigidity and support for any load within the rated capacity of the machine. Means shall be provided for accurate, ease of leveling.

Table. The worktable shall be a casting of iron, or iron alloy, internally ribbed and proportioned to support and withstand the maximum capacity work-piece weights and tool thrust loads. A direct drive AC servomotor, protected by the table housing, shall provide the drive for the table. The table shall have eight (8) radial T-slots for fixture location. The size and configuration of the T-slots shall be in accordance with ANSI B5.1M. The table and base shall be designed to preclude fluid intrusion into critical components with air purging. The table shall be configured to supply coolant thought the center of table.

Machine Ways. Machine ways shall be hardened. The ways shall be of a type suitable for high grade precision numerically controlled machines covered by this purchase description. Movement of the slides on the way surfaces shall be through adjustable

19-20-1201 SPE4A8-21-P-0043 Page 6 of 104 preloaded, re-circulating roller bearing cartridges or nonmetallic way liners having a low coefficient of friction, with excellent slip-stick and damping properties. Protection of the machine ways shall be either telescoping or curtain type way covers equipped with way wipers.

Axes. All axes of the machine shall be actuated through a closed loop, high-gain electrical servo mechanism driving re-circulating ball screws and nuts. Infinitely variable feed drives shall be provided for all axes. Axes shall be machined to accept way bearings of a precise fit to their respective ways. All ball screws shall be of the double nut design meeting the requirements of ASME B5.48 Class 3, and equipped with seals to exclude foreign material and prevent loss of lubricant. Axis description shall conform to TIA-267- C. Linear AC digital servo for axis drives will also be acceptable.

Power rapid Traverse. Powered rapid traverse shall be provided for movement of all axes. The rate of rapid traverse shall be independent of any feed adjustment.

Spindle. The contractor shall provide a precision grinding spindle. The spindle shall be equipped with ultra-precision balanced pre-loaded bearings. A precision balanced AC motor shall be incorporated into the spindle. The spindle shall be designed and manufactured with good vibration damping characteristics. The grinding spindle shall be designed for operation in both, abrasive dust and wet environment conditions. The diameter of the spindle shall not exceed 8 inches.

Spindle Swivel. The spindle swivel (B axis) shall be CNC driven with dual worm gears so the system can be preloaded electrically. The swivel shall be supported by roller bearing for maximum support. Positioning feedback shall be by direct mounted absolute rotary encoders. The system shall be sealed and air purged to prevent high coolant flow from entering the system.

Wheel Dresser and Holder. The machine shall include a mounted wheel dresser unit. The dresser shall utilize a single point diamond and a motor driven diamond disc.

Coolant shall be directed at the point of wheel dress, and switched on and off through the CNC unit in addition to the automatic cycle. Wheel dressing compensation shall be automatic, and the dressing cycle controlled by the CNC. Programmable contour dressing wheel shall be provided. The system shall be sealed and air purged to prevent high coolant flow from entering the system.

Tool Changer. The tool changer shall be fully automatic, servomotor driven, and fitted with a positioning encoder. The automatic tool changer shall store not less than ten

(10) tools. The tool magazine shall be a dual layer system with 10 tools on the lower level and 5 tools on the upper. The lower will hold the HSK40 tool and the upper the HSK63.

The storage magazine or tool turret shall permit loading and unloading of grinding wheels, coolant nozzles and part measurement probe. The tool changer shall be arranged for random tool selection, and shall reuse tools that have been returned to the magazine after a program operation. The tool changer shall be integrated into the machine control system together with tool identification coding.

Quick Change Tool Receiver. A quick-change tool receiver shall be mounted to the B-Axis. This allows the ability to purchase standard turning tools and when used with a tool changer, allows for multiple turning tools to be utilized for different operations. The static spindle shall be supplied with an HSK 63 interface. The turning spindle and grinding spindle shall be mounted to the B-Axis. The turning spindle is 180 degrees from the grinding spindle. The B-Axis shall be a dual worm drive with a resolution of .02 arc seconds and a run-out both radially and axially of .0001”.

Measurement System. Resolution, accuracy and repeatability in accordance with the requirements in 3.5, Table II. Data from the measurement system shall be stored in a database, and shall be downloaded to the printer.

Enclosure. The machine shall be fully enclosed and shall be manufactured of steel.

The manufacturer shall minimize the panels that have to be removed for operator of machine maintenance personnel to perform routine maintenance functions. The enclosure shall contain the coolant mist and isolate the grinding operation from the machine operator.

A wash down hose to clean parts inside the enclosure shall be provided.

Doors. Doors shall retract fully in front and overhead to allow full access to the work holding surface with an overhead crane. The machine shall have an air blasting system to keep the operators viewing window clear from coolant splash. The doors shall be fitted with interlocks to prevent the operator from opening the doors during automatic operation of the machine. The interlock shall be designed to withstand the atmosphere within the enclosure without premature failure due to coolant contaminants. The machine shall have the capability to operate manually for operation set-up when the doors are in the open position.

Column. The column shall be an iron casting or equal, internally ribbed and braced to minimize distortion and defection under normal loads. The column shall be of the sliding type, designed to support and accommodate the grinding head and spindle drive mechanism. Column slides and screws shall be shielded and protected from foreign contamination by either telescoping or curtain type way covers and wipers.

Coolant System. The machine shall be supplied with a complete flood type coolant system with CNC selection of on/off coolant flow. The coolant system shall be a single stage system, with a paper filter. The contaminated coolant shall flow through the paper filter to remove ferrous particles and deposit grinding swarf in a hopper. The system shall contain power driven pumps, and all necessary piping to deliver at a minimum pressures of 40 psi of coolant. The sump or reservoir shall have a 200-gallon capacity to permit full flow of coolant. The system shall have means for draining and cleaning and shall include a baffle or a removable strainer for ease of cleaning. Means shall be provided to permit delivery of coolant onto each tool holder, allowing the operator to direct and control the amount of coolant to point of application. An air to water type coolant chiller shall be provided to maintain optimum coolant temperature of 68 degrees +/- 3 degrees.

Hydraulic System. The hydraulic system and all components shall conform to ISO 4413. The system shall be complete, including all pumps, valves, piping, cylinders, and pressure controls.

Pneumatic System. The pneumatic system and all components shall conform to

ISO 4414. The system shall be complete, including all pumps, valves, piping, cylinders, and pressure controls.

Electrical System. The machine shall conform to NFPA 79. The existing source power available at the facility is 480 volt, 3-phase, 60 Hertz (Hz). The machine’s electrical system shall be tolerant of fluctuation of ± 10 percent. The electrical system shall be complete, including any electrical transformer(s) that may be required to modify the existing source voltage to the proper operating voltage of the equipment. A properly rated, and fused, single disconnect device shall be utilized on the machine with means of lockout in the off position only. The machine shall have a standard two (2) plug 110 volt 1 phase 60 Hertz outlet at the operator work station.

Electrical Enclosures. Construction of the electrical enclosures shall conform to NEMA ICS 6 standards. The enclosure shall be a NEMA type 12 and shall provide for ventilation of components and shall be designed for an indoor non-hazardous location. All electrical components shall conform to applicable NEMA ICS 1 standards. The machine shall be provided with interlocks on its electronic cabinet that shall instantly remove power from the equipment when the door is opened in accordance with NFPA 79. The electrical enclosure shall be atmospherically controlled with an air-conditioning unit, controlling humidity and temperature per UFC 1-200-01, condensate lines shall be plumbed to the coolant tank.

Arc Flash Protection. The machine enclosures shall be marked for arc flash in accordance with NFPA 79 Paragraph 16.2.3 “Safety Signs for Electrical Enclosures” for arc flash safety.

Solid-State Components. Electrical devices used to power electrical servo and spindle motors of control voltage delivered to solid-state electrical components shall be solid-state devices. Such devices shall handle the electrical load imposed by operation of the machine to its maximum capability. The use of selenium in solid-state components shall be restricted to those devices that protect other solid-state components from voltage surge.

Controller Features. The machine controller shall consist of a Fanuc 32io series CNC Control or newer, incorporating all standard features.
