PURPOSE

The contractor shall provide a satellite television service agreement to the following Albuquerque Area Indian Health Service Facilities:

Mescalero Service Unit 318 Abalone Loop Mescalero, New Mexico 88340

Acquisition will be for one base year and 4 one year option years.

DESCRIPTION OF SERVICES/SUPPLIES

The contractor shall be in accordance with all Federal, State, Local, Tribal and IHS regulations and shall be made with minimal divergence from the schedule established and with minimum disturbance and maximum protection of government personnel, property and general public.

The contractor shall provide all transportation, fuel, personnel, equipment, tools, materials, supervision, and other items and services necessary to provide a satellite television service agreement with the following specifications:

• The Contractor will provide satellite subscription television service at the Mescalero Service Unit.

• 12 televisions hookups will be required under this scope of work.

• The Contractor shall provide all parts, new equipment, materials, labor, supervision, test equipment, maintenance service, technical manuals and transportation necessary to install equipment and provide and maintain satellite television programming subscription service.

• No government equipment will be provided under this contract except the connection point to the TV distribution system and electricity service/connection.

• MAINTENANCE AND SUPPORT

o Maintenance and support will begin after the installation and testing is complete and accepted by the MSU.

Maintenance and support will be provided throughout the option year periods, if exercised by the Government.

o The Contractor shall provide 24 hour /365 day user support through a call center.

o The Satellite television service shall be available to a user on a 24 hour, 7 days a week, 365 days a year.

o Maintenance shall be scheduled during off peak hours.

o The Contractor shall provide 24 hour/365 day technical support.

o The Contractor shall provide on-site support when required by the MSU.

o The Contractor shall physically respond onsite within 24 hours for issues that require onsite support.

o Contractor shall notify the COR at a minimum four hours prior to any onsite scheduled or repair work.

DELIVERY LOCATION

The contractor shall provide a satellite television service agreement to the following Albuquerque Area Indian Health Service Facilities:

Mescalero Service Unit 318 Abalone Loop

Mescalero, New Mexico 88340

PERIOD OF PERFORMANCE

The items required under this contract shall commence NLT 10 days after award:

Performance shall be for the period of August 1, 2018 to September 30, 2019, unless the period is changed by written modification to the purchase order in accordance with FAR 52.217-9, Option to Extend the Term of the Contract.

Offers for a satellite television service agreement for the specified Albuquerque Area Indian Health Service Health Center in the following format:

Price shall include all delivery charges and taxes in accordance with the statement of work.

WAGE DETERMINATIONS UNDER THE SERVICE CONTRACT ACT

Wage Determinations under the Service Contract Act by Direction of the Secretary of Labor are hereby incorporated under WD 15-5455 (REV-6) from the www.wdol.gov on 01/16/218.

CONTRACT OFFICER REPRESENTATIVE (COR)

Kristen Valdez, 575-464-3836, is hereby designated as Contract Officer’s Representative for this service. The Contract Officer Representative responsibilities will be to coordinate with the contractor the technical aspects of this service and the review of performance hereunder. The Contract Officer’s Representative does not have the authority to change or alter the order amount, terms and conditions.

The Contract Officer’s Representative responsibilities include ensuring contractor accountability, monitoring the contractor's technical progress- including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements, interpreting the statement of work, performing technical evaluations as required, performing technical inspection and acceptance required, assisting the contractor in the resolution of technical problems encountered during performance and receiving and processing invoices for payment.

ISBEE CASCADING SET-ASIDE:

Offers will be solicited from Indian Small Business Economic Enterprise (ISBEE) concerns. If we do not receive enough competition and/or reasonably priced offers from the ISBEE set-aside, we will then evaluate quotes and consider for award to other small business concerns. Any acquisition resulting from this cascading set-aside will be from such a concern as follows: First Tier: ISBEE Second Tier: all other Small Business Concerns. Offers received from enterprises that are not one of these small business concerns will not be considered.

SUBCONTRACTS:

None of the services furnished under this agreement shall be subcontracted or transferred to another contractor, or organization, without the specific prior written approval of the Contracting Officer.

IHS CONTRACTING OFFICER:

The authority to negotiate a change in terms, conditions, or amounts cited is reserved for the IHS contracting Officer. The COR designated holds no such authority.

GENERAL CONTRACT INFORMATION:

Contractor Requirements Mandated by the Federal Acquisition Regulation (FAR) to comply with the mandate, the contractor must obtain a Data Universal Numbering System (DUNS) Number. The DUNS No. is a 9-digit number assigned by Dun and Bradstreet Inc., to identify unique business entities. If the offeror (Contractor) does not have a DUNS Number, it should contact Dun and Bradstreet directly to obtain one by calling 1-866-705-5711 or via the internet at http://www.dnb.com.

Refer to FAR Clause No. 52.204-6, Data Universal Numbering System (DUNS) Number (Dec 2012).

Effective on July 31, 2012, the System for Award Management (SAM) replaced the Central Contractor Registration (CCR). During the term of the contract, the Contractor's DUNS number shall be in active status in accordance to FAR 52.204-6, Data Universal Numbering Systems (DUNS) and updated annually in the System Award Management (SAM) pursuant to 52.204-7, Central Contractor Registration (Dec 2012). You June access SAM at www.sam.gov.

Contractors/Vendors wanting to do business with the government are required to register in CCR and revalidate annually. This provides payment information, validates Small Business Administration certifications as small, disadvantaged, 8(a), or HUB-Zone businesses, calculates business size, and validates taxpayer IDs with IRS.

CONTRACTING OFFICER RESPONSIBILITY:

The authorities to negotiate changes in the terms and conditions or the amounts cited in the contract are reserved to the Contracting Officer.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Technical and past performance, when combined, are significantly more important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.217-9 Option to Extend the Term of the Contract (March 2000)

a. The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

b. If the Government exercises this option, the extended contract shall be considered to include this option clause.

c. The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

52.216-18 Ordering (October 1995)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders maybe issued from date of award through contract expiration date.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is only considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.
