This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.

a. Name and address of the proposed contractor(s).

Only the Oracle Authorized, Indian Owned Business Economic Enterprise (ISBEE) Software Licenses resellers are qualified to bid on this requirement.

b. Nature of the acquisition and proposed unique qualifications of the contractor(s).

Maintenance services for Oracle Hyperion software can only be purchased from an

Oracle l icensed vendor. Hyperion is the centralized planning, budgeting, and forecasting solution that integrates financial (UFMS) and operational planning processes, and delivers global financial consolidation, reporting and analysis in a single, highly-scalable software solution. This is currently used by IHS to support the Spend Plan and

IHS Operating Plan processes. Additionally, Hyperion Planning in conjunction with

Smart View greatly simplifies the distribution of continuing resolution funds leading up to the final budget as well as any carryovers in no year appropriations. We are currently in the middle of implementing major enhancements of the system across all IHS locations with funding allocations. Once the application is implemented, we plan to re-evaluate the number of licenses required at which time we would enter into a longer term agreement.

This will allow us to enter into only one agreement with the correct number licenses and the correct duration. If we do not wait to gain an accurate end user estimate, we could be required to enter into multiple licensing agreements starting at different points and very likely waste funding on unneeded licenses or fall short of the required license, which would require another agreement for more licenses. Typically licenses are priced based on the number required so this also would be a waste of funding and add complications to our agreement(s). Due to the previously mentioned project circumstances and constraints it is necessary to utilize the current license provider to avoid any potential interruptions in service and allow for adequate time to plan for and conduct an open competition.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.

The RFQ and this justification will be publicized on the www.fbo.gov

7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.

During the market research the contracting officer has confirm that the quotes to be received from ISBEE offerors will be comparable to the last order which was ordered via GSA schedule.

8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.

Oracle representative was contacted by the Contracting Officer to obtain an estimate via a potential ISBEE offeror.

9. Any other facts supporting the use of other than full and open competition.

NA
