JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command Naval Surface Warfare Center, Philadelphia (NSWCPD), Contracts Division Code 02.

2. Description of Action Being Approved

Award of a contract action on a sole source basis to Super Radiator Coils (SRC) (451 Southlake

Blvd, Richmond VA 23236) to purchase six (6) Advanced Carbon Dioxide (CO2) Removal Unit

(ACRU) Self-Assembled Monolayers on Mesoporous Supports (SAMMS ) sorbent canisters, Super Radiator Coil part number VA1014588.

3. Description of Supplies/Services

The proposed effort is for the purchase of six SAMMS sorbent canisters for use in ACRU design testing at NSWCPD test facilities and sparing for future fleet installation of the ACRU.

The SAMMS sorbent canisters contain the active CO2 sorbent within the ACRU and provide the necessary vehicle for desorption heat transfer and airflow routing. One ACRU contains two beds comprised of three canisters each for a total of six sorbent canisters.

The U.S. Government’s minimum needs have been verified by the certifying technical and requirements personnel.

Estimated Dollar Value ($K)

(TY$K) FY-17 TOTALS

RDT&E $240 $240

The Delivery for this effort will be fourteen (14) weeks from date of award.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1) Only One Responsible Source and No Other Supplies or Services Will

Satisfy Agency Requirements (FAR 6.302-1), as implemented by paragraph 6.302-1 of the

Federal Acquisition Regulation (FAR).

5. Rationale Justifying Use of Cited Statutory Authority

The sorbent canister design was updated as part of a separate ACRU design and qualification effort under contract N64498-16-C-5004, awarded to Hamilton Sundstrand (HSC). Prior to that contract, HSC developed the existing prototype ACRU and initial canister design for Virginia

Class under a competitively selected contract. The original prototype competitive source selection determined the current source to be the most technically suitable to engineer and design the ACRU. The HSC competitively procured prototype ACRU is now the baseline CO2 removal system for Columbia Class submarines. This baseline considers the performance on the existing prototype, a risk assessment of the existing machine’s ability to achieve the required performance for the Columbia Class submarine, and the configuration of the prototype integrating with the ongoing Columbia Class submarine design effort.

HSC has used SRC as their sole subvendor for all sorbent canister design and manufacturing efforts to this point. SRC is currently the only available vendor capable of manufacturing beds to

ACRU specifications. The only drawings available to the Government for canister production are interface control documents and general assembly drawings. These do not include engineering drawings to the level of detail required for an alternate source to reproduce the current design.

Production-level drawings were procured as part of the current HSC N64498-16-C-5004 contracting effort, but these drawings and other technical data needed to competitively procure the sorbent beds will not be available for use in procurement until 29 June 2018 per the contract requirements. Without this technical data, there is no way to competitively procure SAMMS sorbent canisters.

Program schedule requires the new design of the beds be tested as soon as possible for risk mitigation and reliability growth prior to installation of the qualification ACRU in the fleet as an

Operational Alteration (OPALT). Testing cannot be delayed until the technical data is available.

The current beds from the prototype contract have design flaws that allow sorbent to escape under some conditions. This loss results in reduced CO2 removal capacity, increased failure of valves and internal ACRU subcomponents, and may be detrimental to other ship systems that interface with ACRU. In order to ensure the design improvements have solved these issues and no further design adjustments need to be made, the new beds must be tested in the only functional full scale ACRU at the NSWCPD Life Support Research, Development, Test, and

Evaluation (RDT&E) Facility. If needed design adjustments are not discovered until qualification testing is complete, the overall ACRU schedule is likely to be negatively impacted including fleet OPALT testing and the potential to delay ACRU production acquisition.

Therefore, SRC is currently the only responsible source for this procurement and no other type of supplies or services will satisfy the Navy’s requirements. To contract with any other source would result in unacceptable delays in fulfilling the Navy’s requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

In accordance with DFARS PGI 206.302-1, a Request for Information (RFI) was posted on the

Federal Business Opportunities (FEDBIZOPPS) website on 12 July 2017. No responses have been received from the RFI posting to date, however any responses obtained will be evaluated.

The proposed acquisition Request for Proposal (RFP) N64498-17-R-4018 was synopsized in the

Federal Business Opportunities (FedBizOpps) website on 3 August 2017 in accordance with

FAR Subpart 5.2. No responses to the synopsis have been received to date, however any responses obtained will be evaluated.

No additional market research was conducted because it is not practicable for the reasons discussed in paragraph 5 above for any company other than SRC to provide the required supplies and services. Any responses received will be considered.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will make a determination that the price negotiated under the proposed contract is fair and reasonable pursuant to FAR Part 15. These non-commercial supplies have been procured by the Government in the past and they have been modified slightly for this contract to meet the updated program needs under the current ACRU contract that was issued

September of 2016. Due to these supplies being procured previously for the Government, the

Government intends to use past procurement information to prove fair and reasonableness.

8. Actions to Remove Barriers to Competition

As discussed in Section 5 paragraph two of this document, the Government does not own the rights to the technical data of the SAMMS sorbent canisters. However, noted in the same paragraph, there is an ongoing Government procurement for the rights to this technical data which is anticipated to be completed in June of 2018. The Government anticipates that obtaining the rights to the technical data will promote future competition for the ACRU SAMMS sorbent canisters. Nevertheless, as of now, SRC is the only responsible source to provide the ACRU sorbent canisters and no other suppliers will satisfy the requirement.
