Solicitation No. 17-249-SOL-00001 Janitorial Services

SECTION L- INSTRUCTIONS, CONDITIONS AND NOTICE TO OFFERORS OR RESPONDENTS

L.1 INTERPRETATION OF SOLICITATION - DISCREPANCIES

(a) The Offeror has a duty to inquire and seek clarification concerning possible ambiguities and/or discrepancies. Order of precedence is solicitation contract documents, specifications, and drawings in that order.

(b) It shall be the obligation of the Offeror to exercise due diligence to discover and to bring to the attention of the Contracting Officer at the earliest possible time any ambiguities, discrepancies, inconsistencies, or conflicts in or between the specifications and the applicable drawings or other documents incorporated by reference herein. Failure to comply with all obligations shall be deemed a waiver and release of any and all claims for extra costs or delays arising out of such ambiguities, discrepancies, inconsistencies, and conflicts.

(c) Under no circumstances will any oral statements made be binding upon the Government unless such statements or agreements are issued in writing by the Contracting Officer.

(d) Any prospective offeror desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must submit a request in writing to the Contracting Officer. Terms of the solicitation and specification remain unchanged unless the solicitation is amended in writing.

L.2 FAR 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Requirements contract for services resulting from this solicitation.

L.3 FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

L.4 PROPOSAL SUBMISSION DOCUMENTATION

The Offeror shall complete the following in order to submit a complete proposal.

(a) Standard Form SF-30, Blocks 8, 9A, and 9B.

1. Block 11 and Block 13E will be filled in when there have been solicitation amendments issued that require acknowledgement.

2. Blocks 15A, 15B and 15C.

3. Include the Offeror’s DUNS number and email address for correspondence in Block 8.

(b) Section B, Prices; a price for each, the Basic Period and all Option Periods must be filled in.

The price proposal shall be submitted with the Technical Proposal but in a separate envelope identifying it on the outside as the Price Proposal and inscribed with the Solicitation Number and the Offeror’s company name.

(c) The Technical Proposal shall be separated from the Price Proposal, refer to Paragraph 1(b), above. The Technical Proposal shall address each Criterion listed in Section M and cannot exceed 25 pages in total length. The response under Criterion 1 listed in Section M shall include the résumés of each individual proposed to perform the work described by the Scope of Work, Part I, Section C. Information provided under the four Experience Criteria listed in Section M shall cover at least five but no more than ten projects performed within the past five years. If the Offeror cannot name five projects performed in the last five years, the responses may include information that goes back in time far enough to include five projects. The Technical Proposal shall be loose-leaf, bound by a secure clip or by use of a GBC or spiral binder. Do not submit the Technical Proposal in a two or three-ring loose-leaf binder.

L.5 FAR 52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from:

(b) The copy of any protest shall be received in the office designated above within one (1) day of filing a protest with the GAO.

SECTION M- EVALUATION FACTORS FOR AWARD

M.1 EVALUATION OF OFFERS

The Government reserves the right to issue a single award or multiple awards to the contractor(s) whose quote represents the best value as defined by FAR 2.101. The socio-economic status of an offeror may also be considered, should one or more quotes represent the best value. To be eligible for contract award under this solicitation offerors shall have an ACTIVE registration in System for Award Management (SAM) database and shall have no ACTIVE Exclusions. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation will be most advantageous to the Government, non-price factors, price and other factors considered.

M.1-1 REJECTION OF UNRELAISTIC OFFERS

The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low cost when compared to Government estimates such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and or any risks of the solicitation. Any aspect of the proposal judged to be unacceptable may render the entire proposal unacceptable.

M.2 EVALUATION—COMMERCIAL ITEMS 52.212-2 (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Price

2. Past Performance – Technical Capability

3. Relevance of Experience

4. Capacity

The proposal will be evaluated based on price, other price-related factors and responses to the Evaluation Criteria. Price and other price related factors is an important aspect of the evaluation and will be assigned a weighting of 45% of the total evaluation. However, the Government is seeking to make an award for the proposal that provides the best overall value and might not award a contract to the offeror proposing the lowest rates depending on the attributes detailed in the response for the Evaluation Criteria below.

For the Evaluation Factors, this accounts for part of the total evaluation, the following criteria will be used to evaluate proposals. The percentage factors listed to the right in the table below is the percentage each criterion represents of the Evaluation Factors:
