COMBINED SYNOPSIS/SOLICITATION
(I) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
(II) This solicitation is issued as a request for quote (RFQ). Please reference solicitation number 16-ASAM-BOC-NAT-0018 on all quotes. All quotes must list the company name, address, point of contact, telephone number, email address, DUNS, and Cage code.
(III) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-83, dated November 1, 2015.
(IV) This combined synopsis/solicitation is issued as full and open competition. The NAICS code is _519190_________. The small business standard size is ___500_______.
(V) This combined solicitation/synopsis is for purchase of the following commercial products:
(VI) Description of requirements for the items to be acquired:
To obtain access to labor and employment legal information resources and original news coverage, via a subscription service, of a diverse range of local, state, regional, and national topics, including, but not limited to, labor, employment, employee benefits, human resources, health and safety, and law.
The news service must specialize in and provide extensive and on-going original coverage of all labor and employment topics to ensure that Department staff and officials are aware of all happenings related to labor and employment locally and nationally. Access to this news information must be via a customizable email subscription, an online portal containing all publications, and one copy of a print newsletter.
The labor and employment law information center must provide legal research resources and practice tools. At a minimum, these tools must include a digital full-text affirmative action compliance manual, a digital full-text Equal Employment Opportunity (EEO) compliance manual, an extensive collection of state-level labor law materials, and generic samples of a wide variety of legal letters, forms, and checklists that lawyers may build their own versions off of.
Tasks:

| The vendor must create and publish original news content that covers a diverse range of local, state, regional, and national topics, including labor, employment, employee benefits, human resources, health and safety, and law. |

| The vendor must publish this information on all week days, with the exception of federal holidays. |

| The vendor must provide access to digital versions of this news content via an email subscription service. |
| 4.2.a. |
| Staff must be able to sign up to receive an emailed copy or copies of this news content via an established listserv address or via an online portal made available to all employees of the Department of Labor. |
| 4.2.b. |
| Staff who sign up for email via the online portal must have the option to customize the content and frequency of the news content delivered to them. At a minimum, the options must include: |
i. to receive alerts when the latest articles are published throughout the day
ii. to receive an afternoon briefing of articles published throughout the current day (to be sent no later than same-day 6 pm EST)
iii. to receive a daily review of articles published throughout the current day (to be sent no later than same-day midnight EST)
iv. to receive a version of articles published throughout the current day that is customizable by headlines or by partial-text highlights and narrowed down by user-selected topics of interest (to be sent no later than same-day midnight EST)

| The vendor must make their original content available and browse-able via an online portal that is accessible only to Department of Labor employees via IP authentication. |

| The online portal must include the original content published by the vendor and must be updated throughout the day as the vendor publishes new material. |

| The online portal must provide users with the following options to search for material: |
i. Full-text general search
ii. Advanced text search that provides users with the ability to narrow searches down by date published, by topic covered, and media content included
iii. Pre-existing subject categories in, at minimum, states, law firms, unions, industries, and federal statutes, where users may click on the headings under each category to access articles tagged to match those headings

| The vendor must deliver a print edition of published news content to OSEC by no later than 8 am EST every morning of publication. |

| The vendor must provide an online portal that provides practice tools, publications, and other legal research resources in labor and employment law to OFCCP. |

| The online portal must include, at minimum, the following content: |
i. An affirmative action compliance manual published by the vendor
ii. An EEO compliance manual published by the vendor
iii. Practice tools that include generic samples of letters, checklists, forms, and HR policy manuals that lawyers may use and customize for their daily use
iv. A database of state labor and employment laws and legal materials that may be displayed in an easy-to-read format for users
(VII) Period of Performance: One (1) 12-month base period plus Four (4) 12-month option periods.

(X) Quotes will be evaluated based upon the procedures in FAR part 13.106-2. This award will be made to the vendor that represents the best value to the Government, with the evaluation based upon the Lowest Price Technically Acceptable (LPTA) quote. DOL will determine technical acceptance based upon the quoting the exact specifications in Section VI of this combined synopsis/solicitation.
(XI) The clause at FAR 52.212-3 Offeror Representations and Certifications-Commercial Items. (NOV 2015), applies to this acquisition. Respondents must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications – Commercial Items with the quote.
(XII) that the clause at 52.212-4, Contract Terms and Conditions -- Commercial Items (NOV 2015), applies to this acquisition and a statement regarding any addenda to the clause.
(XIII) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (NOV 2015) applies to this acquisition.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) of this paragraph in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

(XIV) The following DOL Local Clauses apply to this acquisition.
DOLAR 2952.201-70 – Contracting Officer’s Representative Clause
a) TBD is hereby designated to act as contracting officer’s technical representative (COR) under this contract.
(b) The COR is responsible, as applicable, for: receiving all deliverables; inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual scope of work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.
(c) The COR does not have the authority to alter the contractor’s obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If, as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the contracting officer must issue such changes

DOL 2012-02 - Contractor’s Obligation Clause "(a) Except for changes identified in writing and signed by the Contracting Officer, the Contractor is required to notify, within five working days of receipt or knowledge, any request for changes to this contract (including actions, inactions, and written or oral communications) that the Contractor regards as exceeding the scope of the contract. On the basis of the most accurate information available to the Contractor, the notice shall state:
(1) The date, nature, and circumstances of the conduct regarded as a change in scope;
(2) The name, function, and activity of each Government individual and Contractor official or employee involved in, or knowledgeable about, such conduct;
(3) The identification of any documents and substance of any oral communication involved in such conduct;
(b) Following submission of this notice, the Contractor shall continue performance in accordance with the contract terms and conditions, unless notified otherwise by the Contracting Officer.
(c) The Contracting Officer shall promptly, within 5 business days after receipt of notice from the Contractor, respond to the notice in writing. In responding, the Contracting Officer shall either:
(1) Confirm that the Contractor’s notice identifies a change in the scope of the contract and directs the Contractor to stop work, completely or in part, in accordance with the Stop Work provisions of the contract;
(2) Deny that the Contractor’s notice identifies a change in scope and instruct the Contractor to continue performance under the contract; or
(3) In the event the Contractor’s notice does not provide sufficient information to make a decision, advise the Contractor what additional information is required, and establish the date by which it should be furnished and the date thereafter by which the Government will respond.

DOL 2014-01 – Electronic Submission of Payment Request Clause DOL-NO-DM-OASAM@quickpay.dol.gov
1. Electronic PDF/TIFF Invoice Submittal - In an effort to support the eCommerce initiative and expedite vendor payment processing, the DOL requires invoices to be submitted electronically.
The contractor shall:
(a) Address the invoice to the appropriate email address specified above.
(b) Submit the invoice via attachment in PDF or TIF format.
(c) Submit only one invoice per electronic submittal.
(d) Enter specific information in the subject line of the email in the following format:
<Contractor Name>, DOL Agency, <Contract Number, BPA Call or Order Number>, Invoice Number, <Invoice Amount>
Example: ABC Co, OASAM, DOL00-00-X0000/X0000, Invoice Number AB-1298433, $15,000.00.
(e) Submit a copy of the email with the attached invoice to the contracting officer's representative (COR) at the COR email address specified in the contract.
(f) Wait for either a success or failure email response, regarding the invoice email, before sending in another email with the same invoice attachment.
The contractor MUST NOT:
(a) Submit an invoice that exceeds the size limit of 16 megabytes (approximately 400-500 pages). However, if the invoice exceeds this limit, a summary invoice attachment of less than 16 megabytes should be emailed to the payment email address above; while the detailed invoice, including any supplemental information, shall be sent to the COR or other representative at the address (specified in paragraph 2 below).
(b) Submit an invoice that is heavy in shading or color.
(i) An emailed PDF image cannot have any text that has a background with any color other than white. If the image has a shaded background, it will be converted to black, and the text will be illegible.
(ii) An emailed TIF image must be black and white.
(c) Submit more than one attachment, as subsequent attachments will not be recognized.
(d) Submit more than one invoice in a single attachment.
(e) Attempt to use the “Recall or Resend” email message feature.
General Information:
Payment due dates will be calculated only from the date that invoices are received in the electronic invoicing email box and determined to be proper invoices.
Inquiries regarding invoices should be emailed to XXXInvoiceInquiries@dol.gov. The relevant invoice must be attached to the inquiry email and the subject line of the email must state “INQUIRY,” followed by the information described in paragraph 1). d. above.
Example: INQUIRY: <Contractor Name>, DOL Agency, <Contract Number, BPA Call or Order Number>, Invoice Number, <Invoice Amount> Do NOT use the electronic invoicing email address for inquiries about the invoice.
2. Paper Invoices submitted via fax or U.S. mail
Paper invoices should only be faxed or mailed when electronic email cannot be accomplished.

DOL 2014-03 – Section 508 Clause- (JUNE 2014)
Section 508 of the Rehabilitation Act, as amended in 1998 by Public Law 105-220 (the Workforce Investment Act), applies to Federal Agencies and the Contractors acting in support of the Agency. The Contractor is required to provide Section 508 systems and components when Federal agencies develop, procure, maintain, or use Electronic and Information Technology (EIT). The contractor shall ensure that its system and components allow Federal employees and members of the public with disabilities to access and use of information and data that is comparable to the access afforded Federal employees and members of the public who are not individuals with disabilities. The term electronic and information technology includes, but is not limited to, computers, printers, software applications, telecommunications products (such as telephones), information kiosks and transaction machines, Internet/Intranet sites, multimedia, and office equipment such as copiers and fax machines.
For all EIT procured, maintained, developed or used at DOL to include electronic documents, software, websites and webpages created or maintained by the Contractor, in order to meet Section 508 accessibility requirements, the Contractor shall:
1. Provide summary narrative text descriptions or a data tables describing each complex graphic (e.g., pie graphs, line graphs, maps, bar graphs, flow charts) in a separate comma-separated values/character-separated values (CSV) file.
2. Label each figure or graphic image with an alternate text description.
3. Contracted vendor support staffs producing EIT deliverables must have a working knowledge of Section 508 and performing Quality Assurance Testing for Section 508; must include this information for the individuals proposed on the contract.
4. Contractors are responsible for having updated authoring and testing tools to produce Section 508 output on their own; the Government will not provide these tools.
5. Unless otherwise stated in the specification of the Contract, two digital copies of any report over 25 pages shall be delivered in media formats readable by Windows-based programs; one copy shall be formatted in Microsoft Word and the second shall be in the Portable Document Format (PDF). Color and/or black & white PDFs are acceptable. Unless permitted by the specifications, reports shall not be submitted in HTML format.
