JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0232, Philadelphia, PA.
2. Description of the Action Being Approved
This is a sole source action to be awarded without providing for full and open competition. The proposed contract action will result in a new firm fixed price contract to be awarded to SSS Clutch Company Inc., 610 West Basin Road, New Castle, DE 19720 for various quantities of starter clutch systems to be utilized on existing generator systems on US Navy ships.
3. Description of Supplies/Services
The NSWCPD intends to procure a total quantity of seventy five (75) SSS Clutch Kits Size 38FT, Part Number 19361. The estimated dollar value of this procurement is $1,344,075. Funding planned for this acquisition is FY16 Other Procurement Navy (OPN) funds. Delivery is expected to be within 364 days after the contract is awarded. Partial deliveries prior to the delivery date are acceptable.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This acquisition is to satisfy the minimum requirements of the Naval Surface Warfare Center, Philadelphia Division, which initiated the requirement. This justification does not authorize other requirements.
4. Statutory Authority Permitting Other Than Full and Open Competition
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements” as implemented by Federal Acquisition Regulation (FAR) 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority
The Ship Service Gas Turbine Generator (SSGTG) aboard the DDG 51 Class surface ship features a Rolls Royce 501K-34 gas turbine engine as the primary power producer. This engine is equipped with a redundant independent mechanical air start system (RIMSS) Model 250-kS4 small gas turbine engine.
This starting system requires a reliability upgrade, referred to as the SSS Clutch Kit. The SSS Clutch Kit is manufactured by SSS Clutch Company Inc.
To manufacture a SSS Clutch Kit requires access to, and knowledge of, the engine and the starter and gearbox operational requirements, manufacturing tolerances, techniques and procedures, herein referred to as “prerequisite technical data”. SSS Clutch Company Inc. is the only known vendor with the “prerequisite technical data” and SSS Clutch Company Inc. is the only approved manufacturer with the specialized expertise to manufacture and deliver a SSS Clutch Kit for use on the aforementioned surface combatants.
The proposed acquisition covers the procurement of seventy five (75) SSS Clutch Kits (P/N 19361) to be used for implementation in the marine gas turbine back-fit program under Ship Change Document (SCD) 4638. Procurement of these components with a different design, even though they may possess similar performance features, would be impractical since they may not function properly in the SSGTG drive train. This would result in greatly increased life cycle costs due to the need to provision and procure alternate SSGTG components, and or transition parts, and the need for additional training of shipboard and pier side personnel in its operation and maintenance. It would also have detrimental impact on standardization and configuration control with its related costs of repair planning and documentation.
SSS Clutch Company Inc. is the original designer, developer and sole manufacturer of the SSS Clutch Kit. As a result, SSS Clutch Company Inc. is the only source with the complete technical data package, including drawings essential to furnish the SSS Clutch Kits. The Government does not possess, has no legal right to, and is unable to independently develop the prerequisite technical data for procurement on the basis of full and open competition. Based on the above, the SSS Clutch Company Inc. SSS Clutch Kits covered by the proposed acquisition are considered unique supplies available only from SSS Clutch Company Inc.
6. Description of Efforts Made to Solicit Offers From as Many Offerors as Practicable
The proposed contract action was synopsized via posting on the Federal Business Opportunities (FEDBIZOPPS) website on 27 May 2016 as required by FAR 5.201(b)(1). While to date, no responses have been received to the synopsis notification, any responses obtained will be evaluated. No additional market research was conducted because it was deemed not practical for the reasons discussed in Paragraph 5 above.
7. Determination of Fair and Reasonable Cost
Prior to award, the Contracting Officer will determine whether the cost to the Government for the material covered by this Justification and Approval is fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, the Government has no plans at this time to compete future contracts for the type of supplies covered by this procurement. If another potential source emerges, the Government will assess whether competition for future requirements is feasible.
