Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity:

This request is a Justification for Other Than Full and Open Competition for requisition # 770-19-2- 801-0086. The purchase request is for Buspirone HCL 10MG (100 count and 1000 count), which is a prescribed medication to treat certain anxiety disorders or to relieve the symptoms of anxiety.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
a. 10MG – NDC 00591-0658-10 for B0195 BUSPIRONE HCL 10MG TAB (qty. 500 bottles)
b. 10MG NDC 00591-0658-01 for B0195 BUSPIRONE HCL 10MG TAB (qty. 3000 bottles)
c. Estimated contract value: $244,500.00
d. Delivery date is 1-2 weeks after receipt of order.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The referenced pharmaceutical, Buspirone HCL, has been in high demand across the seven CMOP facilities but in very low supply from vendors. It has been listed as number one (10MG), six (15MG), and eight (5MG) on the on National CMOP’s “Top Ten 007 Prescriptions Canceled” report (see attachment 1). Several competitive solicitations have been issued for this pharmaceutical with little or no success in awarding to a vendor due to critical shortages. The list of recent and ongoing solicitations is:

Sources sought notice 36C77019Q0236, posted to FBO.GOV on 01/11/2019 and a closing date of 02/28/2019, has received zero responses to date.
Tri-Pharma is the only vendor that has product availability and is able to provide the product immediately (1-2 weeks).
4. Description of market research conducted and results or statement why it was not conducted:
This is an emergency procurement for Buspirone HCL. The CO is unable to determine that two or more (or a combination) SDVOSB’s, VOSB, or SB can provide the product at a fair and reasonable price within the timeline required to ensure an uninterrupted supply of Buspirone HCL. This product is not available from the federal prison industry (FPI), Ability One, DLA or GSA.
